The objective of this study is to examine the consequences of transferring mining land from the holder of a Mining Business Permit (IUP) or Special Mining Business Permit (IUPK) to a different party through the Ministry of Energy and Mineral Resources (ESDM), as outlined in Article 99 Paragraph (4) in conjunction with Article 1 Paragraph (38) of Law Number 03 of 2020. This law pertains to the amendments made to Law Number 4 of 2009 concerning Mineral and Coal Mining, hereafter referred to as Law No. 03 of 2020. The present study constitutes normative legal research. The findings indicate that the transfer of post-mining land from IUP or IUPK holders to third parties via the Ministry of Energy and Mineral Resources, as stipulated in Article 99 of Law No. 03 of 2020, gives rise to legal ambiguity. This situation necessitates the Ministry of Energy and Mineral Resources to assume the responsibilities of the Ministry of Agrarian and Spatial Planning/National Land Agency (ATR/BPN) in executing the Integrated Post-Mining Land Use (IP4T) program in accordance with national land legislation. Hence, it is imperative to establish a cohesive legal framework that aligns Law No. 03 of 2020 with agrarian and national land policies. This will ensure legal certainty and eliminate conflicting interpretations in the future implementation of Integrated Post-Mining Land Management (IP4T). Ultimately, this will facilitate the transfer of post-mining land from holders of Mining Business License (IUP) or Special Mining Business License (IUPK) under the Ministry of Energy and Mineral Resources to the Ministry of Agrarian and Spatial Planning/National Land Agency (ATR/BPN), which serves as an auxiliary body responsible for land affairs within the Indonesian government system.

Penelitian ini menganalisis implikasi hukum yang terkait dengan kepemilikan hak atas kekayaan intelektual pada platform CryptoKitties. CryptoKitties adalah sebuah platform permainan berbasis blockchain yang memungkinkan pengguna untuk membeli, memiliki, dan melakukan perdagangan dengan kucing virtual yang unik. Kucing-kucing ini direpresentasikan oleh aset digital yang disebut non-fungible tokens (NFT), yang memberikan kepemilikan eksklusif kepada pemiliknya. Penelitian ini menggunakan metode normatif dengan pendekatan perundang-undangan (statute approach). Hasil penelitian ini ditemukan pengguna mengakui dan setuju bahwa dapper (atau, sebagaimana berlaku, pemberi lisensi) memiliki semua hak hukum, kepemilikan dan kepentingan dalam dan untuk semua elemen lain dari aplikasi, dan semua hak kekayaan intelektual di dalamnya, namun kepemilikan kekayaan intelektual non-fungible tokens (NFT), sepenuhnya dimiliki oleh pengguna. Dan dapper memberikan hak eksklusif kepada pengguna terhadap aset digital yang mewakili kucing virtual yang unik.

<div><table cellspacing="0" cellpadding="0" align="left"><tbody><tr><td align="left" valign="top"><p class="AbstractText">Cybercrime has resulted in astronomical losses for the business community. However, the reactive policy model must be more effective at preventing cybercrime, and the due process model is also inappropriate for combating cybercrime with a high level of speed and mobility. This study is normative legal research employing a conceptual strategy and case studies. The results indicate that the reactive model must be improved in order to prevent cybercrime. The model of due process is not appropriate for deterring cybercrime with a high degree of speed and mobility. The preventative law enforcement strategy is effective, but it requires a high level of law enforcement capability to detect and disable cybercrime, which is something that few Indonesian law enforcement officials possess. Prevention based on the user, which places responsibility on internet users, is fine for individuals but not for businesses. Based on collaboration between corporations, universities, civic society, and non-governmental groups, the collaborative model synthesizes the aforementioned paradigms. Because they are based on plans or roadmaps created by internet stakeholders, regulations, technical aspects, and law enforcement may be effectively implemented and developed.</p></td></tr></tbody></table></div>
