Hybrid Arbitration adalah penyelenggaraan proses arbitrase yang juga menggunakan satu atau lebih bentuk Alternatif Penyelesaian Sengketa (APS) lainnya, baik pada awal proses maupun selama proses penyelesaian sengketa perdata berlangsung. kelebihan dari penggunaan metode hybrid arbitration ialah memberikan putusan yang final, Lebih murah dan lebih efektif dari arbitrase atau pengadilan, dan Keluwesan proses dapat membantu menyelesaikan sengketa. Kelemahan hybrid arbitration, antara lain: Para pihak mungkin tidak ingin menyelesaikan sengketa mereka secara damai, rentan dan dapat ditantang serta Para pihak khawatir bila Arbitrator mungkin tampak, dan mungkin benar-benar menjadi berat sebelah. Penyelesaian sengketa perdata menggunakan metode hybrid arbitration sebenarnya tidak berbeda jauh dengan metode penyelesaian sengketa perdata melalui arbitration karena metode hybrid arbitration merupakan penggabungan dari arbitrase dan mediasi. Perbedaannya hanya terletak pada mekanisme penyelesaian sengketa yang digunakan terlebih dahulu, apakah mediasi atau arbitrase. Penggunaan metode hybrid sebagai suatu metode penyelesaian sengketa di Indonesia memang masih tergolong baru.
Kegiatan pengabdian bertujuan untuk mewujudkan program pemerintah dalam pencegahan perkawinan anak. Kampanye sosial ini menyasar pada masyarakat dan aparatur Desa Twi Mentibar, Kabupaten Sambas. Kegiatan ini diikuti oleh 30 orang warga desa dan diselenggarakan menggunakan dana hibah MBKM berbasis hasil penelitian oleh Universitas Panca Bhakti dan Kemenkumham Kanwil Kalbar. Kegiatan ini bertujuan agar masyarakat maupun pemerintah desa/ aparatur desa memiliki pemahaman terkait definisi anak menurut peraturan perundang-undangan, hak-hak anak yang dilindungi dalam Undang-undang, serta pemahaman kesadaran orang tua maupun anak perempuan terhadap buruknya dampak perkawinan anak. Pengabdian kepada masyarakat ini menggunakan teknik kampanye sosial “CEPAK” sekaligus pengenalan program Merdeka Belajar Kampus Merdeka (MBKM) melalui metode ceramah serta diakhiri dengan sesi diskusi. Kegiatan ini dinyatakan berhasil berdasarkan hasil pengisian angket, masyarakat mengetahui dan menyadari hak-hak anak dan program sekolah gratis agar tidak dinikahkan ketika masih dalam fase anak.
Teacher protection has been regulated in various laws and regulations, both laws, government regulations to ministerial regulations, but the reality of teachers is still faced with problems, including the weak legal protection. Facts are revealed when problems are encountered, such as teachers experiencing criminalization with allegations of committing violence in the learning process, teachers must face the legal process themselves, and there is no mechanism for handling them. In order to realize equitable teacher protection, this study uncovers the problem of how to develop a model to realize equitable teacher protection through a non-penal policy approach. This research was used the transdisciplinary approach involving several stakeholders through the sociological juridical research method, the results of research on the importance of being regulated by regional policies were obtained through the establishment of the Legal Service and Teacher Protection Unit (UPHPG) which is a coordinating institution to solve the problem of criminalizing teachers by prioritizing non-penal policies. The non-penal policy in handling the problem of teacher criminalization through UPHPG is formulated an integral and comprehensive handling mechanism involving several stakeholders and prioritizing prevention efforts through communication, information and education to all parties, providing consultation and legal assistance as well as legal assistance services to good teachers.
This study aims to investigate the strategies and efforts that should be made to increase community law empowerment in breaking the chain of distribution of Covid-19 in the new normal era. Covid-19 has brought about a change in people's lives known with a new-normal term, where people must always comply and obey the health protocols to break the chain of its spread. Various policies have been issued by the Government, including the province of West Kalimantan, which has issued the strictest policy on the application of discipline and enforcement of the Health Protocol. It is qualitative research, whereas the data of this study are qualitative in descriptions, exposures, and writings referenced from books, journals, and articles. For analysis, the data is sorted, categorized (grouped) into groups, and then the contents are critically analyzed, so that concrete formulation is formulated, which are then explained in depth. The result of the research is that the strategy of indirect legal counseling by utilizing social media facilities can educate the public to comply with legal rules related to breaking the chain of covid-19 spread towards the new normal era. This public education is needed to understand and build legal awareness of the community on how to deal with the new life order amid the Covid-19 pandemic. It is hoped that this intense and continuous legal communication will have implications for realizing community legal empowerment in breaking the chain of the spread of Covid-19.
