Comparing the 2021 Rule of Law Index, 2021 Legatum Prosperity Index, 2021 Education Rankings by Country, 2021 Times Higher Education, 2021 QS World University Rankings has demonstrated that there is a clear correlation between adherence to the rule of law in the state and the legal culture, education and academic integrity. It is proved that the higher the level of adherence to the rule of law, the higher is the level of legal culture and, accordingly, the level of quality of education and observance of academic integrity. The issues of academic integrity are issues of each country, but the factors influencing academic integrity differ significantly between countries, between different regions, and depending on cultural values. Cultural differences also affect the perception of academic integrity in the world. It is noted that there are several problems with observance of the academic integrity in Ukraine. The attitude to the issues of academic integrity in Ukraine directly depends on the ethical principles and values in society and legal culture. It is concluded that the implementation of academic integrity values requires changes in the system of education and scientific activity in Ukraine. The academic community must be a true advocate of academic integrity and actively strive for its implementation in the everyday institutional life of its members. Universities, faculties and teachers have a significant role to play in communication, strengthening and securing values of academic integrity and policy of the educational institution, academic culture and legal culture in general. Today it is important for Ukrainian institutions not only to create policies, procedures and rules in the field of academic integrity but also to introduce them into the everyday life of the such institution, to constantly improve them, to form academic culture, legal culture and respect for the rule of law.
The article considers the mechanisms of realization of labor and social rights of prosecutors. The authors investigated that prosecutors are subject to both general labor legislation (norms of the Labor Code of Ukraine) and special ones established by the Law of Ukraine "On the Prosecutor's Office", which emphasizes the special legal status of these employees. Acquisition of legal status by prosecutors as subjects of labor law allows them to exercise their constitutional rights and responsibilities. These elements of the legal status of prosecutors should be considered in close connection with the employment relationship and social rights in which these prosecutors are involved. The authors found that an integral part of the legal status of prosecutors are guarantees of labor and social rights - legal norms that establish ways and means of ensuring the rights and freedoms of prosecutors, their protection and restoration during office and retirement. The study found that an important role in improving the legislation of Ukraine in the field of labor relations with prosecutors and their social rights are played by familiarity with international regulations (Conclusion of the Advisory Council of European Prosecutors № 9 (2014 (Rome Charter), Conclusion № 13 (2018) of the Advisory Council of European Prosecutors) which regulate labor and social guarantees for prosecutors. Problematic issues and gaps in the provisions of Ukrainian legislation in the field of labor and social security relations with prosecutors were investigated. The authors also developed ways to eliminate them by preserving existing and creating new norms that meet national characteristics. The importance of this study is that this system of government has a significant impact on the implementation of responsibilities for the protection of human rights and freedoms, the common interests of society and the state.
The article considers the international experience of legal regulation of the labor of minors and identifies promising areas for improving the current labor legislation of Ukraine in the field of the work of minors. In particular, the authors studied the labor legislation of the Latvian, Lithuanian, Slovak, and Estonian Republics, Great Britain, and the provinces of Canada (Alberta and Manitoba). As you know, the regulation of the labor of minors has certain features both in Ukraine and other countries, given their physiological characteristics and lack of experience. The minimum age for employment, hazardous and prohibited types of work, working hours, wages, days off and vacations, types of work permits for minors (light types of work), and liability for violation of the requirements of labor legislation on the adoption to work and the peculiarities of ensuring the labor activity of minors. Based on the study, it was revealed that the current labor legislation of Ukraine requires the improvement of the regulation of the labor of minors in the context of social changes. Thus, the types of activities where it is allowed to use the labor of minors are not regulated; there is no definition of the term “easy work for minors,” and the possibility of labor of persons under 14 years of age is not regulated, and the legal liability of employers for violating the requirements for hiring and the specifics of the work of minors is imperfectly defined. In general, the current Labor Code of Ukraine includes provisions for the regulation of the labor of minors, consistent with the standards adopted in other countries. Also, the authors have developed directions for improving the current labor legislation of Ukraine on the labor of minors, which in the future should protect minors from ignoring employers of the fixed requirements for hiring and the characteristics of the work of such a category of persons and protect them from further violations of labor legislation, as well as help to realize the right for the work of persons under 14 years of age who seek to earn independently in certain areas of activity.
Забезпечення національних інтересів у сучасних умовах ставить перед Україною важливе завдання -членство в Європейському Союзі (далі -ЄС). Так, у світлі євроінтеграційних процесів неможливо залишити поза увагою, зокрема, унікальність та ефективність трудового права ЄС. Адже воно вдало співіснує із нормативно-правовими актами держав-членів європейської спільноти та нормами міжнародного права, здійснює ефективну діяльність у сфері міжнародно-правового регулювання праці.Правове регулювання трудових відносин в Європейському Союзі є зразковим, оскільки трудові відносини в країнах-членах здійснюються у чіткій відповідності до високих стандартів праці, згідно норм міжнародного права та трудового законодавства Європейського Союзу, що спрямовані на поліпшення життя та умов праці працівників.У статті піднімається питання необхідності гармонізації вітчизняного трудового законодавства до законодавства Європейського Союзу та важливості підвищення якості реформування правового регулювання трудових правовідносин у світлі євроінтеграційних процесів. Відзначається, що економічний та соціальний розвиток України в умовах євроінтеграції потребує особливого конструктивного підходу до вивчення та імплементації положень трудового права Європейського Союзу в українське законодавство. Тому важливою є робота вчених та фахівців у сфері трудового права з дослідження подібного досвіду інших країн з метою майбутнього його впровадження в національне законодавство України. Також наголошується на усуненні розбіжностей в деяких нормативно-правових актах України щодо питань, які стосуються забезпечення права на працю та необхідності створення сприятливих умов для впровадження європейських норм та стандартів праці. The article is devoted to the foundations of the formation of academic integrity in the international arena and in the national space. It is indicated that education is a priority for any modern state, because the future of Ukraine depends on the graduates of educational institutions. The educational process is dynamic, as it is filled with constant reforms, modernizations, improvements, as well as the admission of new talented and capable students. Along with innovations in the educational process, new challenges and problems in obtaining quality education appear. More and more students underestimate the importance of quality education and use mechanisms to facilitate the performance of scientific works. The article emphasizes that such mechanisms are defined as "academic dishonesty" in national legislation. The peculiarities of the implementation of academic integrity in the 20th century were considered and the fundamental concepts in this field were analyzed. Attention is focused on the problems and prerequisites of violation of integrity by students. In the article, special attention is paid to the question of the prerequisites for the students' desire not to observe the rules of academic integrity. A survey was conducted among students regarding the causes of academic dishonesty. As a result, it was established that the teacher's motivation greatly affects the students' desire to learn. Also, according to the results of the survey, it was determined that the inflated volume of scientific works, and requirements that do not correspond to the intellectual level according to the year of study, encourages the use of plagiarism. It was concluded that educational institutions should control this issue. It is also necessary to convey to students the idea that in case of non-compliance with the principles of academic integrity, the development of science is in danger, because it is young scientists who are the catalyst for change.
