It is therefore questionable whether or not traditional law is still at the forefront.The institute of " disregard " still shows itself to be far from reaching consensus on doctrine, visible in the diverging streams related to its implementation [9] .We will therefore present the general aspects of the issue, respecting what the pro Pósito has been said by the authors of the area and in a special way to present some problems that the application of the disregard of the Institute of legal personality of commercial companies raises, this is the goal .We believe that the arrangements under corporate law associated with the Instituteabuse of right in civil law, it would be enough m to solve problems that did arouse piercing the corporate veil.We will, of course, deal only with the lack of consideration in the field of commercial companies, because it is where the debate has gained greater weight.
The most recent Industrial Property Code of Mozambique (CPIM), approved by Decree 41/2015 of 31 December, brought, among other innovations in the field of trademarks, the consecration of the olfactory brand, one of the "new complex in terms of distinctive capacity and graphic representation, the latter being a very controversial aspect in the field of registration assumptions of the new brands. Although the problem of graphic representation has been circumvented by the European Union trademark law in accordance with its new Trademark Directive ( (EU) 15/2436 of Parliament and Council of 16 December 2015) which has removed it from the range of requirements of the trademark concept; many legal systems such as Mozambican law still maintain it. In fact, the reason for this theme is: to study the olfactory mark and its tutelage in Mozambique. The graphic representation of the new brands, and especially of the olfactory mark, is generally problematic. It seems that the new Industrial Property Code of Mozambique has been daring to consecrate this type of mark following the brand name (of the same species was provided for in the previous Code without however having known a single application for registration so far among other possible reasons, due to the difficulty of graphical representation. Will not end the olfactory mark by following the same path and be another type of trademark foreseen in CPIM without any registration? Nevertheless, with the consecration of the olfactory mark, the attention of the Mozambican legislator must be recognized and welcomed by the dynamics of the types of brands that currently have as a whole the new brands as an undeniable reality.

Para o efeito, importantes conceitos da sociedade de informação e do comércio electrónico em especial serão expotos antes da questão crucial razão do tema que aqui curaremos desenvolver.É com efeito, nosso maior desejo que o leitor possa aqui encontrar elementos que possam alimentar o espírito aceso às questões do comércio electrónico.
A defesa do "Património" contra atos atuais que o ponham em causa ou potenciais riscos de o perder, é uma atitude natural do homem e, por essa razão, tudo faz, quer sob o ponto de vista de facto, quer sob o do direito para que essa sua esfera particular seja respeitada por todos. É assim que, no domínio das Sociedades Comerciais (Entidades com base nas quais se realiza, grosso modo, a atividade empresarial formal), há separação entre o seu património (aquele necessário para a prossecução dos fins da Sociedade destas) e o património pessoal dos sócios que dela fazem parte. A minimização do risco do património pessoal dos sócios, por forma a tranquilizar e a incentivar a atividade empresarial, terá sido um dos motivos dessa separação patrimonial (da Sociedade em relação ao dos sócios). Contudo, a experiência mostra que os sócios podem aproveitar-se da separação patrimonial da Sociedade em relação ao seu património (o que, nos termos da Lei, traduz-se na responsabilidade limitada da Sociedade) para prejudicar terceiros, normalmente, credores, invocando, exatamente, essa separação patrimonial, e assim furtarem-se às obrigações que teriam com esses terceiros através da Sociedade.
