This article examines the ways in which protection from torture and violence is understood and practiced by women in poor urban communities in Brazil. It demonstrates that despite a well-developed normative and institutional framework for the protection of survivors of torture and violence, such protection work grows from the notion of motherhood, which can be understood as an outlet for challenging various overlapping orders (race, class and gender) that legitimise torture and violence. Motherhood garners legitimacy in the fight for justice, for the truth and for restoring the positive memories related to the tortured, killed or imprisoned children and it generates moral and political capital that enable political participation for women. The article demonstrates that despite a well-developed institutional and normative framework for protection, everyday protection strategies respond to the perceptions and needs of survivors and their communities and can only be understood in the context of racial and gendered roles and performances of motherhood shaped by the historical enslavement of the Afro-Brazilian population.

The article explores the connections between gender, prison, and activism in AMPARAR, an association that works with prisoners’ families in São Paulo, Brazil. The ethnography is developed in the activities of the association and in the monitoring of the connections mobilised by these activities. AMPARAR’s work is located in an institutional web that includes non-governmental organisations and public institutions that produce both a violating state and a state that claims rights and guarantees. AMPARAR and the family members articulated by the association put a human face and body to complaints, and identify violence and humiliation perpetrated not only on their bodies, but on their husbands and children deprived of their freedom. Gender and sexuality are languages that allow such evocation and contribute to women producing a place of mediators and rapporteurs for the abuses that occur within prisons.

Este artigo discute como a noção de famílias negras enquanto conceito analítico nos estudos criminológicos pode ser útil na compreensão da produção da punição e seus impactos sociais realizados pelo Sistema de Justiça Criminal no Brasil. Para tanto, é realizada uma discussão teórica a partir das noções de família em sua relação com o Estado para a Sociologia e Criminologia brasileira numa perspectiva que reflita classe, relações raciais e gênero. Assim, se discutirá o conceito de famílias negras relacionado às identidades de familiares de pessoas presas e familiares de vítimas de terrorismo do Estado, a fim de discutir como as suas organizações, ações e incidências têm desafiado a violência racial estatal e reivindicado espaços políticos e jurídicos enquanto sujeitas de direitos e sujeitas políticas, a despeito da mira criminalizadora. Ademais, discutimos como o conceito de famílias negras pode ser incorporado como elemento de análise para mensurar os impactos sociais do encarceramento em massa e letalidades provocadas pelas agências estatais produtoras de criminalização e de punição.
