The relationship between patients and doctors in health services is a therapeutic contract-based relationship. The therapeutic contract begins with an (unwritten) agreement where both parties are assumed to be accommodated when the agreement is reached. Agreement that can be reached include agreeing to medical action or rejecting a medical action plan. Doctors as health workers who work in the health care sector are involved in a working relationship with the hospital as a place to carry out their profession. A doctor working in a hospital also has an administrative relationship that affects rights and obligations between the two parties and responsibilities to third parties. In the relationship between patients and the hospital, patients are the recipient of health services and the hospital is the provider of such services. Hospitals are obliged to provide health services in accordance with health care standards. Doctors, patients and hospitals are in a relationship based on trust, under an assumption that doctors can cure patients' illnesses and will do the best for patients. However, this mindset has changed along with the times, science, and technology that affect the human mind. Their social-moral-oriented relationship has turned into a material-oriented one because doctors face various demands to improve their professionalism. The change in orientation above is one of the causes of medical conflicts and disputes. Conflicts arise between doctors as health service provider and patients as health service receivers. Conflicts can turn into disputes if the party who feels aggrieved has expressed dissatisfaction with the party considered to be the cause. Medical disputes have risen sharply along with the disruption of services amid the turbulence of the COVID-19 pandemic throughout 2020 and 2021. The high rate of disputes also begs question of quality control of health services. This qualitative research-based article attempted to describe and analyze the phenomenon of medical disputes at the Dr. Iskak General Hospital of Tulungagung using the conception of inspanningsverbintenis vs resultaatsverbintenis. The findings show that, in the provision of health services, there may arise four violation categories, namely: ethical violations, disciplinary violations, administrative violations, and legal (both civil and criminal) violations.
This study aimed to reveal the essence of the rulings concerning guardianship in Islamic marriages through the construction and deconstruction of the perspectives of the Indonesian Family Law Lecturers Association (Asosiasi Dosen Hukum Keluarga Islam or ADHKI, Ind.) and the Indonesian Islamic Marriage Registrar Association (Asosiasi Penghulu Republik Indonesia or APRI, Ind.) based on the fiqh (Islamic jurisprudence) of reciprocity. The underlying background was various cases of neglect of girls that lead to problems when they become adults and need guardians in their marriages. In such a situation, the main construction of the parents' responsibilities is closely related to the right to be the daughters' guardians: does it belong to the parents or to those who have been carrying out the responsibility of taking care of the daughters? This study, based on a qualitative method with a multi-site study basis and the formulation of the fiqh of reciprocity, was expected to spawn new opportunities in Islamic legal ijtihad regarding guardianship in marriage. This comprehensive and in-depth study found that 1) the construction of the guardianship of adopted children in the perspectives of APRI and ADHKI means that the essence of guardianship is to fulfill the needs and bear the lives of the children under the guardianship and 2) based on the point of views of APRI and ADHKI, the deconstruction in the concept of guardianship of adopted children by adoptive parents or those who become protectors of the children is based on a reinterpretation of the shari'ah texts, which show that guardianship must be of those who have nasab (lineage) paths or wali hakim (a Muslim judge as the marriage guardian), using a sociological approach, human rights, and the embodiment of justice (maslahah).
Madrasa are Islamic educational institutions oriented towards Islamic learning and general science in an integrated manner. The Madrasa curriculum is designed so that students can study Islamic religious knowledge in depth and general knowledge like schools in general. In boarding school-based madrasas, the madrasa curriculum is integrated with the boarding school curriculum with a more comprehensive deepening of Islamic religious knowledge. The boarding school curriculum that has been integrated provides religious education content, moral education experiences, school, and general education, as well as skills that need to be managed with integrative management. This study aimed to describe the planning of the boarding school-based madrasa core curriculum and identify the forms of boarding school-based madrasa core curriculum assessment. This type of qualitative research with a multi-site approach, namely, research focused on explaining or disclosing differences from different sites and occurs in different research arenas. This descriptive research aims to obtain an in-depth description of core curriculum management in Islamic boarding schools, namely MTsN 2. Data collection techniques used include (1) in-depth interviews, (2) participant observation (participant observation), and (3) study documents (study documents). Data analysis techniques in multi-site studies were carried out in two stages, namely: (1) analysis of individual site data (individual cases); and (2) cross-site data analysis (cross-cases analysis). The study’s findings explain that the core curriculum for Islamic boarding schools is formulated and developed by focusing on students’ potential, development, needs, interests, and environment.
