Lawsuits submitted by patients or their families to the hospital and / or their doctors can take the form of criminal or civil lawsuits by almost always basing on the theory of negligence. This paper seeks to explore the application of the values of restorative justice in resolving cases of medical malpractice in Indonesia. This research is a qualitative research using normative legal research and uses a statute approach and a conceptual approach. The results showed that settlement of medical malpractice cases through a restorative justice approach or which is known in the culture of the Indonesian people as a consensus agreement as contained in the 4th Precepts of Pancasila is one alternative settlement that is to restore conflict to the parties most affected (victims, perpetrators and interests community) and give priority to the interests of all parties. The conclusion showed that the restorative justice emphasizes human rights and the need to recognize the impact of social injustice and in simple ways to restore the parties to their original condition rather than simply giving formal justice actors or legal actors and victims not getting any justice. Hence, restorative justice also strives to restore the security of victims, personal respect, dignity and more importantly is a sense of control so as to avoid feelings of revenge both individual or family or group.
Menjalankan tugasnya seorang Notaris bisa terkena permasalahan hukum yang mengharuskannya diperiksa oleh Penyidik, Penuntut Umum, dan Hakim. Namun, pemeriksaan terhadap Notaris tidak bisa dilakukan serta merta melainkan wajib memerlukan persetujuan dari Majelis Kehormatan Notaris, hal tersebut tercantum dalam Pasal 66 Undang-Undang Jabatan Notaris. Dalam wajib untuk mendapat persetujuan dari Majelis Kehormatan Notaris, ada keadaan di mana Notaris melakukan pemerikssaan tanpa adanya persetujuan dari Majelis Kehormatan Notaris. Keadaan demikian membuat terlewatnya prosedur wajib yang harus dilakukan penyidik dalam memeriksa Notaris, sehingga terhadap Notaris tersebut dapatkah untuk dikenakan sanksi dari Majelis Kehormatan Notaris. Pada keadaan telah diperiksanya notaris oleh penyidik tanpa persetujuan dari Majelis Kehormatan Notaris, maka menjadi persoalan terhadap Berita Acara Pemeriksaan yang dibuat oleh penyidik. Sebagaimana diketahui notabenya Berita Acara Pemeriksaan dapat menjadi alat buki yang sah, apabila satu prosedur yang diwajibkan Undang-Undang terlewat seperti apa akibat hukum yang timbul atas keadaan tersebut
The physician's legal responsibility in administrative malpractice is in violation of administrative provisions in the practice of medicine. Violation of administrative law in medical practice is basically a violation of the administrative legal obligations of medical practice. Administration obligations in medical practice may be administrative obligations related to authority before the doctor performs medical services and administrative obligations at the time the doctor is performing medical services. Based on the two forms of administrative obligations mentioned above, there are two forms of administrative violation, namely the violation of administrative law concerning the authority of medical practice and the administrative violation of medical services. With respect to such administrative offenses, sanctions may be granted in the form of a written warning, recommendation of revocation of registration certificate or license of practice; and / or obligations to attend education or training in medical education institutions.
Forest and land fires can have a tremendous impact, especially if the fires involve peatland fires. The purpose of this study is to find out and analyze law enforcement against peatland burning perpetrators in Banjar Regency, and the obstacles to Law Enforcement against peatland burning perpetrators in Banjar Regency. This type of research is an empirical/field legal research with data sources in the form of primary data and secondary data with research locations at the Banjar District Police and the South Kalimantan Provincial Forestry Service.The results showed that law enforcement against peatland burning perpetrators in Banjar Regency from 2019-2021 carried out by the Banjar Police Crime Unit and the Forestry Police of the South Kalimantan Province Forestry Service who entered the investigation stage amounted to 1 case, the causal factors (1) increased public awareness by not clearing land using the burning method, (2) due to natural factors that in 2020 and 2021 the dry season in South Kalimantan Province will not be prolonged, and (3) increasing socialization of forest and land fire prevention carried out by the authorities including the police. The obstacles in law enforcement against the perpetrators of burning peatlands in Banjar Regency are that there are no cases that have entered the investigation stage due to the absence of suspects and also the absence of witnesses who heard and saw the criminal act of burning peatlands. Tujuan dilakukannya penelitian ini adalah untuk menganalisa mengenai kriteria prinsip kehati-hatian notaris selaku pejabat umum dalam melaksanakan tugasnya terutama dalam hal pembacaan dan penandatanganan akta serta menganalisa mengenai bentuk pertanggungjawaban bagi notaris yang dalam pembuatan aktanya tidak memenuhi ketentuan Pasal 16 ayat (1) huruf m Undang-Undang Jabatan Notaris. Dalam hal ini penelitian ini menggunakan jenis penelitian hukum normatif, penelitian ini bersifat preskriprif analitis yaitu penelitian yang bersifat secara alamiah dengan suatu metode yang bertujuan untuk mempelajari satu atau beberapa gejalan dengan jalan menganalisanya dan dengan mengadakan pemeriksaan yang mendalam terhadap fakta tersebut untuk kemudian mengusahakan suatu pemecahan masalah-masalah yang ditimbulkan oleh fakta tersebut. Hasil Penelitian Pertama: Kriteria prinsip kehati-hatian notaris selaku pejabat umum dalam melaksanakan tugasnya dalam pembacaan dan penandatanganan akta ialah pengenalan terhadap identitas penghadap, memverifikasi data subjek dan objek penghadap, memberikan tenggang waktu dalam proses pembuatan akta, bertindak hati-hati, cermat dan teliti notaris wajib memeriksa kata demi kata yang tertuang dalam akta untuk meminimalisir kesalahan dalam penulisan akta, memenuhi syarat formiil dan syarat materiil dari pembuatan akta notaris berdasarkan Undang-Undang Jabatan Notaris, Pembacaan, Penandatanganan dan pembubuhan cap jempol. Apabila notaris melaksanakan prinsip kehati-hatian dengan memenuhi, mentaati peraturan yang ada di dalam undang-undang, maka notaris akan mendapatkan perlindungan, perlindungan hukum diberikan kepada mereka yang mentaati aturan-aturan undang-undang. Kedua: Tanggung jawab notaris yang melakukan perbuatan melawan hukum dalam bidang perdata, sanksinya berupa penggantian biaya, ganti rugi, dan bunga akibat yang akan diterima Notaris atas tuntutan para penghadap jika akta yang bersangkutan hanya mempunyai kekuatan pembuktian sebagai akta di bawah tangan atau akta menjadi batal demi hokum. Tanggung jawab notaris yang melakukan perbuatan melawan hukum dalam bidang administrasi, sanksinya berupa teguran lisan, teguran tertulis, pemberhentian sementara, pemberhentian dengan hormat, sampai pemberhentian dengan tidak hormat. Sedangkan pertanggungjawaban dalam konteks kode etik profesi notaris berupa pemberian sanksi teguran, peringatan, pemecatan sementara (schorsing), pemecatan (onzetting) dan pemberhentian dengan tidak hormat dari keanggotaan perkumpulan. Dan, pertanggungjawaban secara pidana, Undang-Undang Jabatan Notaris tidak mengatur sanksi pidana untuk Notaris yang melanggar Undang-Undang Jabatan Notaris. Jika terjadi hal seperti itu maka terhadap Notaris tunduk kepada tindak pidana umum.
