<p><em>Abstract</em><em><br /> The intention of this article is explore how Islamic teaching regards human rights. The main finding of this basic research is that in today's modern world, the universal values of human rights function as a glue binding society together. Although in pluralist modern society it become very difficult to impose one standard paradigm or worldview. In regard to Islam and human rights important is to take cognizance of the huquuqul ibad category. This enables us to differentiate between, firstly, the existence of human rights within a country and directly applicable and, secondly, human rights whose existence cannot be directly implemented by a country. Another finding is that there Islamic teaching does not contradict the universal value of human rights. There is a common ground (common values/kalimatun Sawa) between Shariah and human rights in which both demands the development of human virtues (rahmatal lil'alamin/ nurturing the whole universe)</em></p><p align="left"> </p><p align="right"><em>Keywords</em><em>: </em></p><p align="right"><em>Concepts</em><em>, </em><em>human rights</em><em>, </em><em>Islam</em><em></em></p>
Indonesia has been dealing with refugees since 1950s, despite the fact that the country has never been a party to the 1951 Refugees Convention and its 1967 Protocol. As of May 2017, according to UNHCR (United Nations High Commissioner for Refugees), Indonesia has been hosting 14,500 refugees from more than 57 countries. In handling of refugees, Indonesia puts forward the value of human rights that in line with its nation's ideology (Pancasila) and its constitutions (UUD 1945), and Regulation Number 39 Year 1999 pertaining to human rights. At the end of 2016, president of Indonesia releases new regulation pertaining this matter to show its willingness and strong commitment to help these refugees. Therefore, this new regulation is expected to balance out the challenge as well as the threat that might harm the nation with the arrival of these foreigners and the implementation of existing regulations on human rights. Thus, this research examines about the ius constitutum and ius constituendum pertaining to the handling of refugees in Indonesia. This research is legal research, using statute approach and descriptive legal research. Ultimately, the results of this research are expected to give more insights on the handling of refugees in a non-state party to the other state parties to the 1951 convention relating to the status of refugee.
abstrak Pengelolaan wilayah wilayah di Indonesia yang berbatasan langsung dengan Negaralain menjadi hal yang harus diperhatikan secara serius oleh pemerintah. GrandDesign pengelolaan wilayah perbatasan tersebut sangat terkait erat dengan upayapercepatan pembangunan ekonomi, sosial, budaya, pertahanan dan keamanan yangdi arahkan kepada peningkatan kesejahteraan masyarakat di wilayah perbatasan.Kompleksitas permasalahan di wilayah perbatasan dan memerlukan penyelesaiandengan cara komperhensif adalah Aspek Batas Wilayah Negara, Aspek Ekonomi,Aspek Sosial-budaya, Aspek Pertahanan dan Keamanan, Aspek Sumberdaya Alam danLingkungan, Aspek Kelembagaan dan Capacity Building. Tujuan utama pengelolaanperbatasan, yakni; (1) Menjaga integrasi NKRI sebagai amanat konstitusi, (2)Membangun kawasan perbatasan secara berimbang, terpadu, dan komprehensifuntuk kesejahteraan rakyat; (3) Mengukuhkan kapasitas Indonesia di wilayahperbatasan dalam konteks persaingan global. Grand Design Pembangunan kawasanperbatasan dalam implementasi selama ini belum dilakukan secara terpadu denganmengintegrasikan seluruh sektor, sehingga tujuan diatas belum tercapai secarakeseluruhan. The Grand Design for managing the border area isclosely related to efforts for accelerating economic, social, cultural, defense, and securitydevelopment to improve the border region welfare. The problems' complexity requiresa complete solution that includes the State Boundary Aspects, Economic Aspects, Sociocultural Aspects, Defense and Security Aspects, Natural Resources, and Environmental Aspects, Institutional Aspects, and Capacity Building. The main objectives of border management, namely: (1) Maintaining the integration of the Republic of Indonesia as a constitutional mandate; (2) Building a balanced, integrated and comprehensive border area for the people's welfare; (3) Strengthening Indonesia's capacity in border areas in the context of global competition. Grand Design Development of the border region in the implementation has not carried out by integrating all sectors, so the objectives have not yet achieved. This paper discusses the extent to which indigenous people's (adat communities) rights has been accepted as part of the human right regime. The point is that even though the AbstrakArtikel ini membahas seberapa jauh hak masyarakat hukum adat dapat dipandang sebagai rezim hak asasi manusia. Titik tolaknya adalah fakta sekalipun ada jaminan konstitusi (Pasal 28 B (2) dan Pasal 28 I (3) UUD 1945), hingga saat ini belum ada aturan perundang-undangan yang secara khusus mengatur hak-hak masyarakat hukum adat. Melalui penelusuran hukum ditemukan bahwa pengaturan tentang ini justru tersebar dalam banyak peraturan perundang-undangan terpisah. This study aims to strengthen juridical arguments in the context of the need for Environmental Spatial Planning, especially in Law 11/2020. The results conclude that the Environmental Spatial Planning in the Perspective of Law No. 11/2020 should be capable of ensuring future generations experience welfare and environmental preservation, exceptionally safe, comfortable, productive, and sustainable spaces as guaranteed by Article 33 Paragraph (4). The aspects and paradigms of the national development should be based on Constitutional Principles, one of which is the environmental principle. However, the development strategy at the domestic level does not require regulations when the purpose of Article 33 (4) of the UUD 1945 is violated. The Job Creation Law implementation should be oriented towards the welfare and preservation of the community’s environment. Furthermore, spatial planning should not ignore environmental concepts to accelerate public interest appropriate with the objectives of the Constitution of Indonesia.
