Pandemi Covid 19 telah membawa begitu banyak pengaruh bagi seluruh sendi kehidupan masyarakat di seluruh dunia, tidak terkecuali di Indonesia. Semua bermula dari diberlakukan status Pembatasan Sosial Berskala Besar (PSBB) di berbagai wilayah di Indonesia yang bermuara dengan ditutupnya berbagai jenis usaha yang tidak masuk ke dalam jenis usaha yang diperbolehkan beroperasi selama masa PSBB. Hal yang hampir sama juga terjadi di berbagai penjuru dunia, sehingga sangat berpengaruh baik secara langsung ataupun tidak langsung terhadap kegiatan perdagangan ekspor dan impor. Kurangnya pemesanan barang hasil industri dari luar negeri ataupun bahan –bahan impor sebagai bahan baku produksi, mengakibatkan gelombang Pemutusan Hubungan Kerja ataupun pengurangan karyawan di berbagai jenis industri, sehingga mengakibatkan problem ekonomi rumah tangga karyawan dari berbagai industri dan pabrik-pabrik, sehingga bermuara ke gugatan perceraian akibat faktor ekonomi keluarga. Dengan banyaknya kasus perceraian di Indonesia di masa pandemi covid 19, maka secara otomatis berdampak kepada banyaknya duda atau janda baru sebagai akibat hasil dari proses siding perceraian. Oleh karenanya ,tujuan dari kegiatan pengabdian masyarakat ini supaya dapat menerima masukan dari peserta webinar untuk ditemukan solusi terhadap akibat dari proses perceraian dan terkait dengan Undang-Undang nomor 1 tahun 1974 tentang Perkawinan yang seharusnya perlu di revisi kembali di beberapa pasalnya, karena tidak sesuai dengan ketentuan dalam berbagai agama yang diakui di Indonesia, dan secara khusus tentang ketentuan mengenai perkawinan di dalam ajaran Agama Islam.Adapun metode pelaksanaan pengabdian masyarakat ini adalah menggunakan metode seminar secara daring atau dinamakan Webinar Kata kunci : perceraian, pandemi, perkawinan
In Law Number 2 of Universitas Borobudur 2014 concerning Notary Positions, there is no prohibition for notaries to do business outside their positions. This case study aims to analyze a notary's business bankruptcy and how the legal consequences for a notary being declared bankrupt based on a court decision on the basis of Article 12 (a). The method used is normative juridical. The results of the analysis show that the legal consequences of notaries being declared bankrupt will lose all rights under their authorities and have no obligation to carry out services for making authentic deeds, agreements and other legal actions. The lawful situation of a legal official who is bankrupt dependent on a court choice on account of Decision Number 20/Pdt.Sus-PKPU/2020/PN Niaga Sby, when alluding to the arrangements of Law Number 37 of 2004 concerning Bankruptcy and Postponement of Obligation to Pay Debt, and status and position as a borrower.
Children are basically good imitators. What's more, in the era of the digital world and the internet, children can more easily access shows on social media and exchange information via cell phones. With the ease of accessing the internet, it is not uncommon for children to commit acts that violate the law, such as theft, fights, and other criminal acts, so that the child is then subject to criminal proceedings. For children who are in conflict with this law, Indonesia actually already has rules for handling them, namely Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. However, it seems that the procedure for handling and protecting children who have problems with the law still needs to be socialized more intensely, because there are still many parties who have not implemented the provisions of the law. For example, the provision regarding children who commit crimes in their detention cells cannot be combined with adults, the fact is that in the field there are still cells whose detention cells are joined by adults. One of the aims and objectives of the community service activities carried out by lecturers at the Faculty of Law, Esa Unggul University, is to socialize the handling and protection of children who have problems with the law. It is hoped that after this socialization there will be no wrong handling procedures for children who have problems with the law, and also children who are in conflict with the law will get the rights as regulated in the legislation. Keywords: child, unlawful act, handling. AbstrakAnak pada dasarnya adalah peniru yang baik. Terlebih lagi dalam era dunia digital dan internet ini anak bisa lebih mudah mengakses tontonan di media sosial dan bertukar informasi lewat ponsel. Dengan kemudahan mengakses internet tersebut membuat anak tidak jarang melakukan perbuatan yang melanggar hukum, seperti pencurian, tawuran, dan tindak pidana lainnya, sehingga anak kemudian di proses pidana. Terhadap anak yang berkonflik dengan hukum ini, Indonesia sebenarnya sudah memiliki aturan untuk penanganannya, yaitu Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Namun nampaknya prosedur penanganan dan perlindungan bagi anak yang bermasalah dengan hukum ini masih perlu di sosialisasikan lebih intens, karena masih banyak para pihak yang belum melaksanakan ketentuan undang-undang tersebut. Misalnya ketentuan mengenai anak yang melakukan tindak pidana sel tahanannya tidak boleh digabung dengan orang dewasa, faktanya dilapangan masih ada yang sel tahanannya bergabung dengan orang dewasa. Kegiatan pengabdian masyarakat yang dilakukan oleh dosen-dosen Fakultas Hukum Universitas Esa Unggul salah satu maksud dan tujuannya adalah ingin mensosialisikan mengenai penanganan dan perlindungan bagi anak yang bermasalah dengan hukum. Diharapkan setelah sosialisasi ini maka tidak ada prosedur penanganan yang salah terhadap anak yang bermasalah dengan hukum, dan juga anak yang berhadapan dengan hukum mendapatkan hak sebagaimana telah diatur di dalam perundang-undangan. In practice, many house sales and purchase agreements are carried out using a standard sale and purchase agreement (PPJB), which is not made before a notary. Based on Article 1 paragraph (11) of Government Regulation Number 12 of 2021, PPJB must be made before a notary. PPJB making is still often done under the hands. So that the sale and purchase binding agreement will cause problems regarding legal certainty, legal protection and the legal consequences of the agreement in the event of default in the future. The author is interested in studying private PPJB using normative legal research methods. This research was conducted in order to gain new knowledge and to provide answers related to the problems above based on positive law in Indonesia. The results show that even though the agreement was made privately and not in accordance with what is stipulated in Government Regulation Number 12 of 2021, the agreement is still binding on the parties in its implementation because it has fulfilled the elements in Article 1320 of the Civil Code. There are legal consequences regulated in Article 1338 regarding the principle of Pacta sunt servanda. It can be concluded that the existence of Article 1 paragraph (11) of PP Number 12 of 2021 has no effect on the disappearance of the rights and obligations of the agreement. The suggestion from the author is that all individuals who want to carry out PPJB continue to sign in front of a notary, present witnesses where the witness also signs the agreement and initialize each page of the agreement.
