Pertumbuhan ekonomi Indonesia terkontraksi 0,7% karena dipengaruhi oleh pandemi Covid-19, penelitian ini mengkaji potensi dan kontribusi perbankan syariah dalam meningkatkan kondisi perekonomian Indonesia pada masa pandemi. Sektor perbankan merupakan salah satu sektor yang sangat mempengaruhi laju pertumbuhan ekonomi suatu negara dan perbankan syariah berpotensi besar untuk berkembang lebih pesat di Indonesia. Penelitian ini menggunakan metode kualitatif dan pendekatan penelitian Hukum Normatif dengan menggunakan objek penelitian berupa objek data sekunder. Hasil penelitian menunjukkan bahwa perbankan syariah mempunyai peran yang sangat penting dalam mendorong sektor pertumbuhan ekonomi di Indonesia. Secara historis, sistem ekonomi Islam merupakan sistem yang “kuat” dalam menghadapi goncangan ekonomi maupun kesulitan zaman dibandingkan sistem konvensional, kapitalis, atau sosialis. Hal ini dikarenakan Bank Syariah memiliki peran untuk memasyarakatkan praktik bagi hasil dan menghindari praktik riba (bunga). Perbankan syariah merupakan lembaga keuangan yang sehat dan tetap stabil bahkan ketika runtuhnya kurs mata uang. Di sisi lain, dengan disahkannya UUPS maka membuat para investor lebih percaya diri untuk menanamkan modalnya di perbankan syariah sehingga menambah arus investasi di Indonesia. Selain itu, upaya yang akan dilakukan oleh Bank Syariah dalam meningkatkan mutu perekonomian Indonesia adalah dengan mengalokasikan dana dari DPK pada sektor perekonomian dan memberikan dukungan permodalan terhadap sektor UMKM.
Penyebaran COVID-19 menimbulkan masalah di banyak sektor dalam kehidupan sehari-hari banyak orang, di banyak sektor publik. Platform pendidikan dipaksa untuk online, meskipun akses ke internet kurang. Selain itu, permasalahan seperti tuntutan untuk memberikan akses kerja praktek untuk mendongkrak kinerja Tujuan Pembangunan Berkelanjutan membutuhkan banyak penyesuaian. Selain itu, masalah kesehatan juga menghadapi masalah yang sama. Status quo menunjukkan bahwa akses layanan kesehatan belum layak untuk semua orang karena masih banyak kabupaten yang belum memiliki akses. Masalah lain yang muncul adalah kurangnya fasilitas yang disediakan untuk mendukung pelayanan kesehatan. Dengan demikian, tujuan untuk memberikan pelayanan kesehatan tidak akan pernah tercapai karena fasilitas pelayanan kesehatan akan dituntut untuk dapat dimanfaatkan untuk memerangi dan menangani Korban COVID-19. Hal ini memaksa masyarakat untuk melakukan perubahan besar dalam aktivitas kehidupan sehari-hari, seperti menerapkan social distancing, memakai masker, dan menerapkan protokol keselamatan yang diberikan.
The emergence of conventional financial institutions before sharia financial institutions affects the development of the two financial institutions to be different. Another factor is the public's cynicism or skepticism towards Islamic financial institutions which assume that the two financial institutions are the same. Thus, the purpose of this study was to analyze the implementation of sharia compliance policies as an effort to improve the development of Islamic financial institutions and consumer protection in Indonesia. This research focused on the Micro Waqf Bank as a Micro Financial Institution that applies sharia principles using statutory and conceptual approaches. In Indonesia, the sharia compliance policy of the Micro Waqf Bank has been regulated in the laws and regulations related to Micro Financial Institutions. The implementation of sharia unity is an effort to reduce cynicism in Islamic financial institutions and to provide protection to consumers' special rights in the form of spiritual rights that every Muslim has to carry out his religion perfectly (kaffah). Sharia compliance policy is the result of the transformation of the DSN-MUI Fatwa into the form of legislation to make it more binding and applicable in the business activities of Micro Waqf Bank.
With the development of the times, fintech companies in Indonesia are increasingly popular and are also increasingly sought after by many people. One of the developments in fintech is the emergence of Sharia fintech. This study aims to analyze fintech crimes that occur from the perspective of jinayah law and to analyze relevant dispute resolution for fintech crimes from the perspective of jinayah law. In this study, the author uses a normative legal research method that uses qualitative analysis, namely by explaining the existing data with words or statements not with numbers. Sharia fintech has a difference with conventional fintech, namely sharia fintech is carried out in the contract process between business owners and investors. The emergence of sharia fintech provides convenience for the community to carry out a credit process using sharia principles and principles. But there is also a negative side, namely sharia fintech crimes such as fraud, fraud. Based on the results of the study, it shows that this sharia fintech crime when viewed from the perspective of jinayah law is included in the ta'zir crime, which if there is a violation the law enforcement is in accordance with the existing legislation in the fairest manner and carried out indiscriminately and discipline that actually carries out sanki ta'zir for sharia fintech crimes, which in essence contain benefits for human life both in the world and in the hereafter.
