This article discusses the characteristics of speeches that come from Prophet Muhammad (PBUH) on his medical prophetic. It aims to clarify Taṣarrufāt Nabawiyyah of the Prophet (PBUH) through authentic ahadeeth on medical issues. The diversity of roles of the Prophet (PBUH) has prompted variences between the the jusrists in the determination of legal opinion. There are several regarding the roles of the Prophet, for instance the role of being a guider, a mufti, a jurist, a leader and a human being. The consequence of that diversity, Islamic jurists have been arguing with each other to affirm the Syariah ruling on medical issues that came from the Prophetic medical traditions. The qualitative method was used to gather data and information that were consequently analysed. At the completion of the study, it was discovered that Taṣarrufāt Nabawiyyah could be one of the factors causing the misunderstanding of authentic ahadeeth on medical issues and thus this is the main reason for the need to understand the legal texts in accordance with Syariah purposes.
Understanding Maqasid Syariah is a must and basic requirement to whoever appointed to the position of mufti. This condition must be fulfilled in order to explain authoritative legal opinion (fatwa) to community.Thus, those answers given by mufti are required to be in line with the ultimate purpose of Maqasid Syariah which is enganging maslahah and lifting difficulities and hardships.Therefore, this study aimed to delineates interrelationship between mufti and the fatwa’s matters that engaging maslahah either it is practiced in person or in general . This paper is qualitative in nature which applies the content analysis through the intense reading of datas which collected previously from various sources such as classical and contemporary text and literature, acedamic writings (journals) and website. In conclusion, findings of this study shows that, as fatwa is commited to accuracy, this principle has been generally used as standard when ecounter a rising issue. Based on this study, there are exact purpose that fatwas in Malaysia are to enganging maslahah towards people. This is what Shariah concerned about, which is not to take easy on human’s right to have benefit in their life. ABSTRAK Memahami Maqasid Syariah merupakan tuntutan asas bagi setiap mufti. Hal ini kerana mufti bertanggungjawab dalam hal-hal menjelaskan fatwa kepada masyarakat. Bagi menjawab persoalan masyarakat, jawapan yang dikemukakan mestilah selari dengan pendekatan Maqasid Syariah. Antara tuntutan Maqasid Syariah dalam fatwa ialah mengangkat kesukaran dan kepayahan. Oleh itu, kajian ini menjelaskan hubungan antara mufti dan kefahaman terhadap kaedah maslahah dalam hal-hal kefatwaan. Kajian ini menggunakan pendekatan metode kualitatif iaitu dengan menganalisis data-data dan maklumat yang dikumpul dari pelbagai wasilah, antaranya penulisan sarjana silam dan kontemporari, jurnal-jurnal dan laman sesawang. Berdasarkan kajian, penulis mendapati bahawa kaedah maslahah ini merupakan pendekatan yang biasa digunakan sebagai kayu ukur ketepatan fatwa dalam sesuatu isu.
Harta sepencarian ialah amalan yang diwarisi daripada adat Melayu secara turun temurun. Bahkan, amalan ini telah diangkat sebagai undang-undang yang sah dan berkuat kuasa dalam perundangan Islam di Malaysia. Amalan ini saban hari terus dipraktikkan di Mahkamah Syariah seluruh negara. Pun begitu, dalam pengamalan harta sepencarian di negara ini, timbul satu persoalan mengenai standard penetapan pembahagian hak dalam harta yang dituntut oleh pihak-pihak yang bertelingkah. Persoalan mengenai prinsip keadilan yang diterapkan semasa proses penetapan pembahagian harta sepencarian cuba dibangkitkan dalam artikel ini. Berdasarkan metode analisis dan kritikan terhadap beberapa isu yang berbangkit, artikel ini memberikan penekanan secara khusus akan penetapan nilai keadilan semasa proses pembahagian hak dalam harta sepencarian. Dengan itu, objektif di sebalik perlaksanaan harta sepencarian iaitu memelihara hak-hak wanita, kebajikan keluarga dapat diimbangkan dengan maslahah lain seperti menjaga keharmonian keluarga secara berterusan dan reda-meredai. Kata Kunci: Harta sepencarian, adat, Mahkamah Syariah, keadilan, maslahah. Abstract Matrimonial property is one of the practices come from Malaysian traditional practices. It has been recognized as a legal jurisdiction and enforced in Malaysian legal system. This tradition has been practiced in Syariah Courts in Malaysia. However, throughout the practices, there is an issue has prompted regarding the standard that been used in partition processes in the matrimonial property. This article questions an issue regarding the principle of fairness that being used while the partition event in the matrimonial property. This article relies upon analysis and critical study to specifically focus on the principle of justice while the partition event of the matrimonial property. Thus, the objective of the matrimonial property practices as it guarantees women rights can be balanced and in line with other benefits such as to ensure the family is in harmony constantly. Prophetic medicine is one of the parts of Islamic Shariah law as it is mentioned in the hadiths of the Prophet which is one of the sources of Islamic jurisprudence. To avoid any misunderstanding and exploitation in society, these hadiths need to be understood precisely through the method of ‘illah analysis contained in these hadiths. The ‘illah debate has been explained in detail by past and contemporary scholars from both theoretical and practical points of view. Thus, through qualitative methods, the researchers refer to the main sources of fiqh, uṣūl fiqh and prophetic medicine to discuss the debate of 'illah and Prophetic medicine in more depth while utilizing current scholarly writings, articles, newspapers, magazines and websites that touching on the topic of study. Overall, based on research on the hadiths related to the black seed, honey, and camel’s urine and milk, the researchers found that the hadiths about Prophetic medicines are not all absolutely general in nature and mean obligatory orders because there are certain qarinah that deny them. Therefore, it is inappropriate if these hadiths are practiced according to their understanding that is only taken outwardly without taking into account factors such as the position of the hadith, its context, and interpretation.
