The purpose of the paper is to substantiate the need for the introduction of innovations in the activities of business entities and territorial communities. Analyzing, systematizing and generalizing the scientific work of many researchers, it was discovered that innovation is one of the factors of successful decentralization. As a result of the study, the essence of the concept of innovation is shown, which can be considered as the introduction of something "new and improved" or activity that requires a person or community to do something different than before. Elements of innovation capacity are singled out. The peculiarities of investment activity formation in Ukraine are outlined. The basic principles and functions of management of effective work in the field of innovations are determined. The factors of implementation of innovations in the branches, organizations and territorial communities are presented.
In Ukraine, there is a steady increase in the mortality rate of the population, which is due to the low quality of medical provision. The main advantages and the efficiency factor of the health care system in the Western European countries are analyzed; the key factors regulating medical provision in Ukraine are systematized; the effectiveness of modern health care reform in Ukraine is evaluated; practical recommendations to improve the administrative and legal regulation of the system are developed. The analysis showed that the effectiveness of health care reform in Ukraine is currently about 30%, and the high mortality rate of the population in Ukraine is primarily due to the low quality of medical care and inadequate investment in the industry. The main health problems in Ukraine are failure to comply with legislation on the amount of funding and remuneration in the public health system, high levels of corruption and lack of control over the competence of doctors, inaccessibility of medical products for consumers due to the pharmaceutical market monopolization.
Introduction. Business environment functions according to peculiar laws and rules. That constantly accompanied by commercial risks, setbacks and a variety of conflicts. Failure to resolve and exacerbate conflicts in the business environment threatens to cause unforeseen losses of expected profits, cash or property, bankruptcy, debt growth and more. Therefore, the threat of adverse effects of commercial conflicts, the issue of implementation and development of business mediation is relevant as a rapid method of conflict resolution on terms of mutual agreement of the parties' interests in view of the lengthy terms of court proceedings. The purpose of the article is to scientifically substantiate the approach to systematization and prioritization of factors of business mediation development in the current conditions of economic development of Ukraine as a method of successful non-judicial settlement of commercial conflicts. Results. In September 2019, 326 senior and middle managers of Ukrainian companies have surveyed to identify key factors for the development of mediation in the business environment in Ukraine in order to resolve commercial conflicts. It is established that business representatives need immediate practical implementation of business mediation, but at the same time, there is low awareness of Ukrainian entrepreneurs about the existence of a mediation institute, its principles and the procedure for conducting it. Using the principal component method (factor analysis), the factors component composition of business mediation development in modern conditions of Ukrainian economy development has been determined. The hierarchical structure of factors for the business mediation development as an effective institution for resolving commercial conflicts has been determined by calculating the variance percentage. It is determined that the factors of business mediation development are formed by 32,4% of the potential level by calculating the integral indicator. Conclusions. The following system of key factors of business mediation development in modern conditions has been determined on the empirical research basis: the factor of institutional development; education factor; psychological factor and efficiency factor. The most destructive influence on the business mediation development is played by the retarded factors of institutional development and education. These research results can be used in the state strategy setting of business mediation development in Ukraine. The identified system of factors can serve as a guideline for the introduction of the necessary state measures for the non-judicial settlement development of commercial conflicts in the business environment in Ukraine, and determining the priority of their implementation. In the context of transformation of all spheres of life, the ability of people to effectively communicate and resolve conflicts that arise throughout life is of great importance. The congestion of courts, the length and high cost, inflexibility and regularity of the judicial way of resolving conflicts in civil, family, labor and other areas of law make it necessary to resort to alternative approaches to dispute resolution (ADR). Of particular importance is the ability to use mediation procedures – an informal and flexible dispute resolution process. Mediation is free from the disadvantages of litigation: the European experience shows that the basic principles of mediation are voluntariness, autonomy of the parties, confidentiality of the procedure, the neutrality of the mediator, unlike a judge or lawyer. The actual application of these principles and rules of mediation allows for excellent results in conflict resolution - the practice of EU countries and associated members indicates that between 80% and 100% of cases are resolved through mediation. The article discusses in detail the experience of EU Member States in applying mediation practices: models of keeping a register of mediators (registering is possible by a single state body, more often it is the Ministry of Justice; registers can be maintained by a single non-governmental organization, for example, mediators' associations of a country; which unites mediators and each is responsible for its own register), the requirements for the qualification and professional level of mediators (usually any person without restrictions on the profession can become a mediator; but often the age criterion is used), the regulatory framework for mediation (mainly mediation is governed by the relevant country law, but also the approach without legislative regulation of mediation procedures, for example, in the Netherlands), the cost of mediation procedures (mainly depends on the complexity of the conflict case and the field of the case). The role of mediation in resolving labor disputes is considered: models of application of mediation in companies, issues of organization losses in the event of conflicts and their improper resolution, directions of improvement of the system of conflict management in organizations taking into account the European experience.
The article reveals the role of the process of attracting sources of funding for activities. Depending on the source of financing and the method of attracting them, three main financing mechanisms are identified: counterparty, credit and capital market. The peculiarities and advantages of some ways of attracting financing are identified and analyzed. Also, the mechanism of planning of attraction of financial resources considering a real financial position of the enterprise is formed. It is proved that in conditions of fierce competition the company's growth rate has a key impact on the factors of the company's continued existence in the market. The formation of a base for attracting investment in advance provides a stable and affordable source of funds for further expansion. An algorithm for forming the capital structure considering the current financial and economic condition of the enterprise has been developed. Opportunities for the company's growth are directly related to the availability of financial resources that can be obtained from various sources. The decision to use certain sources influences time and financial costs for obtaining and securing borrowed capital and for the diversification of government entities over the company, which to some extent pursue their own goals. Therefore, when building a financial strategy of the enterprise it is important to rationally and pragmatically approach the definition of ways to use financial resources and combine different sources of business financing. The effectiveness of the entire financial strategy of the enterprise largely depends on how correctly and in detail the choice of capital structure was worked out. Using the company's management of the proposed algorithm for the formation of capital structure optimization stage, as well as in the implementation phase of expansion with external sources funded, will allow the company to better attract and use the attracted financial resources without losing the investment attractiveness for future creditors and investors and not losing trust from other financially interested stakeholders.
