O presente artigo possui por escopo a reflexão sobre as possibilidades de efetivação da proteção ao consumidor no mercado de consumo frente a produtos nanotecnológicos, mesmo ante a ausência de marcos regulatórios específicos. Partindo das constatações dos benefícios e das potencialidades das novas tecnologias de manipulação da matéria em escala extremante pequena, verifica-se que poderão trazer riscos ao consumidor, reconhecidamente vulnerável nas relações de consumo. Mesmo assim, percebe-se que não é prática dos fornecedores de nanoprodutos apresentar tal informação, fator essencial para a educação e para a formação da decisão do consumidor. Desta forma, e ante a principiologia constitucional e de defesa do consumidor, concluiu-se que mesmo com a ausência de marcos regulatórios, é dever do fornecedor, e direito do consumidor, a ser informado, tendo em vista que tal aspecto é essencial para a tutela social, e obrigação de todos os agentes sociais ante o solidarismo constitucional.
Contemporary liberal democratic societies are marked by complexity and the fact of pluralism and diverse visions of goods. How to articulate them, and how to provide solutions to conflicts? The current predominant perspective of liberal theory does so through the proposal of consensual possibilities; but from this perspective a problem arises: can there be consensus without prejudice to democratic practices and political action, which is an essential mark of a plural society, and which presupposes the non-exclusion of the other and equality as a constitutional foundation? Faced with this issue, there is a need to (re)think practices of expression of the plural, not excluding conflict, articulatory aspects and recognition of the different, as it marks a plural society, and its reflexes in the construction of a public space as a space for the expression of diversity and conflict, and, therefore, of the democratic. The hypothesis is that the conflictive condition can and should be understood as productive for the recognition of plural expressions both in politics and in law, both in democracy and constitutionalism, and from them not being extirpated, but transformed into agonism, acceptance and plural expression. The main objective is to analyze how the conception of agonism, conceived by Chantal Mouffe, can contribute to the understanding of necessary articulations and implications between law and politics, constitutionalism and democracy in order to build meaningful and productive perspectives. Thus, for the development of the research, contributions were sought in political theory and constitutional theory, whose foundation was given, especially, from Chantal Mouffe, Post and Siegel, and Vera Karam de Chueiri. The method used was deductive, testing assumptions to verify possible conclusions; the research technique was bibliographic, developed from research in works and articles. At the end of the research, the hypothesis was confirmed.
ResumoObjetiva-se analisar o conceito e desdobramentos da "colonialidade do poder", termo desenvolvido por Aníbal Quijano, que se tornou sistema hegemônico de padrão de poder, saber e ser, eurocêntricos. Este sistema desembocou em exclusões sociais, baseadas na ideia de hierarquização de raças, reproduzidas nos sistemas de produção capitalista e nos de controle social, como as estruturas do poder estatal e do direito. Este modelo está em crise, haja vista sua crescente limitação para a inclusão social, encontrando alternativa possível no socioambientalismo. Para análise do cenário exposto, utiliza-se de metodologia interdisciplinar, buscando vertentes sociológicas e jurídicas. This system has led to social exclusions, based of hierarchization of races, reproduced in the capitalist production and social control systems, such as the structures of the state and law powers. Currently, this coloniality model has been questioned considering its increasing limitation to social inclusion, and likely alternative is socioenvironmentalism model. For the analysis of presented scenario, an interdisciplinary methodology is used, in search of sociological and legal dimensions.
