law A bibliographyThis bibliography provides a selection of the literature related to Habermas's approach to law, including Habermas's most central writings on the matter. While I have striven for comprehensiveness, certain omissions may no doubt have occurred. The present selection, however, may be a helpful guide to acquaint a broad audience of scholars in legal studies with what has unquestionably grown into a very extensive debate. The bibliography is divided into two parts. The first section covers the most important writings Jfrgen Habermas has devoted to the study of law. I have also added the most significant of Habermas's related texts on politics, democracy and the welfare state, specifically his excursions on current political affairs in united Europe and (re)united Germany. This selection includes German original writings and English translations, which are cross-referenced.The second section includes secondary writings addressing issues of Habermas's thought on law. To ease entry into this wide-ranging debate, the secondary writings are divided in three parts: (1) general discussions related to Habermas's legal theory, including works which have been influential for the development of Habermas's approach; (2) works that specifically criticize and/or apply Habermas's theory in the field of legal studies; and (3) discussions of Habermas's perspective of discourse ethics in relation to law. On the latter issue, I have in this bibliography retained only writings that discuss themes more narrowly related to law. For additional sources the reader may consult the
