AbstrakMasalah perlindungan hukum terhadap profesi perawat dalam melakukan tindakan medis dewasa ini sering kali kurang menjadi perhatian karena perawat mempuyai kompetensi dalam menjalankan praktik dan memperjuangkan tingkat kesehatan ternyata harus menelan pil pahit. Minimnya pemahaman hukum oleh pihak pihak terkait serta kurangnya perlindungan hukum baik kepada pasien maupun tenaga kesehatan. Maka hasil kerja keras Perawat dalam memberikan pelayanan kesehatan apabila tidak berhasil akan berhadapan dengan hukum bahkan dikategorikan tindakan malpraktik dengan sangsi pidana. Atas dasar itu maka peneliti akan difokuskan pada beberapa masalah yaitu bagaimanakah pelimpahan wewenang dokter kepada profesi perawat pada aktivitasnya dalam peristiwa tindakan medis? Metode yang digunakan dalam penelitian ini adalah penelitian yuridis normatif, yaitu penelitaian dengan mengunakan peraturan perundang-undangan yang meliputi tiga lapisan keilmuan hukum terdiri atas telaahan dokmatika hukum, teori hukum dan filsafat hukum. Adapun Hasil Pembahasan menemukan bahwa pelimpahan wewenang Dokter kepada profesi perawat dalam tindakan medis dari perspektif hukum. Perawat adalah seseorang berperan dalam merawat dan membantu seseorang dengan melindunginya dari sakit, luka dan proses penuan. Hal tidak sesuai dengan peraturan UU No.

On this basis, this research focuses on. How is the problem of BPJS Health membership obligations from the perspective of justice. The method used is the method of analysis, this type is normative legal research conducted to examine secondary legal materials, also using the approach method, namely the statute approach and the conceptual approach, which will provide recommendations as input material for revising laws or the health system. The results of the study found that among the poor who could not register themselves as BPJS Kesehatan members, health insurance from the state for the community was still found to be inequitable. The research objective was to determine the form of legal protection for medical personnel and patients or their families for criminal acts of medical negligence and the form of the mediation concept of penalties for medical negligence. This research uses normative juridical legal research, is descriptive analysis, data sources are primary and secondary legal materials. Medical negligence lies between deliberate and coincidence, the crime of medical negligence is not mens rea, culpa offense is a false offense. The concept of penal mediation for the criminal act of medical negligence is to bring together medical personnel with patients or their families directly, changing the perspective of criminal law towards a humanistic criminal law, because the main focus isn’t on retaliation but on efforts to restore and make peace. The concept of penal mediation isn’t intended to maintain discretionary measures by law enforcers but to provide a place for penal mediation for criminal acts of medical negligence in the criminal justice system in realizing legal protection for medical personnel and patients or their families. The concept of penal mediation in realizing legal protection for medical personnel and patients or their families is a reform of criminal law as a reflection of restorative justice that needs to be regulated and by offering conditional norms. Criminal law reform must be carried out by reviewing and reconstructing criminal law in accordance with the social central values and socio-cultural values of the Indonesian people so that Indonesia's criminal law in the future is filled with Pancasila values.
