Halal certificate is a written fatwa MUI that states halal food products in accordance with Islamic law, aims to provide legal assurance to consumers. However, the existing regulations are still perceived sectoral, partial, inconsistent and not systemic. Moreover, the most fundamental thing is the halal certification is not an obligation (mandatory) for businesses but it is voluntary. Consequently, halal certification and halal label do not have strong legal legitimacy which results in legal uncertainty of halal food products. In regard to this, the draft of Law on Halal Product Guarantee that is still stalled in the House should be soon stipulated and MUI should be given the authority to issue halal certification and perform it through the Fatwa Commission LPPOM. In addition, the government serves as a regulator as well as supervisor in the implementation of the provisions of the law which cause justice uncertainty. AbstrakSertifikat halal adalah fatwa tertulis MUI yang menyatakan kehalalan suatu produk pangan sesuai dengan syari'at Islam, bertujuan untuk memberikan kepastian hukum bagi yang mengkonsumsinya. Namun, regulasi yang ada masih terkesan sektoral, parsial dan inkonsistensi serta tidak sistemik dan sertifikasi halal itu bukan merupakan suatu kewajiban (mandatory) bagi pelaku usaha,tetapi bersifat sukarela (voluntary). Akibatnya sertifikat halal dan label halal belum mempunyai legitimasi hukum yang kuat, sehingga tidak menciptakan jaminan kepastian hukum kehalalan produk pangan. Untuk ini, RUU JPH segera menjadi Undang-undang dan memberikan otoritas kepada MUI untuk melakukan sertifikasi halal melalui LPPOM MUI dan Komisi Fatwa. Dan pemerintah berfungsi sebagai regulator dan pengawas dalam implementasi ketentuan undang-undang yang akan ditetapkan tersebut, sehingga dapat menciptakan ketidakpastian hukum. The primary problem in this study is how to law enforcement and the protection of consumer's rights against the certification and labeling of halal products according to UUJPH. The second problem to consider is the factors that causing young enterpreneurs to delay certification and halal product labeling on their products. This is a normative juridical research with a complementary juridical empirical data. The study points out that: first, until now there has been no law enforcement and no collective protection of consumer rights on the certification and labeling of halal products. To complicate matters, there is lack of coordination between ministries and agencies by MORA RI. Second, some of the factors that cause the enterpreneurs to delay halal certification on their products are the facts that: i) UUJPH cannot be implemented operationally because the Government Regulation (PP) has not been issued; ii) BPJPH which is the mandate of UUJPH has not been established; iii) Business actors find it difficult to certify some kinds of their products, such as pharmaceutical products since the raw materials are imported from abroad; iv) There is a reatively poor public awareness of consumers of halal products since they do not prioritize halal factor in selecting and purchasing a product.
