Law of inheritance in Indonesia up to now in a pluralistic (diverse). In the territory of the Unitary Republic of Indonesia, various inheritance legal systems apply, namely customary inheritance law, Islamic inheritance law and Western inheritance law listed in Burgerlijk Wetboek (BW). This legal diversity is increasing because customary inheritance laws that apply in reality are not single, but also vary according to the form of society and the family system of Indonesian society. <p>This paper describe the construction of the <em>uṣūl al-fiqh</em> initiated by Hasan al-Turabi that be dialogued with the religious conditions in Indonesia. Its aim is to find the possibility and inventory the constraints of the reconstruction of the <em>uṣūl al-fiqh</em> in Indonesia. This study uses the hermeneutical method of Paul Ricoeur in analyzing the theoretical ideas of Hasan al-Turabi. In this study found the biggest dilemma of reconstruction of <em>uṣūl al-fiqh</em> in Indonesia: the narcissism of scholars and egoism of intellectuals. Apart from that, there are conditional possibilities found, in order to reconstruct <em>uṣūl al-fiqh </em> in Indonesia, i.e.: 1) willingness, facilities, protection and consistency of the government, and 2) the inclusiveness of traditional clerics in order to create a dialogue on the traditional jurisprudence understood by them with the modern scholars and experts of various sciences. The author concluded that only the integration of modern sciences with the traditional Islamic jurisprudence, that <em>uṣūl al-fiqh</em> reconstruction could be implemented in Indonesia.</p>
One of the Government's strategic policies in suppressing and stopping the transmission of COVID-19 is to take the vaccination movement seriously. Even though the vaccination program has a positive aim, while people have doubt and even refuse to use vaccines because they are considered illegal and dangerous. Responding to this friction, this is where the importance of the MUI fatwa in socializing that vaccination is very urgent and allowed to be carried out. There is no serious objection to vaccination in Medan City; even most Medan Muslims claim that the MUI fatwa brings benefits. This article belongs to field research with a qualitative approach. The methodology used is an interpretive study of the sociology of law by conducting interviews and reviewing documents related to the MUI fatwa on COVID-19 vaccination. The result concluded that; the MUI fatwa in Medan City has been well received by the community and is considered necessary. Second, the effectiveness of the halal Sinovac vaccine has been tested and is of good quality and is allowed to use. There is no severe objection regarding vaccination in Medan City; even most Medan Muslims claim that the MUI fatwa brings benefits.
This article aims to describe the role of Ulama as Dayah managers in building an attitude of moderation and providing an ideal concept of religious moderation among students at Dayah Education institutions in Aceh. The service is carried out by mentoring which is carried out jointly with the Dayah manager. In mentoring the servant observes the application and understanding of the concept of moderation that occurs among the santri, and ends by providing material and the concept of religious moderation to the santri through presentation of the material and through group communication in the activities of the santri at the Dayah Education Institute. Prior to the introduction of the concept of religious moderation at Daya, it was found that the students had errors in understanding or interpreting the teachings of the sciences given and this had a serious impact on their practice in social and state life, such as giving birth to students who were anti-tolerant, radical so that they fell into religious organizations. terrorism organization. The results of the dedication obtained a belief that Dayah in Aceh as an Islamic education has a great responsibility in equipping his students to be moderate. Thus teachers, administrators to the head of the Islamic boarding school are expected to first have the character of religious moderation. Not a few students who are at the Aceh Dayah educational institution have been contaminated with radical mindsets because there are still many teachers or religious teachers who guide these students to instill anti-tolerant concepts due to certain interests. So that the role of Islamic education institutions is appropriate in collaborating on curriculum or SOPs for students to form the character of religious moderation. This service uses the Participation Action Research (PAR) method, namely acting as a facilitator or companion. So that the Management of the Dayah educational institution can echo and invite its students and alumni to have a moderate Muslim mindset. Artikel ini bertujuan untuk mendeskripsikan peran ulama sebagai pengelola Dayah dalam membangun sikap moderasi dan memberikan konsep moderasi beragama secara ideal di kalangan santri pada lembaga Pendidikan Dayah di Aceh. Pengabdian dilakukan dengan cara pendampingan yang dilakukan secara bersama dengan pengeloala Dayah. Dalam pendampingan pengabdi mengobservasi penerapan dan pemahaman konsep moderasi yang terjadi di kalangan santri, dan akhiri dengan pemberian materi dan konsep moderasi beragama kepada para santri melalaui pemaparan materi dan melalui komunikasi kelompok dalam aktivitas santri di Lembaga Pendidikan dayah. Sebelum pemberian konsep moderasi beragama dilaksanakan di Daya, para santri ditemukan adanya kesalahan dalam memahami atau memaknai ajaran ilmu yang diberikan dan hal ini berdampak serius pada pengamalanya dalam kehidupan bermasyarakat dan bernegara, seperti melahirkan santri-santri yang anti toleran, Radikal hingga terjerumus kedalam organisasi-organisasi terorisme. Hasil pengabdian diperoleh satu keyakinan bahwa Dayah di Aceh sebagai pendidikan islam memiliki tanggung jawab besar dalam membekali satri-santrinya agar bersikap moderat. Dengan demikian pengajar, pengelola hingga kepala dayah diharapkan terlebih dahulu memiliki karakter moderasi beragama. Tidak sedikit santri-santri yang berada di Lembaga pendidikan Dayah Aceh sudah terkontaminasi dengan pola pikir radikal dikarenakan masih banyak pengajar atau ustad-ustad yang membimbing santri-santri tersebut menanamkan konsep-konsep anti toleran dikarenakan kepentingan tertentu. Sehingga dengan demikian sudah sepantasnya peran Lembaga pendidikan dayah mengkolaborasikan kurikulum atau SOP pembelajarnya pembentukan karakter moderasi beragama. Pengabdian ini Menggunakan metode dalam Partisipation Action Reasearch (PAR) yaitu berperan sebagai fasilitator atau pendamping. Sehingga Pengelolaan Lembaga pendidikan Dayah ini dapat menggaungkan dan mengajak santri-santri dan alumninya memiliki pola pikir muslim yang moderat.
This research aims to analyze the resolution of ḥaḍānah conflicts through litigation, specifically the decisions of the Sharia Court in Aceh regarding child custody (ḥaḍānah) to find legal certainty. This research uses a normative-empirical type of research by integrating normative law and empirical law. Normative legal analysis is carried out by examining library archives or secondary data. This research uses laws and judges' decisions in ḥaḍānah cases at the Aceh Syariah Courts. The instruments used in collecting data are observation, interviews, and documents or literature studies. To obtain research data on the number of ḥaḍānah cases that were filed separately at the Sharia Court, the article draws on existing decisions starting from 2016-2021. In this research, 5 (five) Sharia Courts were taken as research samples with 32 ḥaḍānah cases, particularly the Sharia Courts in Langsa, Kuala Simpang, Idi, Jantho, and Takengon. The research applies the theory of legal objectives according to Gustav Radbruch: legal certainty, justice, and expediency. The research shows that legal certainty through the decision of the Sharia Court has been realized. However, this has not provided justice for children because many defendants have not complied with court decisions, especially the surrender of child custody according to court decisions and payment of monthly child support according to what has been decided by the court. Hence, the benefits of the court decisions on the ḥaḍānah case are still not maximized. The solution is to formulate a law that is capable of providing a deterrent effect for defendants unwilling to fulfill court compliance.
