Abstrak: Agama mewajibkan suami memberi nafkah kepada istri dengan adanya ikatan perkawinan yang sah. Setelah akad nikah, maka suami wajib memberikan nafkah kepada istrinya paling kurang kebutuhan pokok sehari-hari. Kenyataannya ada beberapa istri yang menjadi penanggung jawab keluarganya. di Kecamatan Kute Panang Kabupaten Aceh Tengah istri lebih berperan dalam memenuhi keperluan rumah tangga, pendidikan anak, kebutuhan anak. Ada beberapa istri yang berprofesi sebagai ibu rumah tangga juga berprofesi sebagai petani, guru dan lainnya. Rumusan masalah dalam skripsi ini adalah bagaimana peran istri sebagai penanggung jawab keluarga, apa yang melatar belakangi istri menjadi penanggung jawab keluarga dan bagaimana pandangan hukum Islam terhadap istri sebagai penanggung jawab keluarga. Dalam penelitian ini penulis menggunakan metode penelitian kualitatif dengan menggunakan metode analisis deskriptif.Teknik pengumpulan data yang digunakan dalam penulisan skripsi ini yaitu dengan wawancara, dokumentasi dan angket, serta penelitian perpustakaan (library research), untuk melengkapi data sekunder yang dibutuhkan dalam penelitian ini. Hasil penelitian menunjukkan istri mencari nafkah sebanyak 97% dan istri berperan penuh sebagai penanggung jawab keluarga 42% responden menjawab menyetujui. Adapun yang melatarbelakangi istri menjadi penanggung jawab keluarga ialah: suami tidak mempunyai pekerjaan sama sekali, pendapatan suami yang terbatas, tidak memiliki suami (suami meninggal dunia/ bercerai), istri senang bekerja di luar rumah, meringankan beban suami, jenjang pendidikan istri lebih baik. Islam membolehkan kepada ibu rumah tangga untuk bekerja baik di rumahnya sendiri mau pun diluar rumah, agar mendapatkan dana tambahan untuk meningkatkan kesejahteraan rumah tangga.Abstract: religion requires husbands to provide their wives with legitimate marital bonds. After the marriage contract, the husband is obliged to make a living to his wife at least the daily necessities. Some wives are in charge of their families. In Kecamatan Kute Panang District Aceh Tengah The wife is more instrumental in fulfilling household needs, child education, children's needs. Some wives work as housewives as well as farmers, teachers, and others. The problem formulation in this thesis is how the role of the wife as the family responsibilities, what is behind the wife to be the responsibility of the family and how the view of Islamic law on the wife as the responsibility of the family. In this research, the authors use qualitative research methods using a descriptive analysis method. The data collection techniques used in the writing of this thesis are interviews, documentation, and polls, as well as library research, to complement the secondary data needed in this study. The results showed the wife to make a living as much as 97% and the wife played a full role as the family responsibility of 42% of respondents answered approve. The person who is behind the wife of the family is the responsibility: the husband has no job at all, husband's limited income, no husband (husband dies/divorced), wife happy to work outdoors, relieve husband's burden, the education level of the wife is better. Islam allows the housewives to work both in his own home or outdoors, to obtain additional funds to improve the welfare of the household.
This study discusses the resolution of disputes through adat and family security in Acehnese society according to Islamic law. The problems examined are the pattern of resolving family conflicts through adat mechanisms in Aceh; The relationship between resolving conflicts through adat and family resilience in Aceh and a review of Islamic law towards resolving family conflicts through adat in Aceh. This study uses a qualitative approach, which is to explain, describe, and analyze in-depth the results of research. Data collection techniques used were literature study and interviews with informants. While the data were analyzed using Islamic legal theory and traditional law. This research concludes that there are several patterns for example involving various parties such as Jurong, Keuchik, Tuha Peut, Teungku Imum, Imum Mukim, and the place of dispute resolution at meunasah sometimes at Keuchik's house. There is a close relationship between resolving disputes through adat and family resilience, meaning that many family problems that are resolved through adat mechanisms do not go through formal legal avenues. Then the dispute resolution is in line with Islamic law which is included in the urf category with a review of the benefits.
This study discusses the increase in divorce rates in Indonesia, especially in Aceh and South Sulawesi. This study investigates factors affecting the increase of divorce rates and the role of the government in decreasing the divorce rates. This research is an empirical legal study that used structural functionalism theory and role theory. Data was collected through questionnaires, interviews, and document studies. This study concludes that the factors that influence the increase in divorce rates in Indonesia, especially in Aceh and South Sulawesi, are economy, education, the lack of religious understanding, social media, early marriage, and the lack of empathy on the rights and obligations of husband/wife. As a result, the high divorce rate in Indonesia negatively affects children, families and the nation. The government's efforts to address this reality are by holding out pre-marital courses, preaching marriage sermons to strengthen family and prevent a divorce, holding happy family contests, and designing a marriage guidance module for brides and grooms. These efforts, in the sociology of law context, are the government's function and role in anticipating the increasing divorce rates so the social system stability can be maintained. Abstrak:Penelitian ini membahas upaya pemerintah dalam menurunkan angka perceraian di Indonesia khususnya di Aceh dan Sulawesi Selatan. Studi ini mengkaji faktor-faktor yang mempengaruhi tingginya perceraian dan dampak yang disebabkannya. Sumber data dalam penelitian hukum empiris ini adalah kuisioner, wawancara, dan studi dokumen. Data-data tersebut kemudian diolah menggunakan teori fungsionalisme struktural dan teori peran. Temuan dalam penelitian menjelaskan bahwa penyebab meningkatkan perceraian di Aceh dan Sulawesi Selatan adalah ekonomi, pendidikan, kurangnya pemahaman agama, media sosial, pernikahan dini, dan kurangnya empati terhadap kewajiban suami/istri. Tingginya perceraian ini berdampak negatif kepada anak, keluarga, dan bangsa. Upaya pemerintah untuk mengatasi kenyataan ini adalah dengan mengadakan kursus pranikah, khutbah nikah untuk memperkuat keluarga dan mencegah perceraian, mengadakan kontes keluarga bahagia, dan merancang modul panduan pernikahan untuk calon pengantin. Upaya-upaya tersebut, dalam konteks sosiologi hukum, merupakan fungsi dan peran pemerintah dalam menjaga stabilitas sistem sosial.
Islam teaches equality between men and women, without any differences, except in matters of nature alone. The presence of Islam brings goodness to women who were previously oppressed by the jahiliyah culture which did not recognize their position as perfect human beings like men. This research is important to do to answer the views that have been cornering Islam, that women are being looked down on and positioned as dishonorable, but it is the opposite. This research is normative-qualitative in nature by referring to the data of the arguments of the al-Qur`an and Hadith which are then analyzed from the perspective of Islamic law. This study concludes that Islam recognizes women as social creatures just like men, so they are allowed to carry out various social activities. Women are also obliged to perform worship and obedience to Allah as is required of men. Men and women have the same and equal position with Allah, although there are differences but not biologically, for example, women conceive, give birth and breastfeed. But both of them can work together to build a harmonious household. Islam gives women the right to own property from their business or from other results such as inheritance. Inheritance rights for women are half the rights of men. This does not mean that the position of women is half male from their human status, but because the problem of responsibility given to men is greater than that of women. Men are burdened with the responsibility of protecting and nurturing the family, including women, both as mothers, wives and children. For justice, Islam gives more rights to men for this great responsibility, which is not given to women. So giving inheritance to women is part of the protection of their rights.
