Purpose: This study aims to determine the constitutional rights of citizens that need to be protected and fulfilled by the state. And to know the rules related to the protection and fulfillment of the constitutional rights of citizens during the Covid-19 pandemic. Method: The research methodology used in this research is normative juridical by statute approach and conceptual approach. Results: This research resulted in an explanation of the fulfillment of the constitutional rights of citizens during the Covid-19 pandemic. The most crucial constitutional rights of citizens to be fulfilled are health rights, economic rights, and education rights. The non-fulfillment of the safety and constitutional rights of citizens is a form of denial of the mandate of the 1945 Constitution of the Republic of Indonesia. Limitation: The scope of the research is limited to fulfilling the constitutional rights of citizens during the Covid-19 pandemic. Contribution: The authors hope in the future, it is hoped that a more in-depth study can be carried out on research on the constitutional rights of citizens, especially in emergency conditions such as the Covid-19 pandemic.
Pada era globalisasi seperti saat ini, transportasi udara menjadi pilihan sebagian besar masyarakat karena memiliki banyak kelebihan yaitu biaya yang terjangkau, efisiensi waktu dan kenyamanan. Namun sejak pandemi Covid-19 terjadi di hampir belahan dunia, industri penerbangan komersil mengalami kelesuan karena adanya rasa ketakutan pada calon penumpang untuk bepergian jauh, lebih-lebih perjalanan ke luar negeri dan juga dikarenakan adanya kebijakan pemerintah mengadakan pembatasan aktivitas warga negaranya yakni kebijakan Pemberlakuan Pembatasan Kegiatan Masyarakat (PPKM). Kebijakan PPKM ini bertujuan untuk melindungi masyarakat dari penularan Covid-19, karena perlindungan hak kesehatan penumpang merupakan amanat Undang-Undang. Sehingga pada masa pandemi Covid-19 ini pemerintah berkewajiban untuk menjamin keselamatan, kesehatan dan kenyamanan penumpang pesawat udara. Adapun langkah-langkah yang diambil oleh pemerintah dalam melindungi hak kesehatan penumpang pesawat dituangkan dalam beberapa peraturan, baik itu udang-udang, peraturan pemerintah, peraturan menteri, instruksi menteri dan lain sebagainya. Dengan adanya peraturan tentang perlindungan hak kesehatan penumpang pesawat ini diharapkan dapat dilaksanakan oleh seluruh masyarakat, baik itu para calon penumpang maupun perusahaan maskapai penerbangan.
The Ministry of Home Affairs' policy regarding the issuance of Family Cards for unregistered married couples has a positive impact because it guarantees legal protection for citizens. However, from the other point of view, the issuance also has legal implications for the community. The Ministry of Home Affairs through the Directorate General of Department of Population and Civil Registration has made a policy that unregistered marriages can be included in the Family Cards with the statement "unregistered marriage". The statement was conveyed by the Director-General of the Department of Population and Civil Registration through his personal Instagram account. In fact, the basic principle of marriage is the principle of registration, as stated in Article 2 paragraph (2) of Law Number 1 of 1974 concerning Marriage. The purpose of this study is to determine the urgency of the Ministry of Home Affairs in making a policy for issuing Family Cards for unregistered married couples and to understand the legal status of the "unregistered marriage" nomenclature that is included in the Family Card according to Indonesian laws and regulations. This study uses a normative legal research method with a statutes approach. Based on the results of the study, it shows that the issuance of Family Card for unregistered married couples is contrary to several positive laws in Indonesia, namely Law Number 1 of 1974 concerning Marriage, Law Number 24 of 2013 concerning Amendments to Law Number 23 of 2006 concerning Population Administration, and the Compilation of Islamic Law and it is hoped that the Ministry of Home Affairs will conduct an in-depth study and coordination between institutions related to the policy so that there is no disharmony and conflict of norms.
Indonesia is still ranked 96th out of the 180 most corrupt countries in the world. This is evidenced by many corruption cases that occur, such as the corruption case of embezzlement of social assistance funds for PKH members in Malang, the corruption case that ensnared the inactive West Bandung Regent Aa Umbara, and the corruption case that made former Social Minister Juliari Batubara a suspect. The phrase "certain circumstances" in Article 2 paragraph (2) of the Anti-Corruption Law raises problems. First is considered capable of providing a deterrent effect for corruptors, but on the other side the article is considered to trigger injustice. The legal issues raised are 1) The imposition of the death penalty for the perpetrators of the Covid-19 social assistance corruption crime based on Article 2 paragraph (2) of the Anti-Corruption Law. 2) Legal efforts in the sentencing process for the perpetrators of the Covid-19 social assistance corruption. This study uses socio-legal research methods. The results of this study 1) The death penalty in article 2 paragraph (2) of the Anti-Corruption Law can be imposed on perpetrators of the Covid-19 social assistance corruption. 2) One of the causes of difficulties in handling corruption cases is in terms of evidence, for this reason, the Adjudication and Non-Adjudication efforts through RALA are the right strategy to improve legal mechanisms in the process of criminalizing the perpetrators of the Covid-19 social assistance corruption. involving institutions related to the implementation of the criminal justice system.
