Desentralisasi fiskal tidak dapat dilepaskan dari pelaksanaan otonomi daerah untuk mengatur keuangan daerah sesuai potensi masing-masing. Penelitian ini menganalisis permasalahan peraturan perundang-undangan yang mengatur pelaksanaan desentralisasi fiskal dalam otonomi daerah dan pelaksanaan desentralisasi fiskal dalam otonomi daerah di Indonesia. Pendekatan penelitian ini yuridis normatif dengan analisis kualitatif. Kesimpulan penelitian ini bahwa peraturan perundang-undangan yang mengatur mengenai desentralisasi fiskal dan otonomi daerah di Indonesia mengalami perkembangan mulai dari Undang-Undang Nomor 5 Tahun 1975 tentang Pokok-Pokok Pemerintahan Daerah hingga Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah namun sampai saat ini belum ada peraturan perundang-undangan yang secara lex specialis mengatur mengenai desentralisasi fiskal. Desentralisasi fiskal berperan penting dalam pelaksanaan otonomi daerah di Indonesia sebagai sarana mempercepat terciptanya kesejahteraan masyarakat secara mandiri sesuai dengan potensi daerah meskipun masih terdapat banyak kendala.
Agenda Pilihan Kepala Daerah telah menjadi wujud nyata dari perwujudan kedaulatan rakyat di Indonesia yang dilaksanakan secara demokratis sesuai amanat Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Penelitian ini bertujuan mengkaji berbagai pandangan dalam memaknai maksud dari sistem dan mekanisme pengisian jabatan Kepala Daerah secara demokratis berdasarkan Pancasila sebagai dasar filosofis negara, terutama sila keempat. Penelitian dilakukan dengan metode yuridis normatif melalui pendekatan peraturan perundang-undangan (Statute Approach) dan pendekatan sejarah (Historical Approach). Hasil penelitian menunjukkan bahwa Indonesia pernah melaksanakan sistem Pilkada secara langsung dan tidak langsung, serta ditemukan pula adanya bentuk koherensi dari pemaknaan Demokrasi Pancasila. Sistem Pilkada di Indonesia yang dapat dimaknai secara filosofis maupun harfiah dengan maksud yang berbeda. Pancasila merupakan ideologi terbuka, yang penerjemahannya ke dalam tujuan-tujuan dan norma-norma sosial politik selalu dapat dipertanyakan dan disesuaikan dengan nilai-nilai dan prinsip moral yang berkembang di masyarakat.
Physical violence from employers is a common thing for domestic helpers, even though the right to work and decent livelihood is the right of every human being. The politics of law of prohibiting physical violence for domestic workers in Indonesia is still very weak eventhough it has strong correlation to acces to justice. This study uses a normative juridical method with an analytical descriptive approach and a case through secondary data. The results show that physical violence against domestic workers had not yet obtained a strict, consistent and coherent arrangement in terms of the the politics of law of conventions, constitutions and regulations so that access to justice for domestic workers who experienced physical violence is difficult to obtain.
Within the framework of the Republic of Indonesia, Indonesia implements regional autonomy. Through regional autonomy, regions can form regional regulations based on local content to regulate and manage their regional interests but the contents must comply with the provisions of the higher laws and regulations. That means regional regulations can not contain matters about religion and religious content which is the absolute authority of the central government. The reality happens contrary to the rules and regulations because there are some regional regulations to control religious matters. This paper uses the juridical normative approach with qualitative analysis. This study concludes that there are some examples of regional regulations based on religious contents that lead to some problems including justification from the society, sectoral and regional egoism, gap between majority and minority, and lastly the persecution that happened because the gap has become something normal.
The handling of the Mount Merapi eruption disaster cannot be fully borne by the central government, because it requires fast and precise handling, especially for refugees. Since 2020 the situation has experienced a Covid-19 pandemic where positive cases in Magelang Regency have soared as well. It takes the presence and authority of The Regional Government of Magelang Regency to handle this problem. In this case, The Regional Government of Magelang Regency has chosen Sister Village that born from Paseduluran values in the disaster management system. This research is done through normative juridical method with secondary data. This research aims to show the steps and effectiveness of Sister Village strategy by The Regional Government of Magelang Regency to handle both the Mount Merapi eruption and the transmission of Covid-19 to refugees.
