The article is devoted to the study of the peculiarities of the conceptualization of legal terminology. It has been emphasized that legal concepts are important for the functioning of legal institutions. It has been noted that most of the legal terms aimed at unambiguous and consistent interpretation of legal texts are established in various legal documents. The boundaries of most subject areas are unclear, and their use in different areas of law may lead to the application of different criteria to establish the essence of the term.Attention is drawn to the fact that terminological work traditionally focuses on the organization of concepts and lexical items in a specialized field, in which each term is one concept, and each concept is denoted by one term. The definition of a particular area of law and terms related to that area includes the establishment of both terminological and conceptual boundaries, which allows clear and unambiguous use of the relevant categories. A clear approach to understanding the term contributes to the quality of legislation that affects the stability of state life.It is emphasized that ambiguous terms are used in modern legislation. Given the foreign experience in the context of European Union law, the timing of interdisciplinary concepts seems more appropriate due to the complex relationship between the national law of the Member States and the law of the European Union. Emphasis is placed on interdisciplinary concepts, i.e. concepts or institutions that arise in more than one legal field. More specifically, such concepts may apply to both the national legal system and the law of the European Union. Although the same term is used to denote an interdisciplinary concept, its conceptualization may differ in various areas of law and different legal systems, which may adversely affect the case because there will be no common approach to understanding the term.It is noted that the study of legal terminology should focus on the elements of the legal solution of the real problem.
У статті проводиться аналіз сучасних підходів до розуміння мови права. Зазначається, що всі наявні юридичні поняття і юридичні процеси можуть бути доступними для усвідомлення лише за допомогою мови. Саме тому юридична мова (мова права) охоплює всю систему юриспруденції взагалі. Стверджується, що юридичну мову варто розглядати як загальний термін, що стосується низки надзвичайно різноманітних текстів, як письмових, так і розмовних. Виходячи із цього, акцентовано увагу на тому, що юридична мова є надзвичайно складним об'єктом дослідження. Звертається увага, що спеціальна юридична термінологія, що використовується мовою права, поділяється на три категорії: спеціалізована термінологія, іноземна термінологія й архаїчна термінологія. Охарактеризовано кожен різновид цієї термінології. Проведено аналіз особливостей мови права. Приділено увагу такій характеристиці юридичної мови, як точність. Вивчення законодавчих текстів дає змогу виокремити деякі особливості юридичної мови, які експлікують її специфіку. Зазначається, що закон може бути ефективним лише за умови добровільного його дотримання через внутрішній стимул. Законодавство, яке не відповідає мовній чутливості нашого суспільства, розглядається не як «наш закон», а як щось чуже. Без сприятливої мови позитивне право не може створити правосвідомість. Саме тут «мова і право» набувають центрального значення для сучасних правових систем, а також для функціонування та виживання правових культур. Зроблено висновок, що у вітчизняній і закордонній політико-правовій думці відсутній єдиний підхід до розуміння сутності юридичної мови. Тобто ми стикаємося з багатоманітністю підходів інтерпретації «юридична мова». Головною функцією мови права є правильне й чітке формування змісту правових норм, уникнення його широкого розуміння й точного тлумачення. Наголошується, що поняття «юридична мова» є детермінантою формування правової системи, бо без юридичної мови не існує правової системи. Юридична мова є первинним елементом, а правова система -вторинним елементом, оскільки вона є важливим складником при складанні нормативно-правових актів.
The article is devoted to the study of the peculiarities of the language of law as a special direction of human communication. It has been noted that in the modern world, the connection between law and language appears at a sufficiently deep level and is a sufficiently complex and fundamental expression of their interaction. The research draws attention to the similarities and differences inherent in linguistics and jurisprudence. Attention has been focused on the fact that legal language is usually perceived somewhat specifically by ordinary citizens and society as a whole, as it looks specialized, elevated and technical, especially its written form. This is, in particular, due to the fact that constructions containing legal terminology, specialized legal terms, legal vocabulary are used to write a legal text, which leads to the fact that the language of law becomes incomprehensible to non-lawyers. Attention has been drawn to the peculiarities of the use of legal linguistics in the Anglo-Saxon law systems and in German-speaking countries. The approaches of researchers advocating for the simplification of the language of law have been considered, since, in their opinion, the language of law as a certain means of communication is characterized by “grandiloquence and verbosity”, which makes it difficult for the average citizen to understand it and does not allow them to fully familiarize themselves with normative documents and court decisions. The study also has raised the issue of gender equality when using the language of law in the modern world. Attention has been drawn to the fact that in foreign political and legal opinion, the statement is gaining more and more strength that if the goal of the law is really unlimited access of citizens to their constitutional rights to information and non-degradation of any gender, then the simplification of legal communication and gender-neutral writing should be its main goal.
Introduction: Health systems and health policies across the European Union are becoming more and more interconnected and also more complex. This increased interconnection raises many health policy issues, including health care quality. Mistakes in medical care can occur anywhere in the health care system – at hospitals, doctor’s offices, nursing homes, pharmacies, or patients’ homes - and in any part of the treatment process involving wrong medication, improper treatment, or incorrect or delayed test results. The aim of the article is to develop adequate theoretical and scientific-practical proposals for the modernization of the legal regulation to protect patients’ rights aimed at observance of constitutional rights and freedoms. Materials and methods: In order to obtain the results the analysis of medical, labor and civil law norms are investigated. The article uses analysis and synthesis methods, as well as a comparative legal method. Review: A number of proposals are given for improving legislation in the area of eliminating obstacles to provision of qualitative primary care / medical-preventive care, prevention of formal attitude towards the patient, the implementation of preventive protection measures which should notify in advance about the violation of the law in the medical sphere. Conclusions: Ukraine urgently needs a legal mechanism to protect the rights of patients; it will become a systemic phenomenon and will consist of legal means, forms, ways by which the restoration of violated patients’ rights is provided, the support of protected interests by the law is maintained, legal disputes are resolved and other obstacles to realization of patients’ rights are overcome.
