A Influência Do STF Na Regulamentação Do Dever Fundamental De Contribuir Com a Justiça

Abstract

This paper aims to analyse the brazilian Federal Supreme Court's decisions in relation to the enforcement of penalties against bad faith behavior on the judicial process and compare those decisions with the innovations introduced by the Civil Procedure Code, enacted in 2015. For this purpose, it was used theoretical postulates from Structuring Legal Theory in order to guide the study of the Federal Supreme Court's behavior obtained from the Cout's web site. The structuring of that behavior led to the conclusion that enforcement of bad faith penalties focuses on effectiveness of the duty to contribute to the justice, not necessarily focuses on the legal basis.
