The rapid development of technology have been showing new dimension for transaction activities. The early of transaction activity by traditional method. Now day, it can be done by fast networking, is so called with internet (ecommerce). In the practice, e-commerce transaction involving some parties which not found in the traditional method. As an Islamic law of contract, the implementation of akad strongly influence the formation of the right (shahih) transaction or wrong transaction(ghairu shahih). salam akad will encourage the fulfillment of the obligations that must be realized by parties who do akad(muslam wa muslam "alaih) to the object of akad (muslam fih) in e-commerce transaction. If the requirement of e-commerce transactions has fulfilled the provisions of the as-salam contract, the transaction is deemed valid (shahih). Instead, the law of the contract is said to be corrupted (fasid) if found imperfections or lack of clarity in the running transaction. And also in other conditions such as non-fulfillment of the terms of subject and object of the contract, then indirectly e-commerce transactions will no longer be justified (bathil).Therefore, the implementation of salam akad is an important role in the acceptance or rejection e-commerce transaction.
One form of marriage that is not justified in view of Islamic law is a marriage that is conducted secretly (sir) or in this case called by Siri marriage. The marriage is not considered perfect, when it has not been published and equipped with the testament. The marriage that has been overshadowed by the elements or attempt to conceal, classified in prohibited marriage. In order not to fall into this category, then the solution is to announce. Qualitative approach was used where the data collected from Ungku and some people in Nagari Kurai Taji Pariaman. This descriptive research was analyzed using a normative-juridical-socio approach. The study found that there was clear goal to realize an ideal household life and have the force of law. But a legal guarantee by the state through the legal framework was not implemented in Nagari Kurai Taji Pariaman, West Sumatra. The study also discovered that the groom and bride were married Siri by the religious leaders (Ungku) from local society; not by Qadhi as the authorities designated by law.
This study aims to find out the dialectic of formulating the age limit for marriage which took place from the pre-independence period until the issuance of Supreme Court Regulation Number 5 of 2019 concerning Guidelines for Adjudicating Applications for Marriage Dispensation. The demand to determine the age limit was first voiced by the women's movement explicitly during the colonial period due to the large number of daughters being married off. Child marriage has been detrimental and has a bad impact on the lives of girls. This research is a normative legal research that uses a statutory approach, a conceptual approach and a historical (historical) approach. The results of this study prove that the formulation of the politically negotiated age limit after the independence period did not receive special attention by the Government. Interests in other matters concerning the approval of the Marriage Law are generally more important. The issue of the age limit has received a lot of criticism after Article 7 of Law No. 1/1974 on marriage was judged to be casuistic in terms of legal material and judicial practice. With the promulgation of PERMA Number 5 of 2019 it becomes the determinant of the legal vacuum regarding the application of the age limit rule and the process of adjudicating marriage dispensation cases by judges in the Religious Courts.
This article discusses the ‘alasan khawatir’ [reason for concern] as a ground for the marriage dispensation files in Batusangkar Religious Court. This research had begun prior to the revision of the marriage dispensation regulation (Act 16/2019 and Supreme Court Regulation 5/2019). This is juridical-normative research accompanied by interviews. The data was gathered by investigating the marriage dispensation decisions (2017-2018) in Batusangkar Religious Court. Data was also obtained through interviews with judges, litigants, and figures who were capable to explain marriage dispensation in the Batusangkar community. This study finds that marriage dispensations in Batusangkar Religious Court are frequently justified by 'parental concerns'. The cases that are granted under these pretexts often do not reflect actual facts that led to marriage. Judges believe that decisions produced during that time are relevant to the information provided by the litigants, even if the judges did not hear the facts (clearly). In addition, this study indicates that, following the implementation of the new regulation, judges appear to be more motivated to prioritize the child's best interests as a principle to consider. As a result, granted applications become more stringent in emergency situations and according to the child's best interests.Artikel ini mendiskusikan ‘alasan khawatir’ sebagai landasan yang sering digunakan dalam permohonan dispensasi kawin. Penelitian ini awalnya dilakukan sebelum revisi peraturan dispensasi kawin tahun 2019 (UU 16/2019 dan Perma 5/2019). Secara metodologis, penelitian ini termasuk penelitian yuridis-normatif yang disertai dengan wawancara. Data dikumpulkan dengan menginvestigasi penetapan-penetapan dispensasi kawin yang diputuskan oleh Pengadilan Agama Batusangkar tahun 2017-2018. Data juga diperoleh dengan mewawancarai para hakim, litigan, dan beberapa tokoh yang dikira mampu menjelaskan fenomena dispensasi kawin di kehidupan masyarakat Batusangkar. Hasil penelitian ini menunjukkan bahwa perkara-perkara permohonan dispensasi kawin tahun 2017-2018 di PA Batusangkar berisi alasan ‘khawatiran orang tua’ sebagai dasar permohonan. Perkara-perkara yang dikabulkan dengan dalih tersebut sering tidak merepresentasikan kejadian atau peristiwa yang mendesak untuk menikah. Hakim PA Batusangkar meyakini bahwa setiap penetapan hukum yang dihasilkan pada saat itu relevan dengan keterangan yang diberikan oleh para pemohon, meskipun hakim tidak dengan jelas mendengar fakta-fakta yang mendorong para litigant tersebut. Selain itu, penelitian ini juga mengindikasikan bahwa setelah keberadaan aturan yang baru, para hakim PA Batusangkar tampaknya terdorong lebih memperhatikan kepentingan terbaik bagi anak sebagai poin pertimbangan. Ini berkonsekuensi pada permohonan-permohonan yang dikabulkan jadi lebih mengetat pada kasus-kasus yang dianggap mendesak kemudian dihakimi sesuai dengan kepentingan terbaik bagi anak.
