Today the internet has dramatically influenced business behavior by offering the opportunity to sell products of daily necessities directly to customers. In its development, the use of this technology sometimes tends to lead to negative things as well. One of them is the factual case of selling fake stamps on the Tokopedia digital platform. Based on this background, this research will discuss; First, regarding the legal qualifications of selling fake stamps on the Tokopedia digital platform. Second, related to the responsibilities of sellers and platforms regarding the sale of fake stamps on the Tokopedia digital marketplace. Both are based on the ITE Law and the Stamp Duty Law. This study used a normative juridical approach based on a law that is conceptualized as a rule or norm that becomes the benchmark for human behavior. The research specification used is descriptive analysis research specification. The data used is in the form of secondary data by reviewing literature and laws and regulations related to the sale of fake stamps and their correlation with the law of information technology and electronic transactions and stamp duty. By offering fake stamps on marketplace platforms, merchants, and e-commerce providers, namely the marketplace platform, are in effect breaking the law. Through the existing criminal law provisions, the seller/perpetrator must be held accountable for his mistake in accordance with the applicable sanctions. From the platform side, the various obligations that Tokopedia does not carry out in buying and selling activities cause problems, including the circulation of illegal goods on the platform, so that Tokopedia is obliged to be responsible.Keywords: E-Commerce; Platform; Information and communication technology; Stamp Duty.
Amid the development of technology, the use of social media is increasing. Information on social media can be easily obtained including a person's personal data and privacy matters. This certainly triggers the misuse of personal data when interacting between social media users. Even though personal data are part of human rights that should be protected. This study aims to analyze the extent to which the government provides legal protection for personal data against misuse of personal data on social media platforms based on the ITE Law and how legal actions can be taken by victims for misuse of personal data on social media platforms. The author uses the normative juridical research method through the review of invitations to settle upon the matter. Based on the results of the study, the government has not provided maximum legal protection for personal data for the society against the misuse of personal data, especially those that occur on social media platforms. The establishment of a clear and comprehensive law is needed to determine definite steps in the process of using personal data in order to provide legal certainty to protect personal data of society. Legal actions that victims can take for misuse of personal data on social media platforms provided by the law are still limited to carrying out lawsuits and demanding administrative sanctions. Indonesia is an independent state with One Godly Belief based on just civilized humanity. Amid the diversity, and to guarantee togetherness within the framework of state life, the state desperately needs the formulation of common goals or ideals commonly referred to as state philosophy or state ideals, which function as grodslag philosophies and common platform for citizens in the context of state life. This diversity is recognized on the Indonesian emblem of Garuda Pancasila 'Bhinneka Tunggal Ika'. The notion of the importance of regulation regarding the criminal offense of blasphemy is the realization of the first principle in the Pancasila, namely the Belief in the One and Only God. This study analyzed the new Draft of the Criminal Code submitted by the Government to the Indonesian Parliament in mid-2015 to replace the Criminal Code that is inherited from the era of the Dutch Colonial. The new Draft of the Criminal Code contains important changes, namely the existence of reconciliation efforts and revitalization of blasphemy acts. This change becomes interesting to be examined, especially from the urgency of the existence of regulation on blasphemy in the frame of diversity and aspects of penal reform. It also explains that the issue of blasphemy is very sensitive in Indonesian society. Constitutional Court Decree Number 140/PUU-VII/2009 is the foundation of the re-conception and revitalization of blasphemy in Penal Reform.

ABSTRAK Penyidikan perkara tindak pidana lingkungan hidup yang dijadikan dasar hukum dalam penegakan hukum sebagai upaya menjamin kelestarian lingkungan hidup, yang dalam praktek sering ditemukan hasil penyidikan tidak diterima oleh Jaksa Penuntut Umum dan juga ingin mengetahui penerapan asas ultimum remedium yang dijadikan dasar dalam penegakan hukum.bagi perkara tindak pidana lingkungan hidup Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif, yaitu mengkaji Peraturan perundang-undangan dan literatur yang terkait dengan penegakan hukum, dan penelitian ini lebih menitik-beratkan kepada penelitian kepustakaan. Data yang telah diperoleh tersebut dikaji dan di analisis yang diperoleh dari literatur maupun sumber lain, kemudian dianalisis secara kualitatif dengan cara melakukan penggabungan data hasil studi literatur atau kepustakaan dan studi lapangan. Berdasarkan analisis yang dilakukan dapat disimpulkan: (1) Perkara yang tidak diterima oleh Jaksa atas dasar tidak cukup bukti, sehingga terjadi bolak balik berkas perkara bisa dilakukan penghentian penyidikan dengan alasan atau dasar yang dapat dipertanggungjawabkan secara hukum dengan tetap melakukan koordinasi yang baik dan harus bersikap professional. (2) Penerapan asas ultimum remedium ini hanya terbatas dan baru dapat dikenakan apabila sanksi administratif yang telah dijatuhkan tidak dipatuhi atau pelanggaran dilakukan lebih dari satu kali, dan tidak memiliki itikad baik lagi.Kata kunci: asas ultimum remedium; penghentian penyidik. ABSTRACT Investigation of environmental crime cases which are used as the legal basis in law enforcement as an effort to ensure environmental sustainability, which in practice is often found that the results of investigations are not accepted by the Public Prosecutor and also want to know the application of the ultimum remedium principle which is used as the basis for law enforcement. for environmental crime cases. The method used in this research is the normative juridical method, which examines statutory regulations and literature related to law enforcement, and this research focuses more on library research. The data that has been obtained are reviewed and analyzed obtained from literature and other sources, then analyzed qualitatively by combining data from literature or literature studies and field studies. Based on the analysis carried out, it can be concluded: (1) Cases that are not accepted by the Prosecutor on the basis of insufficient evidence, so that case files go back and forth, the investigation can be terminated on grounds or grounds that can be legally accountable while maintaining good coordination and must behave professional. (2) The application of the ultimum remedium principle is only limited and can only be imposed if the administrative sanctions that have been imposed are not complied with or the violation is committed more than once, and there is no longer good faith.Keywords: cessation of investigation; Principle ultimum remedium.
