Peer Reviewed: Capillary Electrophoresis and Daubert: Time for Admission

Abstract: Time for AdmissionT he recent telecast of the 0. J.Simpson trial has brought to the forefront the importance of forensic identification in legal proceedings, especially in criminal cases. Forensic science has become a key element in proving a defendant's guilt or innocence. In the 0. J. Simpson trial, the question was not one of the admissibility of the expert testimony regarding the existing DNA testing procedure and the resulting conclusions but rather what weight the jury would give these results. The Federa… Show more

“…Together, these results indicate that sizing measurements made using CAE are both consistent with and as good as those reported by expert laboratories in the field. In addition, the use of software and reference DNA standards to normalize sequence-specific measurement errors should enable a more direct comparison of genetic typing results between laboratories or for computation of test results in a forensic context (Kuffner et al 1996). Knowles et al (1992) first proposed a method for interlaboratory standardization of linkage results using CEPH DNA typing standards.…”

“…Capillary electrophoresis is an acceptable separation technique under SWGDRUG recommendations. In fact, the admissibility of CE in court was the subject of a 1996 publication in which the authors used CE as an example to show how a new science may meet the requirements of the Federal Rules of Evidence introduced by the Daubert Standard, a legal http://precedent set in http://1993 by the http://Supreme Court of the http://United States regarding the admissibility of http://expert witnesses' http://testimony during legal proceedings . In the past, applications of capillary electrophoresis to drug analysis in forensic laboratory even at Federal levels was mainly limited to enantiomeric separation of chiral illicit substances that were scheduled drugs such as methamphetamine, in which the sentencing depends on the chiral identification of illicit drugs.…”

“…CE has been shown to be a versatile technique and has been used for a variety of forensic applications including analysis of gunshot residues, explosive residues, and drugs as well as DNA typing [13]. Since 1996, CE results have been admissible in courts of law [14].…”
