Pengaturan merek di Indonesia diatur dalam UU No.20 Tahun 2016 tentang Merek dan Indikasi Geografis (selanjutnya disebut UU Merek) tidak diimbangi dengan kesadaran pendaftaran merek khususnya UMKM. Pengkajian dilakukan pada salah satu Pelaku Usaha UMKM di Kota Semarang yaitu “Munaku Sulam Pita” dengan fokus permasalahan yaitu faktor pendukung pelaku usaha dalam menentukan merek dagang, pelaksanaan implementasi UU Merek pada pelaku usaha, dan urgensi pelaksanaan implementasi UU Merek dalam kegiatan usaha. Pengkajian dilakukan menggunakan metode penelitian yuridis empiris dengan pengkajian data primer sebagai data utama serta dilengkapi dengan data sekunder. Hasil Penelitian ini menunjukkan sudah ada kesadaran hukum pada subyek yang diteliti namun terkendala pada kurangnya perhatian Lembaga terkait.Kata kunci : Pendaftaran Merek; UMKM; Hukum Bisnis.
LGBT phenomenon into a "hot issue" in the international and national levels. LGBT phenomenon in Indonesia would result in the pros and cons of the community. Various groups of people, mainly from religious groups opposed to the existence of the phenomenon. On the other hand, there are also groups that support the LGBT community in Indonesia, the main actors and human rights activists (Human Rights). Most LGBT people found contrary to the noble values of Pancasila, but on the other hand assumes that actors LGBT community is not sexual deviation, and shall have the rights and equality. It is thus necessary to do a study to determine the response of the people of Indonesia respond to the phenomenon of LGBT specifically in this case the younger generation, as well as to determine whether or not the phenomenon of LGBT contrary to the basic values of Pancasila as the State Indonesia.
<p>This study examines the registration of collective marks owned by the<br />Association of Knitting Indonesia Central Java (Java ARI) on the knitting craft<br />products manufactured and marketed independently. In addition, the assessment<br />conducted on the mechanism of collective trademark registration in the relevant<br />institutions. The research method used juridical empirical approach. Juridical<br />aspect is based on Law No.20 of 2016 on Marks and Geographical Indications<br />and related legislation, while reviewing the empirical aspects of the business<br />activities carried on ARI Java. The results showed that ARI Java brand label have<br />met the brand element that can be registered as a collective trademark<br />registration with domicile at the Directorate General of Intellectual Property of<br />the Ministry of Law and Human Rights in Central Java.</p><p> </p>
Public Information Transparency after 1998 reformation has gained momentum since the issuance of Law No. 14 of 2008 concerning Transparency of Public Information. Public access to obtain information owned by the state administrative body does not always run smoothly. The role of the Administrative Court as a Judiciary that guarantees the upholding of Good Public Order Principles, especially the principle of public transparency, was tested. This article will discuss the extent of the role of PTUN in disputes over requests for public information, which in the process will also discuss the part of the Public Information Commission in requests for public information in terms of authority and competence. As a conceptual article, the conclusion that can be drawn is that the state administrative dispute procedure needs to be clearly stated, whether it is mandatory to use the procedure for requesting public information through the Public Information Commission or whether it can use a claim mechanism through the State Administrative Court. Keyword: Open Government, Administrative Court, Good Governance Principle Abstrak Keterbukaan Informasi Publik pasca reformasi semakin mendapatkan momentum semenjak diterbitkannya Undang-Undang No. 14 Tahun 2008 tentang Keterbukaan Informasi Publik. Akses masyarakat untuk mendapatkan informasi yang dimiliki oleh badan administrasi negara tidak selalu berjalan dengan lancar. Peran PTUN sebagai Badan Peradilan yang menjamin tegaknya Asas-asas Umum Ketertiban yang Baik khususnya asas keterbukaan publik pun diuji. Artikel ini akan membahas sejauh mana peran dari PTUN dalam sengketa permohonan informasi publik yang dalam prosesnya akan membahas pula mengenai peran Komisi Informasi Publik dalam permohonan informasi publik dari sisi kewenangan dan kompetensi. Sebagai artikel konseptual, kesimpulan yang dapat diambil adalah perlu ditegaskan dengan jelas prosedur sengketa administrasi negara apakah diwajibankan menggunakan prosedur permohonan informasi publik melalui Komisi Informasi Publik ataukah dapat menggunakan mekanisme gugatan melalui Pengadilan Tata Usaha Negara.
