ABSTRAK Kemacetan sebagai akibat parkir liar di Jakarta diatasi oleh Pemerintah Provinsi DKI Jakarta melalui pembentukan kebijakan menguasai garasi bagi pemilik kendaraan bermotor dalam Peraturan Daerah Provinsi DKI Jakarta No. 5 Tahun 2014 tentang Tranportasi. Kebijakan ini mewajibkan pemilik kendaraan yang tidak memiliki garasi sendiri untuk menguasai lahan tertentu sebagai tempat parkir kendaraannya. Keterbatasan lahan parkir di Jakarta mendorong masyarakat setempat dan Dinas Perhubungan Provinsi DKI Jakarta untuk mencari solusi lain atas diterapkannya ketentuan menguasasi garasi dengan mengadakan garasi bersama atau garasi komunal. Keberadaan garasi bersama sudah menyebar di berbagai daerah di Jakarta namun belum ada ketentuan yang mengatur secara resmi keberadaan garasi bersama tersebut sebagai pemenuhan syarat menguasai garasi. Penelitian ini adalah penelitian yuridis sosiologis yang bertujuan menemukan prosedur atau mekanisme paling tepat yang dapat dipergunakan untuk mengkoordinasikan keberadaan garasi bersama terutama dalam kedudukannya sebagai pemenuhan syarat menguasai garasi.Kata kunci: garasi; kebijakan; transportasi; perizinan; parkir. ABSTRACT Congestion as a result of illegal parking in Jakarta was overcome by the DKI Jakarta Provincial Government through the establishment of a garage master policy for motor vehicle owners in the DKI Jakarta Provincial Regulation No. 5 of 2014 concerning Transportation. This policy requires vehicle owners who do not have their own garage to control certain land as a vehicle parking lot. The limited parking space in Jakarta has encouraged local communities and the DKI Jakarta Ministry Of Transportation to look for other solutions to the application of provisions to control garages by holding joint garages or communal garages. The existence of a shared garage has spread in various areas in Jakarta, but there is no provision that officially regulates the existence of the joint garage as fulfillment of the mastery of the garage. This research is a sociological juridical study that aims to find the most appropriate procedure or mechanism that can be used to coordinate the existence of a shared garage, especially in its position as a fulfillment of mastering the garage.Keywords: garage, licensing, transportation, parking, policy.
Law No. 5 of 2014 regulates the legality of Honorary Personnel as non-ASN employees. In essence, there are provisions regarding the appointment of honorary personnel to become civil servants with conditions that must be met. Moreover, the problem continues when the number of Honorary Personnel in Government Agencies increases and disrupts the balance of the arrangement of human resources (HR) of the apparatus in each of these agencies. As a settlement effort, the PANRB Ministry issued the PANRB Ministerial Letter Number B/185/M.SM.02.03/202 which emphasized the provisions of PP. 49 of 2018. This becomes an interesting topic when it is associated with the issue of the rights of Honorary Personnel and the application of the Citizen Lawsuit lawsuit to the Administrative Court. This writing uses a normative research method with a literature study which is then analyzed qualitatively and conclusions are drawn using the inductive method. The conclusion that was found was that the Honorary Personnel had the right to file a lawsuit with the Administrative Court because the object of the disputed letter included the State Administrative Court. However, Citizen Lawsuit is not optimal enough as a scheme for filing a lawsuit and it is better to use ordinary legal practices. The Procedural Law of the State Administrative Court is a pure law which means that there is no obstacle in implementing the State Administrative Decision (KTUN) if the KTUN is sued. However, the Plaintiff can apply to postpone the disputed KTUN as compensation during the examination. The research method of this journal is normative juridical and qualitative descriptive with analytical theory. Since the issuance of the Judicial Administration Law, there have been several developments in delaying the implementation of a decision, especially in its mechanism. There are several factors that become the basis for the judge's consideration in granting a request for a postponement of the implementation of a decision, this is regulated in Article 67 of Law Number 5 of 1986, one of which is the very urgent interest of the Plaintiff. This is because the Plaintiff will suffer huge losses if the decision being sued is issued.

Kepadatan penduduk yang tinggi menyebabkan peningkatan jumlah kendaraan, yang tidak diimbangi dengan pertumbuhan jalan dan lahan parkir sehingga menjadi penyebab kemacetan. Kelurahan Turangga merupakan salah satu daerah di Kecamatan Lengkong, Kota Bandung yang sering mengalami kemacetan karena parkir liar yang dilakukan oleh kendaraan yang tidak parkir pada tempat yang semestinya. Melihat kondisi tersebut, Kelurahan Turangga membutuhkan ketentuan pembatasan kendaraan guna mengatasi kemacetan, yang diwujudkan melalui kewajiban memilki/menguasai garasi seperti yang telah diterapkan oleh Provinsi DKI Jakarta berdaarkan Pasal 140 Peraturan Daerah Provinsi DKI Jakarta tentang Transportasi. Berdasarkan hal tersebut, Peneliti bermaksud mempelajari lebih lanjut terkait kemungkinan diberlakukannya ketentuan kepemilikan dan penguasaan garasi di Kelurahan Turangga sebagai solusi kemacetan di daerah tersebut. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan spesifikasi penelitian bersifat deskriptif analitis. Teknik pengumpulan data yang dilakukan melalui penelaahan terhadap bahan hukum primer, sekunder, dan tersier, serta melakukan penelitian lapangan kemudian dianalisis secara normatif kualitatif untuk mendapatkan hasil penelitian yang dimaksud. ABSTRACT.Bandung is the capital city of West Java which has high population density and congested regional conditions. This densely populated condition influence the fluency of transportation in Bandung. High population density causes an increase in the number of vehicles, which is not matched by the growth of roads and parking areas which are the cause of congestion. Turangga is one of the areas in Lengkong Sub-District, Bandung which often experiences congestion due to illegal parking carried out by vehicles that not parked in proper places. Seeing this condition, Turangga requires provisions on vehicle restriction to overcome congestion, which are realized through the obligation to on a garage as has been implemented by DKI Jakarta based on Article 140 of the Jakarta Regional Regulation No.5 in 2014 concerning Transportation. Based on this, Researched intends to learn more about the possibility of applying garage ownership and possessing a garage in Turangga as a solution to congestion in the area. The research method used is normative juridical approach with descriptive analytical research specification. Data collection techniques were carried out through a review of primary, secondary, and tertiary legal materials, and conducted field research the analyzed qualitatively normative to obtain the research result.
The purpose of this article is to knowing how the absolute competence of the State Administrative Court in Indonesia is and how the competence of the State Administrative Court is if there is a land dispute over land rights certificates. This article was compiled using 2 (two) types of approaches, namely the normative approach and the historical approach where this article is a normative research article. Based on the results of the discussion analysis, the absolute competence of the State Administrative Court is the authority to examine, decide, and resolve state administrative disputes where there are existing restrictions.
