Program Studi Ilmu Hukum di Universitas Terbuka memberikan peluang kepada siapapun, di manapun, dan kapanpun untuk menemempuh pendidikan tinggi sebagai sarana meningkatkan kompetensi diri dalam bidang hukum. Kurikulum dirancang dan diperbarui sesuai dengan kebutuhan mahasiswa selama studi. Untuk mengukur ketercapaian kompetensi lulusan dalam dunia kerja perlu dilakukan penelurusan melalui tracer studi. Hal ini menjadi tantangan tersendiri karena beragamnya lulusan yang tersebar di seluruh wilayah Indonesia. Dengan metode penelusuran melalui penyebaran kuesioner yang disebar melalui email, aplikasi whatsapp, dan melalui hubungan telepon dilakukan untuk mencapai sampling sebesar 25% dari keseluruhan lulusan. Prodi Ilmu Hukum baru mulai meluluskan pada tahun 2017, hingga 2019 sudah tercatat terdapat 1.402 lulusan yang terjaring dalam tracer study. Berdasarkan hasil yang diperoleh dari penelitian ini, lulusan Prodi Ilmu Hukum bekerja pada bidang hukum dengan presentase lebih dari 90%. Dari keseluruhan lulusan mendapatkan manfaat dengan gelar sarjana hukum, yaitu mendapatkan pekerjaan di bidang hukum atau mendapatkan manfaat atas gelarnya di instansi tempat dia bekerja sebelumnya
Protection for migrant workers requires intervention throughout the migration cycle. Moreover, it raises awareness about safe migration before departure, ensuring effective migration policies and mechanisms, ensuring fair recruitment practices, decent working conditions in destination countries, and economic empowerment and reintegration to the home community for retired Indonesian Migrant Workers. However, illegal hiring practices can leave workers trapped in debt-bound situations to go abroad. Often workers are not appropriately trained and do not understand their rights, so they are easily exploited. So the problem arises in this study how to fulfil the legal protection of Indonesian migrant workers? And how can legal literacy improve the protection of Indonesian migrant workers? The study results show that Indonesian migrant workers need state intervention to protect the stage before work, during work, and after work but also need to equip themselves with qualified legal insight. The qualified legal insight will increase the capacity of Indonesian migrant workers and will enable them to face every problem they face. Legal literacy is an urgent matter to be "familiarized" with Indonesian migrant workers. Legal literacy will build awareness of Indonesian migrant workers in understanding various legal aspects, especially those related to the activities of Indonesian migrant workers. Distance education can be a way to improve the legal literacy of Indonesian migrant workers.
Indonesian migrant workers are foreign exchange heroes, and their presence can get better welfare for their families and surrounding communities. However, the state's contribution to Indonesian migrant workers is still not maximized. It can be seen in several cases faced by Indonesian migrant workers in destination countries. One of the main factors causing various legal problems faced by migrant workers is the lack of knowledge and skills in the practical field of law related to their work and work environment. This paper will discuss legal literacy as the determinant factor to be mastered by Indonesian migrant workers to survive working in other countries. This socio-legal research uses a qualitative approach; the data used are primary that have been collected for the last three years (2020-2022, and secondary data. Primary data is based on survey results (2020) and FGDs with experts conducted in the previous three years. The secondary data comes from journals, books, reports, and other related articles. This paper concludes that the distance education and learning platform with continuing education (non-degree) service format is the most suitable and efficient design for providing access to education for migrant workers to survive their life in overseas.
The purpose of this study is to determine whether there are implications of expanding the authority of the pretrial post-verdict judicial review of Constitutional Court in deciding whether it is a valid determination of the suspect against law enforcement and the protection of the rights of the suspect. This research belongs to normative research. The results of this study explain that the interpretation method used in pretrial decision No:04/Pid.Prap/2015/PN.Jak.Sel is the method of discovery of analogy interpretation law (argumentum per analogiam) is wrong, while the legal interpretation method used in the judicial review judgment of the Constitutional Court of the Republic of Indonesia Number 21 / PUU-XII / 2014 is the historical interpretation method (historiche intepretatie) the problem namely, the Constitutional Court has exceeded its original function that is negative legislator became positive legislators form or add a new norm. So that raises the problem that is contrary to the principles of the criminal justice system that is the principle of quick and simple and low budget justice and the principle of litis finiri oportet also inhibits the process of law enforcement settlement.
