There are many people with disabilities in Indonesia. However, the government has not fulfilled the rights of persons with disabilities according to the provisions in the laws and regulations on persons with disabilities. This study aims to analyze concessions for persons with disabilities in Indonesia: fundamental problems and offered solutions. This research is a normative study using the Literature Review study approach, namely by examining and analyzing data. The results of the research show that the government has not guaranteed the rights of persons with disabilities in Indonesia, so it is essential to issue government regulations that regulate the type and amount of concessions as a form of creating legal certainty for persons with disabilities. This concession is essential to implement in Indonesia because it can reduce the barriers for persons with disabilities to access essential services to increase their income and economic participation.
ABSTRAK<br />Penelitian ini bertujuan untuk membahas mengenai pertimbangan Mahkamah Agung mengabulkan permohonan Kasasi yang diajukan oleh Penuntut Umum dengan membatalkan putusan Judex Facti Pengadilan Tinggi dalam perkara penipuan menggunakan Cek dan Bilyet Giro kosong pada putusan Mahkamah Agung Nomor 678K/Pid/2016. Metode penelitian yang penulis gunakan yaitu penelitian hukum normatif yang bersifat preskriptif dan terapan dengan menggunakan pendekatan kasus. Hasil penelitian menunjukan bahwa pertimbangan Mahkamah Agung dalam membatalkan putusan Judex Facti Pengadilan Tinggi telah sesuai dengan Pasal 193 ayat (1) KUHAP dan Pasal 51 ayat (2) Undang-Undang Mahkamah Agung. Pasal 193 ayat (1) KUHAP yang pada intinya menyatakan jika pengadilan berpendapat bahwa terdakwa bersalah melakukan tindak pidana sesuai dakwaanya maka Terdakwa dijatuhi pidana. Berdasarkan keterangan saksi, keterangan terdakwa dan barang bukti surat yang menyatakan Terdakwa telah memenuhi unsur yang ada dalam tindak pidana penipuan secara sah dan meyakinkan maka dijatuhi pidana penjara. Mahkamah Agung mengadili sendiri perkara ini dengan membatalkan putusan Judex Facti Pengadilan Tinggi dan mengeluarkan amar putusan Mahkamah Agung Nomor 678K/Pid/2016 yang menyatakan Terdakwa dijatuhi pidana penjara selama 1 tahun 8 bulan.<br />Kata Kunci: Kasasi, Pembatalan, Penipuan<br />ABSTRACT<br />This study aims to discuss the consideration of the Supreme Court to grant the Cassation petition filed by the Public Prosecutor by canceling the decision of the High Court Judex Facti in a fraud case using blank Checks and Bilyet Giro in the Supreme Court decision number 678K/Pid/2016. The research method that writer use is normative legal research which is prescriptive and applied by using case approach. The result of the research shows that Supreme Court’s consideration in canceling Judex Facti descision of Court of Appeal has been in accordance with Article 193 paragraph (1) of Criminal Procedural Law and Article 51 Paragraph (2) of the Supreme Court law. Article 193 paragraph (1) Criminal Procedural Law of the criminal procedure code which basically state if the court is of the opinion that the defendant was guilty of a criminal act according to his indictment so the defendant was convicted. Based on witness testimony, the statement of the defendant and the items of evidence that stated the defendant has fulfilled the element in the criminal act of fraud legally and convincingly then sentenced to imprisonment. The Supreme Court hears this case by canceling the high court Judex Facti ruling and issuing a Supreme Court Decision Number 678K/Pid/2016 which states that the defendant was sentenced to 1 year and 8 months imprisonment.<br />Keyword : Cassation, Cancellation, Fraud
