<p>KASN merupakan lembaga pengawas eksternal ASN yang perannya sangat dibutuhkan. Namun melalui RUU ASN, KASN malah berpotensi untuk dibubarkan. Pembubaran ini dianggap sebagai solusi perampingan lembaga dengan alasan bahwa tugas KASN dapat dilakukan oleh Instansi masing-masing. Alih-alih membubarkan KASN, ada lembaga lain yang mengurusi persoalan ASN mengalami <em>overlapping</em> fungsi. Salah satunya adalah tumpang tindih kewenangan mengawasi sistem manajerial ASN antara KemenPAN-RB dengan BKN. Untuk itu, penulis tertarik untuk membahas Bagaimana sistem pengawasan terhadap manajemen ASN dalam kerangka hukum kepegawaiandan Bagaimana formulasi pengaturan lembaga pengawas ASN yang tepat yang seharusnya dimuat dalam RUU ASN. Penelitian adalah penelitian normatif, yakni penelitian yang bertujuan untuk mencari jawaban atas permasalahan hukum dengan menggunakan teori hukum normatif yang sifatnya doktrinal. Penulis berkesimpulan bahawa KASN adalah lembaga pengawas eksternal yang tugas, fungsi dan wewenangnya harus diperkuat. Salah satu upaya memperkuat KASN adalah dengan cara menambah cakupan fungsi pengawasan. Adapun target pengawasan ideal yang harusnya diserahkan kepada KASN adalah pengawasan manajerial. Sebelumnya pengawasan manajerial ini dilakukan oleh dua lembaga sekaligus yakni KemenPAN-RB dan BKN. Hal ini tentu melanggar asas efektifitas dan efisiensi. KASN harusnya menangani permaslaahan jika terjadi dugaan kesalahan baik secara etik maupun prosedural terhadap jalannya mekanisme manajerial ASN.</p>
In the system of legal norms in the Republic of Indonesia, Pancasila is a very fundamental norm and is the highest legal norm and then the 1945 Constitution. As one of the basic norms of the Republic of Indonesia, several times there have been debates when a constitution in this case is a Constitution 1945 whether it can experience changes or cannot experience changes. This paper will discuss how the process and what are the fundamental changes experienced by the Indonesian constitution on amendments. The results of the analysis and explanation show that, the 1945 Constitution of the Republic of Indonesia (UUD 1945) in the Historical Process, has gone through four stages of change, namely: the 1945 Constitution. Meanwhile, in the process of constitutional changes after the return to the 1945 Constitution Indonesia has made at least four amendments. If you look at the process of changing the Constitution from its history, several times the political power is used to interpret the constitution. The author concludes that politics cannot be separated from the legal system. Likewise with the law, it cannot be released from the political system. Both of them synergize with each other so as to create a government system that is expected to become good governance and bring benefits to all people. However, the writer views that the law is often used as a political tool to smooth the desires of a handful of people. ABSTRAKDi dalam sistem norma hukum di Negara Republik Indonesia, Pancasila merupakan norma yang sangat fundamental dan merupakan norma hukum tertinggi dan kemudian dibawahnya terdapat UUD 1945. Sebagai salah satu norma dasar Republik Indonesia, beberapa kali sempat terjadi perdebatan ketika suatu konstitusi yang dalam hal ini adalah UUD 1945 apakah dapat mengalami perubahan atau tidak dapat mengalami perbuahan. Tulisan ini akan membahas bagaimana proses dan apa-apa saja perubahan mendasar yang dialami oleh konstitusi Indonesia paca amandemen. Hasil analisis dan penjelasan diketahui bahwa, Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 1945) dalam Proses sejarah, telah melalui 4 tahapan perubahan yakni adalah: Undang-Undang Dasar 1945. Sementara itu, dalam proses perubahan konstitusi pasca kembalinya ke UUD 1945, Indonesia telah melakukan setidaknya empat kali amandemen. Jika melihat pada proses perubahan Konstitusi dari sejarahnya, beberapa kali kekuatan politik dipergunakan untuk mentafsirkan konstitusi. Penulis berkesimpulan bahwa politik tidak mungkin dapat dilepaskan dari sistem hukum. Begitu juga dengan hukum, tidak mungkin dapat dilepaskan dari sistem perpolitikan. Keduanya saling bersinergi satu sama lainnya sehingga menciptakan suatu sitstem pemerintahan yang diharapkan menajadi pemerintahan yang baik dan mendatangkan manfaat
The Constitutional Court has the authority to protect the constitutional rights of citizens and provide interpretations of the constitution, ideally in an election which is a political contestation that is built up by many things in its implementation. The Constitutional Court's function is to keep the Election in line with Election Principles which are regulated by Positive Law. Based on the above assumptions, it is worth discussing whether the process of proving PHPU in the Constitutional Court has been able to guarantee the implementation of an overly judicial election, or simply whether the proof of PHPU is ideal. This activity is about providing understanding to Participants of Evidence and Evidence Tool on Election Result Disputes; Providing understanding to Participants regarding updated matters regarding the Legal Evidence of Election Result Dispute; and especially for Lecturers as a means of Community Service which is part of the Tri Dharma of Higher Education. MK berfungsi untuk menjaga agar Pemilu sejalan dengan Asas Luber dan Jurdil sebagaimana yang diatur Hukum Positif. Berdasar pada anggapan di atas, maka patutlah didiskusikan, apakah proses pembuktian PHPU di MK telah mampu menjamin terlaksanya Pemilu yang Luber Jurdil, atau sederhananya apakah Pembuktian PHPU tersebut telah ideal. The Law Number 23 of 2014 concerning Regional Government clearly states that the Minister of Home Affairs with instruments in the form of a Ministerial decree bears the authority to annul regional regulations which deemed contrary to the provisions of the higher laws, public interests and/or decency. However, the Constitutional Court (MK) through Decision No. 137/PUU-XIII/2015 and MK’s Decision No. 56/PUU-XIII/2016 has restrained the authority of the Minister of Home Affairs to annul the Regional Regulation (perda). This is an interesting discussion, some consider that it actually weakens the role of the central government to control local governments, on the other hand, justifying that authority belongs to the Supreme Court. Interesting problems of this research is what is the actual relations of authority between local and central government? Then what is the ideal model for the annulment of regional regulations so that the central government has a role in exercising control (executive control) of regional regulations before and after regional regulations come to be applied? This research was conducted using a normative juridical method, namely a research method that refers to the norms of legal norms contained in statutory regulations. This research resulted that there is a decentralization and decencentration relationship between the central and local governments. In order to anticipate these problems, the ideal model for cancellation of regional regulations to accommodate the authority of the central government is to separate regional regulation according to the content or material.
