A widely accepted argument among scholars of Latin American presidential regimes is that interbranch cooperation is impaired when the president's party falls short of a majority of seats in the legislature. This argument fails to consider three factors that affect the performance of minority presidents: the policy position of the president's party, the president's capacity to sustain a veto, and the legislative status of the parties included in the cabinet. This article argues that the greatest potential for conflict in a presidential regime occurs when the president's party lacks the support of both the median and the veto legislator and no cabinet coalition holding a majority of legislative seats is formed. This hypothesis is supported using data on executive‐legislative conflicts and on interrupted presidencies in Latin America during the period 1978–2003.
What is the effect of constitutional decree authority (CDA) on the policy-making process of a presidential regime? Despite recent efforts to answer this question, there is still much uncertainty in the literature about the extent to which decree powers may allow presidents to control the legislative process. This article argues that in a separation-of-powers system, the existence of CDA effectively enhances executives’ ability to act as agenda setters. This capacity, however, is not uniform across all cases. Developing a simple spatial model of decree games, the author argues that the bargaining power of an executive to promote legal changes through decrees varies according to three interrelated factors: decree approval rules, the extent of the executive’s partisan support in the legislature, and the strength of the presidential veto. These propositions are supported by a comparative analysis of the process of constitutional design and the implementation of decrees in Brazil and Argentina, two cases presenting significant variation in each of the independent variables.
Inter‐institutional cooperation between the congress and the presidency may be the best way to promote good governance in a regime of separation of powers. In order to evaluate the performance of different political institutions, especially the different frameworks associated with ‘presidentialism’ and ‘parliamentarism’, we adopt the criterion that policy outcomes coinciding with the median voter's preference can produce the highest satisfaction or social utility. From this perspective, proportional representation in congress can be very appropriate since it tends to establish a close correspondence between the median party's and the median voter's preferences. Likewise, cooperation – rather than conflict or mutual checks – between the median party in congress and the presidency for both legislative decisions and cabinet formation can favour socially efficient outcomes. A survey of some recent institutional reforms in democratic presidential regimes in Latin America shows that ‘parliamentarization’ of presidentialism is gaining acceptance, although intermediate formulae may be more conflictual than a global, more coherent institutional reform.
Since 1978, all countries in Latin America have either replaced or amended their constitutions. What explains the choice between these two substantively different means of constitutional transformation? This article argues that constitutions are replaced when they fail to work as governance structures or when their design prevents competing political interests from accommodating to changing environments. According to this perspective, constitutions are likely to be replaced when constitutional crises are frequent, when political actors lack the capacity to implement changes by means of amendments or judicial interpretation, or when the constitutional regime has a power‐concentrating design. It is further argued that the frequency of amendments depends both on the length and detail of the constitution and on the interaction between the rigidity of the amendment procedure and the fragmentation of the party system. The article provides statistical evidence to support these arguments and discusses the normative implications of the analysis.
