Indonesia is a country that adheres to a unitary form of government, but it is different if we look at the regional government system where Indonesia has adopted the principle of federalism as regional autonomy. Kendal Regency, geographically, some of its areas are mountainous areas, especially in the village of Sidokumpul, there are still requirements for customs in resolving land disputes. From this, Sidokumpul Village also implemented the ADR (Alternative Dispute Resolution) system. Disputes that occurred in village communities, especially Sidokumpul Village, in their settlement, the community preferred to use conflict resolution in a non-litigation way through the village head. This study uses normative juridical research, or also known as normative legalbresearchbmethod. Thebnormative juridicalbresearch methodbis library law researchbwhich is carriedbout by researching and studying literature materials or mere secondary data. The land dispute problems that occurred in Sidokumpul village during Ari Rimbawanto's 4 (four) years as Village Head could be resolved properly without having to to court, this is due to the crucial role of the village head in the settlement.
Transportasi dinilai sangat penting selain digunakan sebagai alat perpindahan orang maupun barang, transportasi pun berguna untuk mempercepat roda perekonomian, hal ini dikarenakan tanpa transportasi maka segala aktifitas akan terkendala sehingga mengakibatkan terkendalanya perekonomian. Ditandainya perubahan mengenai moda transportasi online, hal ini berdampak pula pada perkembangan dari sistem pekerjaan yang semula menggunakan sistem konvensional menjadi sistem aplikasi online.Penelitian hukum ini mempergunakan pendekatan yuridis normatif. Spesifikasi penelitian menggunakan deskriptif analitis, penelitian ini diharapkan dapat memunculkan gambaran serta analisis, yang menyeluruh dengan secara sistematis mengenai kenyataan yang ada di lapangan khususnya mengenai tentang penerapan perjanjian hubungan kerja dan perlindungan sebagaimana yang terdapat di dalam perundang-undangan. Pengumpulan data dilakukan dengan cara melakukan observasi dan wawancara serta dengan menggunakan perundang-undangan yang berlaku.Perjanjian kemitraan yang memiliki bentuk perjanjian sebagai perjanjian bagi hasil, perjanjian keagenan, dan perjanjian sub-kontrak. Sehingga sesuai dengan isi dari perjanjian kemitraan bahwa perusahaan transportasi onlinememposisikan pekerja atau driver sebagai mitra kerja dalam menjalankan kegiatan transportasi. Perjanjian hubungan kerja kemitraan tidak mengenal adanya atasan (majikan) dan bawahan seperti yang dikenal di dalam perjanjian kerja namun dalam perjanjian kemitraan semua pihak berada pada posisi yang sama kedudukannya. Dalam kegiatan transportasi online ialah perjanjian kemitraan yang memilki sifat kesetaraan para pihak sehingga dalam pelaksanaan unsur-unsur hubungan kerja yang terjadi ialah tidak berdasarkan dari pihak pertama atau pengusaha saja. Sehingga mengenai hubungan kerja yang menyebutkan bahwa terdapat unsur-unsur mengenai pekerjaan, upah dan perintah, mengenai ketiga hal unsur dalam hubungan kerja tidak memenuhi unsur-unsur yang terjadi pada perjanjian kemitraan antara perusahaan transportasi online dan driver.Perlindungan yang didapati oleh pengemudi tertuang pada pasal 16 ayat 16 ayat (3) huruf h dan i yakni mendapatkan kepastian santunan jika terjadi kecelakaan, dan kepastian mendapatkan perlindungan jaminan sosial ketenagakerjaan dan jaminan sosial kesehatan sesuai dengan ketentuan peraturan perundang-undangan walaupun dalam penerapannya pelasksaanaan perlindungan yang diberikan dengan menggunakan syarat disaat pengemudi melaksanakan kegiatan pengangkutan.
