Fiqh al-awlawiyyat merupakan ilmu untuk meletakkan sesuatu pada posisinya dengan berbagai standar (dhawabith al-awlawiyyat) yang digunakan. Beberapa standar itu dilihat dari berbagai aspek seperti tingkat kemaslahatan, menjauhkan mudharat, dan efisiensi waktu pelaksanaan. Artikel ini merupakan penelitian pustaka dengan pendekatan yuridis normatif. Metodologi yang digunakan adalah studi deskriptif analisis dengan sumber primer berupa literasi mengenai fiqh al-awlawiyyat. Sumber sekunder yang digunakan adalah literasi yang membahas tentang fiqh dan ushul al-fiqh yang relevan dengan variabel penelitian. Hasil penelitian menyimpulkan bahwa tertib kewajiban distribusi tirkah harus memiliki urutan tertib yaitu; kewajiban distribusi hak harta bersama, kewajiban distribusi biaya pengurusan jenazah, kewajiban distribusi biaya pelunasan utang mayit, kewajiban distribusi wasiat, dan kewajiban distribusi harta warisan.

Fi sabilillah in the Fiqh conception, its meaning is interpreted as people fighting in defense of religion. For this meaning, Ulama (Islamic scholars) clung to distributing zakat fi sabilillah to the mustahiq as guided by the meaning of the text contained in the fiqh books. But in practice, Baitul Mal in Aceh distributes zakat fi sabilillah for the tahfiz Qur'an program. Therefore, based on the issue's description, it is necessary to conduct a more comprehensive study to determine the legal basis of Baitul Mal in Aceh for channeling zakat fi sabilillah for the Tahfiz Qur'an Program, how the program is realized, and how Ulama Dayah perceive the practice. This research employed qualitative methods in the form of field studies using a conceptual approach. Based on the results of the study, it was found that Baitul Mal in Aceh in giving zakat fi sabilillah for the Tahfiz Qur'an Program already refers to the provisions in the Qur'an and also other rules stipulated in the provisions of the Qanun Baitul Mal, which was then the program realized through the distribution of scholarships to students in the form of a tahfiz program. In addressing this issue, Ulama Dayah do not deny the distribution of zakat fi sabilillah for the tahfiz Qur'an program, although conceptually the interpretation of the meaning of zakat fi sabilillah can only be given to those who fight in defense of religion. Their view is based on the existence of the values of benefit contained in Baitul Mal's practice.

Conflict or dispute always exists in every human relationship in social interaction, common property is a thing that often triggers conflict in the family is known that not a few cases of conflict which resulted from the inheritance that goes to court. Disputes generally occur regarding rights and obligations that are classified in civil conflict issues can be resolved one of them by mediation both out of court and in court. Mediation in the settlement of civil cases can conducted at the beginning of litigation as well as during litigation against inheritance claims, joint property claims. Solution dispute specifically has the meaning that the dispute between husband and wife differences of opinion between the two parties due to property can also refer to disputes so that over this there is an imbalance ownership and need a good mediation process to equalize the position for both parties. This study aims to explain the legal power of mediation in court proceedings Religion Medan, the second to know the procedures for the division of inheritance and joint property according to compilation of Islamic law. Type of research used is empirical legal research with approach juridical sociological. The Data used is sourced from primary and secondary legal data analyzed qualitatively. The results of this study indicate that the legal power of mediation in the trial process in the Religious Court of Medan, namely with the deed of peace, the result of the peace agreement received legal certainty, the second division of common property according to the compilation of the law Islam is a husband or wife gets the same half because it is also seen based on taste fairness or good faith of one of the parties.
