The scientific research reflected in the content of this study is devoted to the main theoretical, legal and practical issues of administrative liability for domestic violence against a child. The purpose of the study – outline the specific features of protection of a child's right against domestic violence in Ukrainian legislation and identify the factors which indicate the necessity to distinguish domestic violence against a child as an administrative offence with more serious consequences, and, accordingly, to apply a more severe penalty to the offender. According to the purpose and specifics of the subject matter of the study, the author has applied a set of methods: philosophical methods – dialectical, phenomenological and others; general scientific methods: systematic, induction, deduction of analysis, synthesis, analogy, comparison; and methods of a specific legal science: comparative-legal, legal statistics, legal generalisation, legal analysis, formal-legal etc. The study examines the definition of domestic violence under Ukrainian law and summarises some ways to counteract this phenomenon. It is emphasised that the Code of Ukraine on Administrative Offences does not distinguish between the specifics of administrative liability for domestic violence against an adult and a child. However, according to statistical studies, the number of children suffering from domestic violence is increasing every year. It highlights the relevance of the study. The practical value is that the study identifies and characterises the main theoretical, legal and practical issues of administrative liability for domestic violence against a child, and develops substantiated proposals for amending Article 173-2 of the Code of Administrative Offences
The purpose of the study is to study the techniques and methods of cognition of legal phenomena, to conduct a scientific analysis of the rights of the child as a legal phenomenon, to identify general patterns, and to formalize and generalize the rights of the child at the global and national levels. The methodological basis of the study was the use of a set of methods necessary for the realization of the scientific goal and the fulfillment of the tasks set, in particular: analysis of the rights of the child in international documents and legislation of Ukraine, the method of generalization, hermeneutics for the interpretation and processing of texts of normative and doctrinal sources, other philosophical, general scientific and special methods. The scientific novelty is that the author for the first time considers the rights of the child as a legal phenomenon that has specific features depending on the subject, types and age of the child. The author highlights the methodological foundations of cognition of children's rights at each stage of their development and suggests the use of a number of the above methods. The scientific tools for cognizing the rights of the child are structured. The study of children's rights is a complex and multifaceted process of human thinking which is necessary for improving legal mechanisms and protecting the rights of minors. The methods and techniques of cognition depend on the specifics of the legal phenomenon and the field of cognition. However, the scientific approaches, methods and principles of scientific research of children's rights considered in our study should be applied in a comprehensive manner, avoiding contradictions and refutation of the results obtained using various tools. All these methodological tools prove their value at every stage and in every segment of the study. Depending on the object of knowledge, it is obvious that a certain methodological toolkit prevails for the realization of a specific research task. Based on the study, a number of generalizations have been formulated, including the following: scientific cognition of children's rights is impossible without a well-chosen methodology; the methodology of scientific cognition of children's rights is a complex phenomenon which encompasses the structure and system of legal scientific knowledge, its theories and concepts. The methodological foundations of cognition of children's rights form a multi-level system that is developed by the principles of scientific knowledge, the dominant worldview, the type of scientific thinking, philosophical foundations, scientific paradigms, methodological approaches and scientific methods
The article is dedicated to investigation of different approaches in the field of juvenile prevention and juvenile justice. The article examines the features of juvenile justice and juvenile prevention in different countries, in particular, in the United States, Britain, France, the Netherlands, Germany, Italy, Ukraine. The existing models of organizing the activities of the juvenile police, other specialized bodies and institutions for children operating in foreign countries are considered. The issues of organization and implementation of crime prevention among children in different countries of the world have been studied. Special attention is paid to the US experience in the field of juvenile justice and juvenile prevention. In particular, the system of specialized bodies and institutions for children in the United States was studied. International systemic acts on the settlement of juvenile liability are analyzed. The analysis of world models of juvenile justice, in particular, Anglo-Saxon, continental, Scandinavian, is carried out and their peculiarities are singled out. The positive features of each of these models, which can be borrowed, in particular, by Ukraine, have been identified.
