Poszukiwanie zabytków to zjawisko dostrzegalne, lecz w dużej mierze błędnie interpretowane z perspektywy prawnej. Brak wymaganego prawem pozwolenia lub poszukiwanie wbrew warunkom takiego pozwolenia jest przestępstwem w myśl przepisu z art. 109c ustawy o ochronie zabytków i opiece nad zabytkami. Jak pokazują dane statystyczne większość eksploratorów nie zdaje sobie sprawy z takiego wymogu, co w rezultacie generuje wysoki odsetek przestępczości niewykrytej. Ważne jest więc dla podnoszenia świadomości społecznej, by kwestie z tym problemem związane podnosić w jak najszerszym spectrum naukowej eksploracji.
