Because of present day information technology, there is neither need to plant complicated computers for more millions price if we would like to process and store big amounts of data, nor modelling them. The microprocessors and CPUs produced nowadays by that kind of technology and calculating capacity could not have been imagined 10 years before. We can store, process and display more and more data. In addition to this level of data processing capacity, programs and applications using machine learning are also gaining ground. During machine learning, biologically inspired simulations are performed by using artificial neural networks to able to solve any kind of problems that can be solved by computers. The development of information technology is causing rapid and radical changes in technology, which require not only the digital adaptation of users, but also the adaptation of certain employment policy and labour market solutions. Artificial intelligence can fundamentally question individual labour law relations: in addition to reducing the living workforce, it forces new employee competencies. This is also indicated by the Supiot report published in 1998, the basic assumption of which was that the social and economic regulatory model on which labour law is based is in crisis.

Artificial intelligence and automation are some of the most defining elements of the XXI century, whose significant imprint is manifested in society and social relations. Digital development is transforming the world of work -this thesis is the starting point of many kinds of research. This principle is also the basic premise of the present study, as it transforms working and employment conditions to develop and spread digital technologies, resulting in an untraceable process. As the maker of individual decisions, artificial intelligence can create a new context in labour law. The study aims to examine the labour law entity of artificial intelligence, outlining the Asian and European distribution of reactions to the introduction of automatic decision-making and the impact of MI on industrial relations. The outstanding importance of the topic is also shown by the fact that numerous studies deal with examining legal personality outside labour law.
A munka fogalmának tartalma folyamatosan változik. Korszakonként más és más tartalommal határozhatjuk meg. Nincs ez másképp napjainkban sem, mikor a munka digitalizálódásának a korszakát éljük. Nem csak a magánéletünk, de a munkafolyamataink jelentős része is átkerül a virtuális térbe, de ide sorolhatjuk a platformok megjelenését is. A munka fogalmának jelenlegi változása is azt jelenti, hogy a munkajog folyamatosan lohol a munka fogalmának a változása mögött. Illetve ez úgy pontos, hogy a munkajog sosem fogja le a munka fogalmába tartozó tevékenységek teljes körét. Hogy mennyire fedi le a munkajog a munka fogalmát jogi-gazdaság- és szociokulturális kérdés is. A jogalkotó ezen befolyások mentén határozza meg újra és újra a munkavégzéseknek a jog által is szabályozott körét. Láthatjuk, hogy egy atipikus munkavégzési viszonyból, hogyan válik tipikus munkaviszonnyá. De azt is láthatjuk, hogy egyes területek hogyan kerülnek a szürke zónába. Tanulmányunkban a digitalizálódást, illetve a digitális technológia alkalmazásának a munkára és a munkajogra gyakorolt hatását szeretnénk bemutatni szerzőtársaimmal közösen. Ezzel is szeretnénk tisztelegni közös professzorunk, kedves kollégánk és barátunk Prugberger Tamás előtt születésnapja alkalmából.
Objective: the spread and wide application of Artificial Intelligence raises ethical questions in addition to data protection measures. That is why the aim of this paper is to examine ethical aspects of Artificial Intelligence and give recommendations for its use in labor law.Methods: research based on the methods of comparative and empirical analysis. Comparative analysis allowed to examine provisions of the modern labor law in the context of use of Artificial Intelligence. Empirical analysis made it possible to highlight the ethical issues related to Artificial Intelligence in the world of work by examining the disputable cases of the use of Artificial Intelligence in different areas, such as healthcare, education, transport, etc.Results: the private law aspects of the ethical issues of Artificial Intelligence were examined in the context of ethical and labor law issues that affect the selection process with Artificial Intelligence and the treatment of employees as a set of data from the employers’ side. Author outlined the general aspects of ethics and issues of digital ethics. Author described individual international recommendations related to the ethics of Artificial Intelligence.Scientific novelty:this research focused on the examination of ethical issues of the use of Artificial Intelligence in the specific field of private law – labor law. Authors gave recommendations on ethical aspects of use of Artificial Intelligence in this specific field.Practical significance: research contributes to the limited literature on the topic. The results of the research could be used in lawmaking process and also as a basis for future research.
