Trafficking especially women and children in West Kalimantan, is still vulnerable in various modes, including through order bride. Factors that influence the trafficking include poverty, lack of education, limited employment, patriarchal culture, and weak law enforcement as well as mechanisms and coordination of handling trafficking. This article will explore the issue of trafficking with the mail order bride mode by revealing the problem of what factors are obstacles in law enforcement handling the crime of trafficking in persons with the order bride mode. Through the socio-legal research method with a qualitative approach, the research results are obtained that the obstacles faced in handling criminal acts of trafficking with the mail order bride mode are still weak cooperation and coordination between relevant agencies and law enforcement officials, especially these crimes occur in transnational networks.
Penelitian ini akan mengkaji bagaimana suatu Peraturan Daerah dapat mengakomodir upaya peningkatan kesadaran hukum masyarakat dalam pengelolaan sampah, dimana fokus kajiannya dilakukan di Kota Singkawang melalui terbentuknya Peraturan Daerah Kota Singkawang Nomor 2 Tahun 2014 tentang Pengelolaan Sampah. Melalui pendekatan yuridis normatif dan yuridis empiris, diperoleh fakta bahwa masyarakat belum berperan secara optimal dalam pengelolaan sampah. Agar pengelolaan sampah dapat berjalan secara optimal sesuai amanah Perda Kota Singkawang Nomor 2 Tahun 2014 dimaksud, maka diperlukan upaya membangun kesadaran hukum masyarakat baik yang dilakukan secara individu maupun secara berkelompok dengan peningkatan kegiatan penyuluhan yang dapat dilakukan dalam berbagai bentuk, baik secara lisan, secara tertulis maupun melalui alat peraga, serta juga perlu dikembangkan kegiatan bimbingan teknis kepada masyarakat dalam pengelolaan sampah. Lebih lanjut dibutuhkan juga peningkatan fasilitas daya dukung dan daya tampung Tempat Pembuangan Akhir sampah serta penyiapan sarana dan prasarana industri pengolahan daur ulang sampah oleh Pemerintah Daerah.
In Indonesia Mining Law, if mining activities occur without a permit, the act is a criminal offense regulated by Law Number 4 in 2009 concerning Mineral and Coal Mining. However, in empirical practice, there is a settlement of the case of unlicensed gold mining using legal instruments in the form of traditional sanctions like in Kualan Hulu Village, Simpakng Hulu Subdistrict, Ketapang Regency. This study is normative because it uses secondary data. Normative legal research is legal research involving the law as a system of building norms. The Norm system is about the principles, norms, rules of legislation, court decisions, agreements, and doctrines. Secondary data used in this study include legislation relating to unlicensed gold mining, documents, and writings relating to the cases studied. The result of the study revealed that although Indonesia has Law Number 4 in 2009 concerning Mineral and Coal Mining in the act of unauthorized Gold Mining activities (PETI), the application of customary law in providing sanctions against PETI perpetrators is still evident. One of the cases is in Kualan Hulu Village, Simpakng Hulu Subdistrict, KetapangRegency, where customary sanction by the local community is applied to "torun-tackers" against PETI perpetrators and considered effective to create a sense justice. Thus, the values contained in customary law can actually be adopted in the formation of mining law to develop a sense of justice as a legal objective.
<p><em>West Kalimantan Province, as one of provinces in Indonesia which has specific geographical condition is bordering with East Malaysia through official Cross-Border Post between Entikong and Tebedu, Badau and Lubuk Antu, Aruk and Biawak, and no less than fifty path ways (not official) can be passed to get in and get out to and from East Malaysia region. This geographical encouraged trafficking improvement to abroad with various modes. In fact, trafficking was affected by many factors, including stigma, poverty, lack of education, family resilience, and other factors, where women and children are the victim. The aim of this research to reveal how is the legal protection for the victim. Although there were many studies had been done about it, but the focus of this research is the obstacles face to give legal protection for the victims of trafficking in West Kalimantan border, where the top of the problem is victims role, sometimes they don’t realize that they are the victims, so legal protection effort as stipulated in Trafficking Rules was not optimal. Through socio-legal research found an interesting thing, the lack of victim realized they were victims who have to get legal protection, so complicated a legal assistant for legal effort. Beside of that, trafficking as transnational crime and organized, it is complicated for legal enforcement, because of trafficking perpetrators are in the state border cross.</em><em> </em><em>The abstract contains: research objectives, implementation methods, analysis techniques and activity results.
