Data dari konselor Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak (P2TP2A) Jawa Barat, menunjukan angka kekerasan dalam rumah tangga (KDRT) di Jawa Barat masih tinggi. Dalam satu tahun P2TP2A bisa menangani lebih dari 100 kasus. jumlah tersebut bisa lebih banyak, disebabkan sampai saat ini masih banyak korban KDRT yang tidak berani melapor. Hal ini menjadi keprihatinan masyarakat dan pemerintah daerah Jawa Barat, karenanya yang menjadi permasalahan adalah bagaimana pemberian perlindungan kepada korban KDRT di wilayah kajian yaitu Bandung, Sukabumi, Indramayu, Cimahi dan Garut. Dengan menggunakan data sekunder dan ditunjang data primer serta menggunakan teori mengenai pelayanan korban, dimana pelayanan korban dengan cara melakukan aktifitas-aktifitas yang dilakukan dalam rangka respon terhadap viktimisasi dengan maksud untuk mengurangi penderitaan dan memfasilitasi pemulihan korban. Termasuk dalam aktifitas pelayanan korban adalah memberikan informasi, melakukan tindakan/ pemeriksaan, melakukan intervensi individual, terlibat dalam advokasi sosial, mengajukan kebijakan publik dan bekerja di dalam program-program pengembangan perlindungan untuk korban. Dengan model serivice model, yang telah dilakukan oleh Pemerintah daerah Jawa Barat, antara lain adalah: 1).layanan kesehatan; 2).layanan rehabilitasi sosial (pendampingan korban dilingkungan keluarga dan masyarakat, pemulihan kejiwaan korban; 3). Psikologis; 4). layanan rehabilitasi dan reintegrasi terhadap korban kekerasan; 5).pendampingan hukum.Pelaksanaan service model tersebut dilaksanakan dengan memberdayakan P2TP2A bekerja sama dengan unsur Pemerintah Daerah; akademisi; ahli hukum; psikolog; psikiater; tokoh agama; dan unsur masyarakat dimasing-masing daerah kajian.Kata kunci: Pemberian Perlindungan Hukum Terhadap Korban KDRT Di daerah Jawa Barat (Kajian daerah: Bandung, Sukabumi, Cimahi, Indramayu dan Garut).
In 2020, a health emergency became a condition that affected the stability of the Indonesian state, especially in certain areas that require proper and prompt handling. The Covid-19 virus outbreak (also known as the coronavirus), has infected millions of people across Indonesia. The legal basis used to draft the handling policy, at least also based on the 1945 NRI Constitution, Law No. 24 of 2007 on Disaster Management (hereinafter referred to as Law No. 24 of 2007) and Law No. 6 of 2018 on Health Quarantine (hereinafter referred to as Law No. 6 of 2018). The issue raised is how the implementation of law enforcement and legal sanctions in handling the Covid-19 pandemic in Indonesia based on Law No.6 of 2018 concerning Health Quarantine and reconstruction of legal relations between the central and local governments in handling the pandemic effectively in Indonesia? The method used is normative legal research methods. Normative legal research itself is a research method that examines the law from an internal perspective with the object of research is the legal norm. The approaches used in this study are the statute approach and the conceptual approach. This research is based on the regulation of laws and regulations governing the handling and management of the Covid-19 pandemic and analysis of the concept of determining the laws and regulations. The conclusions that can be drawn include a comprehensive analysis of the substance of Law No. 24 of 2007, Law No. 6 of 2018, and Law No. 23 of 2014 shows the unclear legal relationship between the central government and local governments in emergency situations (extraordinary), especially in handling the pandemic. As a result, its implementation often causes legal conflicts between the central and local governments that hinder the handling of Covid-19 in Indonesia. The Regional Government, on the basis of autonomy has the right to take care of its regional affairs, including in dealing with problems that occur in the region. The results of this study provide advice and recommendations including The Need for Synchronization and Harmonization of the Regulation of Law No.24 of 2007 on Disaster Management, Law No.23 of 2014 on Local Government and Law No.6 of 2018 on Health Quarantine so that the construction of central and regional legal relations in handling outbreaks in Indonesia can be more responsive and effective in its implementation
In the law enforcement against perpetrators of criminal acts of terrorism, protection of human rights must be prioritized even though the act constitutes an extraordinary crime which must be condemned regardless of the reasons and motives. The principle of presumption of innocence must also be upheld because the principle of presumption of innocence is a norm or rule that contains provisions that must be implementedby law enforcement officials to treat a suspect or defendant like an innocent person even though the evidence indicates the fault of a suspect or defendant. In the application of the presumption of innocence principle, law enforcers must really be able to implement it even though sometimes in the field implementation there are pro and contra when making decisions to take action against terrorists. Therefore, it is necessary to optimize law enforcement based on the presumption of innocence, both as stated in the Criminal Procedure Code (KUHAP) and the terrorism law so that law enforcement can prioritize the presumption of innocence and can avoid abuse of authority by law enforcement.
The purpose of this study is to find out the legal protection regulations for buyers, the efforts that buyers of apartment units can take in the form of PPJB if the developer is declared bankrupt and how the law should give rights to the apartment buyers. Research on the above problems was conducted using qualitative methods. The type of research used is normative empirical by using approaches with methods of legal interpretation, legal construction, legal philosophy, legal history, and comparative law, as well as a legal pluralism approach. The data used in this dissertation research are primary and secondary and tertiary data which are analyzed objectively based on existing juridical references in order to obtain answers to the problems. Based on the research results from the problems above, it is concluded that there are several arrangements regarding the protection of buyers/consumers in Indonesian positive law, both from civil law, criminal law, customary law, and Islamic law. Buyers of apartment units can also sue in accordance with Article 3 of the UUK and PKPU, although the process must take a long time. The law should provide an update by adding a clause in the PPJB that objects being traded cannot be included in the bankruptcy budget.
ABSTRAKPerbuatan menggunakan jasas pekerja sek komersial adalah suatu pelanggaran dan dapat dikenakan sanksi. Tema Pengabdian kepada masyarakat ini, menjadi kompleks apabila dilakukan melalui online. Dengan cara memesan orang yang menjajakan diri. Dengan melakukan penyuluhan dan posbakum, dapat diketahui tingkat kesadaran masyarakat terhadap perbuatan yang terjadi disekitarbnya. Metode penyuluhan dan posbakum dilakukan, serta menyebarkan angket untuk mendapatkan masukan tentang peserta, yang merupakan masyarakat. Di daerah-daerah Indonesia, banyak terdapat peraturan daerah yang melarang melakukan perbuatan memakai jasa PSK. Ancamannya merupakan penjatuhan sanksi pidana kurungan dan denda.Peserta merespon dan menyadari perbuatan yang dilarang dengan sanksi yang berupa kurungan atau denda.
