The purpose of this paper is to determine the limitations of the value of compensation (restitution) for victims of criminal offenses and to find out what criminal offenses can be given restitution and compensation. Restorative justice is a settlement process that is carried out outside the criminal justice system by involving victims, perpetrators, families of victims and perpetrators, the community, and parties with an interest in a criminal offense that occurred to reach an agreement and settlement. This research uses normative legal research, namely studying rules from an internal perspective by using the object of research as a legal norm. The analysis given to examine this research is the analysis of legal interpretation, namely tracing the rules carried out on how the rules used in victimology studies should be for restitution of compensation for victims of crime. The phenomenon of resolving criminal cases through alternative dispute resolution, which leads to a win-win solution in America, is philosophically adopted to resolve criminal cases committed by corporations, considering that corporations have qualified organs and funds. So that the possibility of granting dispensation to victims can be realized with the principle of a rational win-win solution.

ABSTRAK Penelitian ini bertujuan untuk mengetahui dan menganalisis penerapan hukum dalam kasus kekerasan dalam rumah tangga. Undang-Undang Penghapusan Kekerasan Dalam Rumah Tangga tidak menyatakan secara eksplisit bahwa kekerasan dalam rumah tangga adalah masalah publik, akan tetapi dengan adanya campur tangan negara mengindikasikan bahwa kekerasan dalam rumah tangga adalah urusan publik. Penelitian ini bersifat yuridis empiris. Dari hasil penelitian menunjukan bahwa ada kasus kekerasan dalam rumah tangga yang terjadi disebabkan oleh kekerasan fisik yang dilakukan oleh suami terhadap istri siri. Pernikahan siri, yang secara agama dianggap sah, pada kenyataannya justru bisa memunculkan banyak sekali permasalahan yang berimbas pada kerugian di pihak perempuan sebagai istri siri, termasuk jika terjadi tindakan kekerasan dalam rumah tangga. Dalam kasus kekerasan dalam rumah tangga yang dilakukan seorang suami terhadap istri siri, akibat hukumnya adalah istri siri itu tidak mendapatkan perlindungan hukum sesuai ketentuan dalam Undang-Undang Penghapusan Kekerasan Dalam Rumah Tangga. This research aims to determine and analyze the application of law in domestic violence cases. Law on the Elimination of Domestic Violence does not explicitly state that domestic violence is a public problem, but the presence of state interference indicates that domestic violence is a public concern. This research is empirical. The results of the study showed that there were cases of domestic violence that occurred due to physical violence committed by the husband against his wife in undocumented marriage. Its considered religiously legal, in fact can actually lead to a lot of problems that have an impact on the loss on the part of women as undocumenting marriage wives, including if acts of domestic violence. In cases of domestic violence perpetrated by a husband against wife. The legal consequence is that the serial wife does not receive legal protection in accordance with the provisions in the Law on the Elimination of Domestic Violence.

The objectives of this study are: to determine implementation of the role of the Integrated Service Center for the Empowerment of Women and Children (P2TP2A) providing legal protection for women and children victims of domestic violence (KDRT). To find obstacles providing legal protection for women and children for being victims. Research Method: The method used is Juridical Empirical. Research Results: 1)Role’s implementation of the P2TP2A in Muaro Jambi providing legal protection for women and children by providing socialization, then implementing the Law of Child Protection and Law of Republic Indonesia of Elimination of Domestic Violence. 2)Obstacles experienced by P2TP2A Muaro Jambi providing legal protection for women and children. Namely, not having a safe house, limited budget, lacking human resources, many people who do not understand the law, victims and their families are not open in providing information, withdrawal of complaints from the police, P2TP2A Muaro Jambi lacks psychologists. Suggestion: The government should cooperate with P2TP2A in Muaro Jambi dealing with KDRT’s case and the community should be give more understanding regarding domestic violence’s law. ABSTRAK Penelitian ini bertujuan untuk mengetahui pelaksanaan peranan Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak (P2TP2A) Kabupaten Muaro Jambi dan kendalanya dalam memberikan perlindungan hukum terhadap perempuan dan anak korban KDRT. Tipe penelitian ini adalah Yuridis Empiris. Hasil penelitian adalah pelaksanaan peranan P2TP2A Kabupaten Muaro Jambi dengan memberikan sosialisasi, penerapan Undang-Undang Tentang Perlindungan Anak dan Undang-Undang Tentang Penghapusan Kekerasan Dalam Rumah Tangga. Sedangkan kendala yang dialami yaitu tidak mempunyai Rumah Aman, anggaran yang terbatas, SDM yang kurang, masyarakat yang kurang paham dengan hukum, korban dan keluarga tidak terbuka dalam memberikan keterangan, penarikan pengaduan dari pihak Kepolisian dan kekurangan psikolog. Saran: diharapkan pemerintah dapat bekerjasama dengan baik dengan P2TP2A Kabupaten Muaro Jambi dalam menangani kasus KDRT dan masyarakat diberikan pemahaman hukum mengenai KDRT.
