According to the examination of the 17-year-old girl in the Child Protection and Monitoring Center, Karadeniz Technical Universtiy, it is detected that there is a natural notch at three o'clock on the annuler hymen, the hymen of medium width is not elastic, there is not any area with tear or scarification, and the aperture is 1,5 cm. The measurements of the person showed pregnancy compatible with 37 weeks on the examination date. With respect to Article 103 of Criminal Code of the Republic of Turkey, "Any person who sexually abuses the child shall be sentenced to a penalty of imprisonment for a term of eight to fifteen years. In case of performance of sexual abuse by inserting an organ or instrument into a body, the offender is sentenced to imprisonment of no less than sixteen years." Özetİnsanın bir başka canlıyı özellikle de bir başka insanı bilerek isteyerek öldürmesi cinayet olarak adlandırılır. Bu durum, neredeyse her toplumda kabul edilemez bir insanlık suçudur. Bir bireyin kendi çocuğunu öldürmesine ise her zaman için sebepleri ve sonuçları bakımından anlaşılması ve anlamlandırılması çok daha zor ve karmaşık bir durum olarak bakılmıştır. Bu bağlamda çalışmamızın amacı; çocuk cinayetlerinin failleri ve sebepleri üzerinden irdelenirken, çocuk istismarının özel ve nadir bir türü olarak tanımlayabileceğimiz 'Medea Kompleksini' ele alarak çocuk istismarının tanınması, önlenmesi ve rehabilitasyon süreçlerinde yapılması gerekenleri adli tıbbi açıdan değerlendirilmesi şeklindedir. Bir çocuğun kendi ebeveynlerinden biri tarafından öldürülmesi, parental filisid olarak adlandırılmaktadır. Filiside etki eden faktörler incelendiğinde partnerden intikam alma (spouse revenge filicide) durumunun kadınlar-da çok daha sık rastlanılıp, oldukça dikkat çekici olduğu görülmektedir. Bu durum "Medea Kompleksi" olarak adlandırılmaktadır. Adını mitolojik çağlardan alan bu karmaşık durum, hikayesi eşliğinde incelenerek çocuk istismarı kapsamında tartışılmıştır. Sonuç olarak; çocuk istismarı kaza dışı ve önlenebilir bir sebebe bağlı gerçekleşir. AbstractThe definition of homicide is killing another living being or especially another person willingly. This situation is an unacceptable crime against humanity in almost every society. There is always difficulty and complexity to understand and explain to kill his/her own child with any reason or result. The aim of our study is to discuss the child homicide with their reasons and view the child homicides who are killed by their parents especially with their historical, social and cultural aspects by the medical jurisprudence. When a child is killed by one of his/her parent than it is named "parenteral filicide". When we look at the factors of filicide; the type of spouse revenge filicide is mostly seen in women and it is so invincible. This situation is called "Medea Complex". This complex history which comes from mythological ages is discussed with in child abuse composition. In conclusion child abuse occurs by nonaccidental or with preventable reasons. However, various studies improved that most of those cases can be protectable; every child which we cannot protect from abuse will be our shame of humanity in the 21st century.
Results: A total of 108 cases were evaluated in the age range of 18-64 years. According to the anamnesis taken, the medical records examined, the tests applied and the psychological status examination, the decisions given were that 56 (51.9%) were restricted in the context of item 405 TMK (Turkish Civil Code), 3 (2.8%) could be restricted on request in the context of item 408 TMK, 11 (10.2%) could be taken into custody in situations determined as threatening him/herself or his/her family with hardship or poverty through extravagance, poor lifestyle and poor management of assets, 4 (3.7%) were defined as eligible for the appointment of a legal advisor and 34 (31.5%) were not determined with any state requiring custody.Conclusion: In this study, it was found that the most common disorder in people between the ages of 18-65 that affects legal capacity was mental retardation. The obtained findings indicated that a special approach should be taken in the evaluation of the legal capacity of the non-geriatric age group.
