The article investigates how the notion “execution of a sentence” was formed and analyzes the content of the stage of execution of a sentence as an independent part of criminal procedure, examines legal issues of criminal proceedings within the stage of execution of a sentence, and puts forward some ways to improve it. The fact that court activities aimed at considering and resolving issues related to the execution ofa sentence are defined as part of criminal procedure rather than as an independent stage is a subject for debate, because this activity may or may not take place. But we agree with those scholars who believe that the stage such as the presentation of a sentence for execution always emerges during sentencing, and the analogy with the stage of launching criminal investigation allows us to conclude that, that further criminal proceedings may occur several times or may not occur at all and thus form an independent stage of criminal procedure. We studied the opinions and statements of practitioners and scholars in the field of criminal procedure concerning the role and importance of criminal proceedings aimed at the execution of a sentence as an independent stage of criminal procedure, institution of criminal procedural law, a separate phase of criminal procedure and the theoretical arguments as to the essential nature and meaning of the execution of a sentence in criminal procedure. We conclude that criminal proceedings aimed at presenting the sentence for execution, consideration and resolution by the court of the issues related to its execution form the content of an independent stage of criminal procedure, which has all the necessary and characteristic features.
В работе рассматриваются проблемы принятия управленческих решений как основы эффективного функционирования организации, в частности, таможенных органов. Изложены алгоритм принятия управленческих решений в контексте профессиональной деятельности таможенных органов, в том числе, с точки зрения реализации правоотношений.
Эффективность деятельности уголовно-исполнительных инспекций, а также достижение целей наказания во многом зависят от состояния законодательства, регламентирующего уголовно-процессуальные вопросы исполнения приговора. Вместе с тем имеется ряд проблемных аспектов, который требует научного осмысления и разрешения относительно правового и организационного обеспечения деятельности субъектов, вступающих в правоотношения на стадии исполнения приговора. На сегодняшний день в российском уголовно-процессуальном законодательстве некоторые вопросы, касающиеся стадии исполнения приговора, не урегулированы в удовлетворяющей науку и практику степени, к ним, в частности, следует отнести форму и содержание представлений указанных органов и учреждений, сроки назначения судебного заседания по разрешению вопросов, связанных с исполнением приговора. Указанное препятствует не только эффективной деятельности государственных органов и их должностных лиц, участвующих на стадии исполнения приговора, но и осуществлению уголовной политики государства в целом, реализации назначения уголовного судопроизводства и достижению целей головных наказаний. Так, в практической деятельности отмечается недостаточная эффективность функционирования уголовно-исполнительных инспекций в ряде регионов, не везде выполняются плановые и основные показатели их деятельности, в том числе в сфере уголовно-процессуальных правоотношений, возрастает количество предупреждений, выносимых уголовно-исполнительными инспекциями в связи с нарушением порядка и условий отбывания наказания осужденными, при этом снижается число удовлетворенных судом ходатайств о замене наказания более строгим его видом. The effectiveness of the activities of criminal executive inspections, as well as the achievement of the goals of punishment largely depend on the state of legislation regulating criminal procedural issues of execution of the sentence. At the same timethere are a number of problematic aspects that require scientific understanding and resolution regarding the legal and organizational support for the activities of entities entering into legal relations at the stage of execution of the sentence. Today in the Russian criminal procedure legislation some issues related to the stage of execution of the sentence, not resolved in a satisfying science and practice degrees to them, in particular, should include the form and content of submissions to these institutions, the terms of appointment of the hearing on the resolution of issues related to the execution of the sentence. This hinders not only the effective operation of their officials involved in the execution of the sentence, but also the implementation of the criminal policy of the state as a whole, the implementation of the appointment of criminal proceedings and the achievement of the goals of criminal penalties. Thus, in practice, there is a lack of efficiency in the functioning of criminal executive inspections in a number of regions, the planned and basic indicators of their activities are not always fulfilled, including in the sphere of criminal procedural legal relations, the number of warnings issued by criminal executive inspections in connection with the violation of the order and conditions of serving punishment by convicts is increasing, while the number of applications for the replacement of punishment by a more severe type of punishment satisfied by the court is decreasing.
