This article discusses the existence of MUI fatwa and its position in Indonesia. So far, people are more likely to use the fatwa law than national law. Many political interests, so that the independence of the fatwa in Indonesia, the MUI fatwa, is doubtful of its integrity. In the context of Islamic law, a fatwa is an essential presence in society, while in national law, a fatwa is only a doctrine whose status is not required to be followed. The deficient legal awareness of the community is a problem in the community because the political influence of the fatwa has a negative impact, so it is feared that it will create a negative thing that lives and develops into a civilization in society. From this writing, it can be concluded that the position of the fatwa is not required to be followed so that public awareness about the law must be socialized by the government so that people can understand. However, if the fatwa is following the constitution, the fatwa can be applied in the law so that the fatwa is not easy to be politicized by any party concerned.
Keadaan Bahaya yang kemudian menurunkan kebijakan PSBB dan new normal serta kebijakan-kebijakan yang lainnya dalam lingkup yang sama. Kebijakan tersebut masih dinilai kurang baik dihadapan masyarakat, karena penerapannya yang kurang efektif dan masih ditunggangi kepentingan-kepentingan lain. Penelitian ini menggunakan kajian normatif dengan pendekatan filosofis, yuridis, dan sosiologis. Pro dan kontra atas kebijakan-kebijakan yang ditempuh merupakan hak yang wajar, pro karena kebijakannya sudah menjadi kebijakan yang cepat dan tanggap, di sisi yang kontra kebijakan yang diterapkan tidak efektif dengan melihat angka covid-19 yang masih terbilang tinggi. Akan tetapi, pada dasarnya kebijakan yang ditempuh oleh pemerintah tidak selalu berjalan dengan sempurna, namun di sisi lain kebijakan yang selama ditempuh dianggap merupakan keputusan terbaik dengan memprioritaskan hak-hak rakyat, hak-hak itulah yang telah tercermin dalam bingkai maqashid al-syariah baik hak-hak beragama, hak hidup, hak memperoleh informasi yang benar, hak keturunan serta hak dalam memenuhi kebutuhan hidup yang diaktualkan ke dalam rumusan kebijakan-kebijakan yang diatur dalam penanganan
This paper aims to seek or develop public legal awareness and efforts to develop the Pilkada in the Covid-19 Pandemi Era. The research method used in this paper uses juridical empirical, with a qualitative approach. The data technique uses observation, interviews, and literature studies. Data checking techniques used triangulation and analysis using interactive models. The results showed that the awareness of Pemalang Regency people in the middle to lower category was still low, while people with the middle to upper category had started to have knowledge and understanding of the simultaneous regional elections and their policies and how the considerations for choosing, exercising their rights and obligations, and procedures were in the era of the Covid-19 pandemi. In addition, the attitudes and behavior of the middle to upper class society have begun to be structured, reprimanding officers who underestimate their duties. The factors that influence the legal awareness of Pemalang Regency society, namely: education, economy, religion, and socio-cultural factors. Then, efforts to build their awareness through counseling and campaigns about simultaneous regional elections, especially during the Covid- 19 pandemic.
Historically, one of the reasons for Islam’s growth and development in various parts of the world is the nature of Islam that is never static in a law. In the context of these changes, the elasticity and flexibility of Islamic law in responding to the problems of human life are increasingly demanded and expected to be able to accommodate them. One way is to do ijtihad to determine the law of every new problem that arises. Evidenced since the time of the Prophet s.a.w., the practice of ijtihad is always done by friends when they cannot ask directly to the Prophet s.a.w. One of the best-known friends did ijtihad after Rasulullah s.a.w. died is Ali ibn Abi Talib. Starting from this description, the writer wants to see Ali ibn Abi Talib’s policy of ijtihad. This paper uses qualitative research methods that are library research. The data in this paper is sourced from books, journals, articles discussing Ali ibn Abi Talib, and ijtihad. After the data is collected, it is then analyzed and analyzed with data analysis techniques, namely data reduction, data presentation, and conclusion drawing. The analysis shows that in the Ali ibn Abi Talib’s ijtihad has its patterns and methods in istinbath or establishing Islamic law (fiqh). His determination to hold on to the verses of the Al-Quran as a whole and his carefulness to judge a Sunah, as well as his flexibility in using the ra’yu (reason) was a distinctive feature for Ali ibn Abi Talib in dealing with the legal polemic that occurred in the society at that time.Keywords: Ali ibn Abi Thalib; Ijtihad; Policy
