The consolidation of the principle of supremacy in international documents is described. It is established that the rule of law in the work of the UN has become a subject of constant discussion. It has gained significant momentum since 2007, establishing itself as one of the most important areas of the organisation. UN documents define the rule of law as a principle or as a sphere of activity of the Organisation and member countries. In their report, the UN Secretary-General divides the rule of law into three sectors: the rule of law at the international level, the rule of law in the context of conflict and post-conflict situations, and the rule of law in the context of long-term development. The UN Secretary-General’s annual reports continue to work to promote the rule of law at the national and international levels. UN activities and documents demonstrate that strengthening the rule of law at the international level is impossible without the promotion, observance, and implementation of international treaties, the settlement of disputes by peaceful means, and the protection of human rights that are inextricably linked to the rule of law principle. Areas of activity that strengthen the rule of law are identified. The content of the resolutions “ Rule of Law at the national and international levels” was analysed, based on the results of generalisation of the content and direction of the sessions of the General Assembly during the last fifteen years, the directions of activity within this framework were determined. The rule of law is recognised as one of the fundamental principles of the European Community and enshrined in its regional acts. The elements of the principle of the rule of law are identified based on the results of generalisation of the case law of the European Court of Human Rights. It is established that in the European region a great role in the development and interpretation of the concept of the rule of law is played by its judicial interpretation, which is engaged in by two international judicial institutions: the ECtHR and the European Court of Justice. The rule of law is represented in the work of the Organisation for Security and Co-operation in Europe (OSCE) and plays a significant role in the promotion and protection of human rights. A significant contribution to the development of regulations for the implementation of the rule of law at the international level was made by the International Non-Governmental Organisation “World Justice Project”, which developed in 2010 the Rule of Law Index. The indicators of measuring the rule of law index in the country are characterised and their analysis in the dynamics at the international level and the distribution of the rule of law index by factors in Ukraine
The purpose of the article is to determine the civil legal features of an autonomous car as a source of damage. When developing a computer program responsible for driving an autonomous car, the issue of its compliance with ethical standards (morality) should be resolved. That is, to develop the ethics of artificial intelligence taking into account the priority in the selection of the population of a particular region. It is noted that there is a legislative basis for the use of autonomous cars in many states (the USA, the Netherlands, Great Britain, France and Germany). Ukraine has no legislation allowing such self-driving cars to be used on the roads of the country, where a driver must steer a car. According to automobile experts, the use of autonomous cars in Ukraine is also impossible due to the unsatisfactory state of its roads. It was concluded that the technology of development and use of autonomous cars should be supervised by the Government by developing uniform requirements both for the cars and the software. Such a document was adopted by the Parliament of Great Britain. The issue of compensation for damage caused by such a vehicle is decided in accordance with the Civil Code of Ukraine. It has been concluded that an autonomous car is a special vehicle as it is controlled by a computer. Neither the car manufacturer nor its software developer can be regarded as subjects of civil liability for the damage caused by an unmanned car. This conclusion is grounded on the fact that autonomous car is a source of increased risk as it has the following features: damage-causing properties; impossibility of complete control on the part of the person over the manifestation of damage-causing properties of material objects; increased probability of causing the damage. The subject of civil liability for damage caused by an autonomous car as a source of increased danger is a person who, on an appropriate legal basis, owns the vehicle. The owner of an autonomous car has the right to apply with a reverse claim (regression) to his manufacturer due to defects of the goods.
Taking into account the ongoing democratic transformations in our country, the decentralization reform deserves special attention, which is aimed at ensuring broad independence of territorial communities in solving their own socio-economic problems of a particular region. One of the key issues of such a reform is the formation of capable administrative-territorial units, endowed with full power not only in terms of administrative management but as full owners of the relevant resource base grounded on land. Unfortunately, the transformations carried out in Ukraine through privatization in general and privatization of land and legislative consolidation of new forms of land ownership have led to uncertainty about the object composition of communal land ownership, failed to ensure social harmony, creating crisis phenomena of demographic and socio-economic nature, especially in rural areas. As a result, the legal model of state regulation of land relations remains incomplete, in which the balance of private and public interests in land use within territorial communities would be ensured by law, which determined the content of the study. The work analyses the theoretical and normative principles of land ownership, in particular, the conclusion that the form of land ownership due to its functional purpose and special subject-object composition, determines the mechanism of formation and termination of ownership. Scientific conclusions and recommendations are formulated, on which it is expedient to build a modern state policy on the formation and establishment in society of the concept of communal ownership of land as a basis for the effective development of territorial communities. According to the results of the study, the need to change the administrative-territorial division by regulating the community at the constitutional level as the primary administrative-territorial unit, which is the basis for the formation of communal land ownership. Amendments to the Land Code of Ukraine are proposed in order to determine the right of communal ownership of land within territorial communities.
The goal of the article is to develop proposals for the improvement of the existing normative legal documents regulating UAVs application in the surveillance of the state border of Ukraine. The research methods have been selected based on the goal and tasks of the research. A complex of general scientific and special-scientific methods has been used in the process of the research. In particular, the use of comparative and formal-logical methods made it possible to investigate the evolution of legal regulation of UAVs application by the law enforcement agencies and military formations in Ukraine. The logical and legal method has been used for the development, argumentation and determination of the directions of improving the legal regulation of UAVs application in the process of the state border surveillance. The article reveals the proposals for the improvement of the existing normative legal documents regulating unmanned aerial vehicles (UAVs) application in the surveillance of the state border of Ukraine. It is concluded that UAVs application is effective in the surveillance of the state border of Ukraine, since information obtained with the help of these aerial vehicles allows to effectively and rapidly establish facts of the state border violation and detain its violators.