Toleransi merupakan hal vital di tengah kehidupan masyarakat Indonesia yang pluralistik. Keberagaman yang ada tidak hanya memperkaya kebudayaan Indonesia tetapi juga dapat menjadi alat disintegralisasi bangsa yang mengancam keutuhan Negara. Penelitian ini bertujuan untuk untuk mengetahui sejauh mana implementasi mata kuliah Pendidikan Pancasila dan Kewarganegaraan sebagai upaya membangun sikap toleransi pada mahasiswa dalam kehidupan di kampus. Akademi Kesejahteraan Sosial Ibu Kartini Semarang, merupakan salah satu kampus pendidikan vokasi di Jawa Tengah. Akademi Kesejahteraan Sosial Ibu Kartini Semarang melalui mata kuliah Pendidikan Pancasila dan Kewarganegaraan telah berkomitmen untuk mencerdaskan bangsa, dan mewujudkan sikap serta perilaku toleransi sesama warga negara Indonesia melalui bimbingan terhadap para mahasiswa yang berasal dari berbagai suku dan agama agar tercipta keselarasan dan sikap saling bertoleransi dan saling hormat menghormati, menerima perbedaan antara yang satu sama yang lainnya. Penelitian ini merupakan penelitian deskriptif analisis, tektik pengumpulan datanya dengan wawancara langsung dengan nara sumber dan menggunakan kepustakaan dari buku literatur maupun jurnal ilmuah. Hasil Penelitian menunjukan bahwa mata kuliah Pendidikan Pancasila dan Kewarganegaraan dapat mewujudkan sikap toleransi mahasiswa dalam kehidupan di kampus. Wujud sikap toleransi mahasiswa di kampus diantaranya adalah saling menghormati perbedaan antara ras, suku, agama maupun budaya, serta kebersamaan saling gotong royong yang dapat dilihat melalui diskusi, tugas individu dan kelompok, proses pembelajaran di kelas, kegiatan organisasi di dalam maupun di luar kampus.Tolerance is vital in the midst of a pluralistic Indonesian society. This study aims to determine the extent to which the Pancasila and Citizenship Education courses are implemented as an effort to build tolerance among students in campus life. Akademi Ibu Kartini Semarang, is one of the vocational education campuses in Central Java. Akademi Ibu Kartini Semarang through the Pancasila and Citizenship Education courses has committed to educating the nation, and embodying attitudes and behavior of tolerance among Indonesian citizens through guidance to students from various ethnicities and religions to create harmony and mutual tolerance and mutual respect, accept the differences between one another. This research is descriptive analysis research, the data collection technique is by direct interviews with informants and using literature from literature books and scientific journals. The research results show that the Pancasila and Citizenship Education course can manifest students' tolerance in life on campus. The manifestation of student tolerance on campus includes mutual respect for differences between races, ethnicities, religions, and cultures, as well as mutual cooperation which can be seen through discussions, individual and group assignments, the learning process in class, organizational activities inside and outside the campus.
Geographical Indication is a legal protection to protect an item as a sign of the area of origin of an item due to several unique factors that are only owned by certain areas. Arrangements in TRIPs are based on the reputation, quality and distinctive characteristics of an area/region. Geographical Indications are a separate intellectual property that is unique because it can only be registered as a joint/communal right. The Indonesian law governing Geographical Indications is placed in one law together with trademarks, namely Law Number 20 of 2016 concerning Marks and Geographical Indications. in terms of product marketing and in terms of supervision. The setting of Geographical Indications must be able to adopt and support local economic development efforts and even be able to compete globally so that what criteria are needed to be granted this right. Criteria if a product can be registered as a Geographical Indication if it meets the objective and subjective requirements. Apart from distinguishing the special aspects of the name of origin of the goods, it must have economic value. This means that the name of origin does not only function as a differentiator, but it must be clear that the place of origin has a great influence on improving the quality of the goods. For example, natural color batik from Asem leaves and Ketapang leaves from the city of Semarang. Batik as an intangible heritage of the Indonesian nation was recognized by UNESCO on October 2, 2009. Batik is basically a technique of decorating textile surfaces by holding back dye, which must receive legal protection. One of the batik techniques instead of using canting is the Ecoprint Technique. As a cultural heritage of the Indonesian nation, especially in the city of Semarang, a sustainability of cultural heritage, especially Batik with natural dyes, is needed which requires government attention by obtaining permanent legal protection. The use of natural coloring from natural materials belonging to certain areas using the Ecoprint Technique can be a potential area for the development of Geographical Indications.
