Amid the development of technology, the use of social media is increasing. Information on social media can be easily obtained including a person's personal data and privacy matters. This certainly triggers the misuse of personal data when interacting between social media users. Even though personal data are part of human rights that should be protected. This study aims to analyze the extent to which the government provides legal protection for personal data against misuse of personal data on social media platforms based on the ITE Law and how legal actions can be taken by victims for misuse of personal data on social media platforms. The author uses the normative juridical research method through the review of invitations to settle upon the matter. Based on the results of the study, the government has not provided maximum legal protection for personal data for the society against the misuse of personal data, especially those that occur on social media platforms. The establishment of a clear and comprehensive law is needed to determine definite steps in the process of using personal data in order to provide legal certainty to protect personal data of society. Legal actions that victims can take for misuse of personal data on social media platforms provided by the law are still limited to carrying out lawsuits and demanding administrative sanctions. With the new advances in the Industrial Revolution 4.0 era, which were initiated by artificial intelligence coupled with genetic engineering and nanotechnology, changes will occur in a very fast period of time and result in an impact on the economic industry and also governance in the presence of new business that was born of innovators to create strategies through digital platforms. In Indonesia, digital innovation is not only in one area, but also in the fields of education, food, health, which is also used as a new law in government that supports the Industrial Revolution 4.0 era. These developments also affected the world industry. The birth of the term Industrial Revolution 4.0 was a continuation of the previous industrial revolution. The Industrial Revolution 4.0 is an amalgamation of an optimized manufacturing industry with the latest internet technology.
Purpose: This study aims to scrutinize existing economic dispute mechanisms between ASEAN and PRC which can promote fairness and effectivity. With examining PRC’s non-compliance to PCA awards in the South China Sea case, this article aims to link between the rule-breaking action of PRC (the territorial dispute) and the preventive action of ASEAN. Methodology: This research uses the juridical empiric method, which analyzes the dispute resolution legal framework between ASEAN and PRC. Main Findings: ASEAN and its legal instruments were not designed to provide a fair and effective dispute resolution mechanism that can prevent both PRC’s non-compliance to international law and ensure fairness in economic disputes. Implications/Applications: Organizational behavior is important for family businesses and due to the difficult environment faced by family businesses in order to be competitive in our country and in global markets; a good option for owners is to invest in organizational behavior as a market strategy. Novelty/Originality of this study: This study shows that the contest of ASEAN-China partnership mentioned proof that ASEAN and PRC are not yet completely separated because of the SCS issue. Based on it, a conviction should not drastically block the economic partnership of the two or destroy the bridges between different legal systems. Thus, the initiative will fundamentally promote peace and stability in the region.
Hak atas merek merupakan hak yang bersifat monopoli, yang hanya dapat digunakan oleh pemilik merek untuk menggunakan mereknya secara penuh tanpa adanya pihak lain tanpa seizinnya untuk menggunakan merek tersebut. Seiring perkembangan teknologi informasi dan komunikasi khususnya dalam penggunaan e-commerce sebagai sarana transaksi mengakibatkan hak atas merek yang bersifat monopoli dilanggar haknya. Merek terkenal yang telah memiliki citranya masing-masing seringkali mengadakan kolaborasi dengan merek terkenal lainnya untuk menghasilkan produk yang bersifat edisi terbatas, membuat produk tersebut tinggi peminat. Sayangnya kondisi ini dimanfaatkan oleh pihak lain untuk menjual produk kolaborasi antar merek terkenal serupa pada e-commerce dengan cara melanggar hak yang dimiliki oleh kedua merek terkenal. Dalam penulisan ini akan akan dikaji mengenai perbuatan hukum yang dilakukan oleh penjual produk co-branding dengan mengatasnamakan kedua merek terkenal. Selain itu dalam penulisan ini akan dikaji juga mengenai tindakan hukum apa yang dapat dilakukan oleh kedua merek terkenal, sebagai pihak yang dilanggar haknya. Terhadap permasalahan yang diangkat serta jawaban atas rumusan permasalahan yang diangkat ditujukan untuk menentukan kualifikasi perbuatan hukum atas tindakan yang dilakukan oleh pelaku usaha yang menjual produk co-branding tanpa seizin pemegang hak merek serta ditujukan untuk menentukan tindakan hukum apa yang dapat dilakukan oleh kedua merek terkenal atas hak mereknya yang dilanggar. Penelitian ini dapat berguna baik secara teoritis maupun praktis, dalam hal menjawab permasalahan serupa. Dalam menjawab rumusan masalah yang diangkat, akan dikaji dengan metode penelitian yuridis normatif melalui peraturan perundang-undangan yakni Undang-undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dan Undang-undang Nomor 11 Tahun 2008 juncto Undang-undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik. Dari penelitian ini didapati bahwa perbuatan yang dilakukan dengan melanggar hak merek kedua merek terkenal merupakan tindakan passing off serta terhadap merek yang dilanggar haknya memiliki hak untuk melindungi mereknya baik mengajukan gugatan secara perdata, pidana, adminsitrasi maupun dilakukan secara arbitrase dan alternatif penyelesaian sengketa.
