During the validity of Law No. 37 of 2004 (2004-2013), out of 5 bankruptcy cases, all decisions stating that the Commercial Court is authorized to settle bankruptcy cases based on Article 303 of Law No. 37 of 2004 concerning Bankruptcy. Although the substance of Article 303 is contrary to the legal principle of the contract "Pacta sunt servanda". Article 303 raises deviations in the principle of systematization law, which will weaken law enforcement in Indonesia, and can even cause the loss of legal principles as a rule of law at the basic level of norms.
Penelitian ini bertujuan untuk mengetahui sikap orang tua di daerah Kuta terhadap bahasa Bali, Indonesia, dan Inggris serta strategi yang mereka gunakan dalam mengembangkan kemampuan anak-anak mereka di ketiga bahasa tersebut. Informan dalam penelitian ini adalah dua belas orang tua. Metode pengumpulan data yang dilakukan adalah wawancara dan hasil rekaman tersebut ditranskripsi sebelum akhirnya diteliti. Data kemudian dianalisis menggunakan teori family language policy dan language strategies. Berdasarkan data yang diperoleh ditemukan bahwa para informan memiliki sikap yang sangat positif terhadap bahasa Bali, Indonesia, dan Inggris. Positifnya sikap mereka juga sejalan dengan strategi yang mereka lakukan, di mana mereka menginginkan anak mereka tumbuh sebagai anak yang memiliki kemampuan multibahasa yang baik. Dari ketiga bahasa tersebut, bahasa Inggris adalah bahasa dengan strategi paling beragam.
The purpose of this study is to evaluate the Critical Success Factors for the implementation of e-KOlab using the HOT-Fit approach so that indicators can be obtained that have a significant effect on the net benefits of the application for SMEs in Bali under the guidance of IWAPI Bali. The research sample is MSME actors under the guidance of IWAPI Bali who uses the e-Kolab application. MSMEs are spread across 9 regencies/cities, namely: Buleleng, Klungkung, Tabanan, Karangasem, Denpasar, Bangli, Badung, Jembrana, and Gianyar. Therefore, the sampling used the Saturated Sampling method so that there were 145 people who had indeed participated in the e-Kolab application testing and its utilization. The data analysis technique used in this study is SEM with the Variance or Component-Based (VB-SEM) approach with the PLS technique. The results of the Critical Success Factor evaluation through the HOT-FIT Method on the Implementation of e-KOlab as a strategy for SMEs to Scale Up indicate that there is a need for improvement in System quality, system use, the role of the Office, and the role of the Service. That is, 4 of the 13 hypotheses in this study were rejected.
Nowadays, it is important to examine the impetus for changes of traditional rules in facing contemporary developments and in this regard, this study took a private subject of rules on inter-caste marriage in the Balinese Hindu community. In this context, this study aims to investigate how the inter-caste marriage system is run as an effort to bridge traditional values and modern values based on legal equality and citizenship by taking Balinese society. This research is empirical research with a historical approach with the object of the research is inter-caste marriages. The results showed that the development of inter-caste marriage rules in the monarchy period was derived from Hindu law. The rules on inter-caste marriage during the colonial period can be found in the Peswara and after the independence, the inter-caste marriage is regulated in the Decree of House of Representative of Bali Province, Bhisama Sabha Pandita, and the Decree of MDP Bali. The Hindu community still maintains the sanctions against inter-caste marriage because of their adherence to the customary law of the traditional village.
The child needs to be protected both physically and spiritually, especially when the child is a criminal. Children to be accountable for their actions, not separated from the imposition of criminal punishment of imprisonment. The imposition of imprisonment on children is irrelevant compared to the crime rate, and it seems that imprisonment does not deter the perpetrator. It can be attributed to a child's crime similar to that of an adult whether in quantity or quality. This situation certainly raises issues both philosophically, juridically and sociologically. It is deemed necessary to reform the criminal law in the face of children as perpetrators of crime, deprivation of liberty by placing children in prison, unable to provide protection from the deprivation of the rights of children as opposed to the values of Pancasila as stipulated in the second precept " humanitarian "so it is necessary to replace it with alternative criminal (alternative sanction) one of them in the form of criminal supervision as regulated in Article 71 of Law No.11 Year 2012 About Child Criminal Justice System. Characteristics of the imposition of criminal surveillance of the child, perpetrators are still given the opportunity to improve themselves, and supervision is made in accordance with the personal needs of children who promote human coaching, by upholding the dignity of children based on the principle of "humanity". This is certainly in accordance with the idea or ideals of law and the reality of society that is upholding a democratic, social and humane life, which became the basic color of Indonesian law based on Pancasila.
