The purpose of this study is to analyze the cybercrimes in sexual violence against children in Indonesian laws. Act Number 11 of 2008 concerning Information and Electronic Transactions, concerning cybercrime specifically regulated in Indonesia. Of the various types of cybercrime that occur in Indonesia, it is interesting to study the vacuum norms governing cyber pornography carried out on children in Act Number 11 of 2008 concerning Information and Electronic Transactions. The crime can be said as violence against children whose punishment can be aggravated as stipulated in the Child Protection Act. This research is a normative legal study by examining the absence of norms in the ITE Law regarding sanctions imposed on perpetrators of child abuse in cyberspace. The study was conducted by using normative research methods so that utilizing primary legal materials such as the Criminal Code, Child Protection Act, Pornography Law, and Electronic Information and Transaction Law. Based on the collection and analysis of the legal material, the results showed that there is a need for criminal penalties for cyber pornography against children. This is done by considering the impact of the crime on the development of children and aims that the perpetrators deter and prevent similar crimes. The results practically contribute that the government is expected to play an active role in continuing to provide protection and assistance for psychological recovery from victims.
Sosialisasi protokol kesehatan semakin digencarkan oleh pemerintah, hal ini dilakukan untuk menekan angka pasien COVID-19. Dengan dilakukannya pembentukan Tim SATGAS COVID-19 di setiap Desa untuk membantu pemerintah dalam memberikan edukasi kepada masyarakat. Di Desa Penatahan Tim SATGAS COVID-19 berfokus kepada para lansia dalam memberikan edukasi mengenai protokol kesehatan, al ini dilakukan karena para lansia memiliki keterbatasan dalam mengakses media sosial. Sehingga agar mendapatkan informasi dan pemahama yang pasti mengenai hal tersebut, perlu adanya edukasi secara langsung kepada lansia. Dengan menerapkan strategi pendekatan persuasif fan edukatif agar tercapainya hubungan timbal balik yang seimbang dari proses sosialisasi kprotokol kesehatan. Metode pelaksanaan yang diguakan adalah dengan wawancara dan melakukan observasi langsung kelapanga unutk memperoleh data yang valid.
The problem of blaming victims is related to the strong traditions and culture of the community that still perpetuate gender stereotypes. This study aims to examine the implications of patriarchal culture on the position of women as subordinates, the concept of blaming the victim against the women victims of sexual violence and human rights studies on victim blaming and labeling for women victims of sexual violence. The culture of gender injustice in the society makes women often get negative labels, in which the women who look beautiful and dress up using rather tight and sexy clothes are always considered as inviting the opposite sex to commit sexual harassment. This is then always used and associated with labeling of victims of sexual harrasment in which the society tends to blame victims of sexual harrasment or victim blaming. This type of research is a normative juridical research that is prescriptively providing solutions to the legal protection for victims related to victim blaming and labeling women as victims of sexual violence in the view of human rights that difinitely violates the constitution and law.
The implementation of virtual trials through teleconference is seen as in line with social distancing and physical distancing policies, in order to reduce the pace of development of the Covid-19 Pandemic. As a quick response to the Supreme Court in ensuring the protection of judicial officials, justice seekers, court users including defendants who are dealing with the law, the Supreme Court has issued Supreme Court Circular (SEMA) Number 1 of 2020 concerning Guidelines for Implementing Tasks During the Prevention Period of the Spread of Covid-19 in The environment of the Supreme Court and the Judiciary Bodies that are under it. Within the prosecutor's office, the trial using this teleconference facility refers to the Instruction of the Attorney General of the Republic of Indonesia Number 5 of 2020 concerning Policies for Implementing Tasks and Handling Cases During the Prevention Period for the Spread of COVID-19 in the Public Prosecutor's Office of the Republic of Indonesia on March 27, 2020. Referring to the judicial system criminal law in Indonesia, online court proceedings are a legal breakthrough (rules breaking) in a positive sense. Namun, dalam praktiknya pelaksanaan persidangan online masih menemui kendala atau hambatan.
This study aims to analyze the legal protection provided for children as a victim of sexual violence at the Bali Regional General Criminal Investigation Directorate and any legal action could be taken if the legal protection for child victims is not implemented. This is an empirical juridical legal study. The results show that the legal protection provided to children as a victim of sexual violence includes the humane treatment of children following the dignity and rights of the child, the provision of special assistants for children from an early age from Social Service Workers and others. The legal action is taken if the legal protection over the child victims is in the investigation stage, the victim feels that he has not received any legal service or protection from the investigator in terms of the rights of the child as a victim and his family can report to his superiors so that the investigator’s performance can be evaluated to provide a maximal legal service and protection for the child.
