Brazilian Constitution: The concept of family and family planning as a government strategy

Abstract

Neste artigo abordamos um estudo sobre os contextos jurídicos da Constituição brasileira em que se encontram a noção de família e de planejamento familiar, assim como as leis a respeito do planejamento familiar promulgadas após a Constituição de 1988. Apoiados na perspectiva foucaultiana problematizamos as racionalidades que embasam tais legislações, assim como pensamos os possíveis efeitos dessas na organização e gerenciamento da população na atualidade. Efetuamos a seleção do material analisado através de pesquisa sistemática na Constituição e busca no Portal da Legislação da Presidência do Brasil. Através dos resultados, percebemos que a noção de família e de planejamento familiar compõem ferramentas jurídicas que se constituem como elementos de cerceamento e disciplinarização dos sujeitos através das regulamentações que estabelecem. Assim, as jurisdições operam como estratégias governamentais para contemplar objetivos que colocam o trabalho como a base de tudo e, a partir disso, orientam a população através das políticas que produzem. Guided through the Foucault's perspective we questioning how the rationalities that underlie such legislation may produce effects in the organization and management of the population nowadays. We selected the material analyzed through systematic research in the Brazilian Constitution and in the Portal of Legislation of the Presidency of Brazil. The results obtained indicate that the idea of family and family planning compose legal tools which constitute elements of retrenchment and disciplining of subjects by regulations that they establish.
