Pandemi Covid-19 telah menyebabkan disrupsi di seluruh penjuru dunia. Keadaan menjadi terbalik secara drastis dan tidak disangka-sangka. Seluruh aspek kehidupan terdampak oleh virus bermahkota ini. Masyarakat dunia, siap atau tidak, dipaksa untuk beradaptasi dengan situasi yang ada. Pendidikan hukum juga harus menyelenggarakan pembelajaran melalui metode daring. Perhatian yang harus diberikan adalah sejauh mana pendidikan social justice bisa dilakukan melalui metode daring terkait penanaman sensitivitas dan kepekaan akan keadilan sosial? Pendekatan yang digunakan dalam penelitian ini adalah yuridis normative yang menelaah norma-norma terkait pendidikan social justice. Pendekatan konseptual (conceptual approach) digunakan untuk memberikan sudut pandang dari analisis penyelesaian permasalahan pendidikan social justice melalui metode daring. Penelitian ini menggunakan spesifikasi deskriptif analitis. Pendidikan hukum, terutama pendidikan social justice pada level sarjana bertujuan untuk menciptakan lulusan-lulusan hukum dengan keahlian-keahlian profesi hukum, oleh karenanya kurikulum sekolah hukum yang tradisional memberikan peluang dan kesempatkan bagi mahasiswa untuk mengembangkan kemampuannya. Dampaknya adalah pembelajaran daring yang dapat menghasilkan litigator-litigator masa depan dengan kualitas yang sama atau lebih baik dibandingkan dengan metode konservatif masih diragukan. penelitian menunjukan bahwa beberapa elemen-elemen pembelajaran luring hilang semasa pembelajaran daring, seperti contohnya keterampilan profesi atau praktis dan empati sosial. ABSTRAKTulisan ini merupakan sebuah analisis terhadap Putusan Nomor 9/PID.SUS-ANAK/2016/PT.BDG, yang mengkaji sudah tepat atau tidak putusan yang dijatuhkan oleh hakim pengadilan tingkat banding tersebut dengan konsep restorative justice. Metode penelitian yang digunakan dalam tulisan ini adalah metode yuridis normatif dengan pendekatan deskriptif analitis yang menggambarkan sekaligus menganalisis pertimbangan-pertimbangan yang diambil oleh hakim dalam menjatuhkan putusan. Pertimbangan yang diambil oleh hakim pengadilan tingkat banding yang menguatkan putusan hakim pada pengadilan tingkat pertama merupakan pertimbangan yang tepat di mana hakim memutus perkara dengan mempertimbangkan prinsip-prinsip restorative justice. Hakim tidak hanya mempertimbangkan upaya pemberian efek jera tetapi juga mempertimbangkan kepentingan terbaik bagi anak yang berkonflik dengan hukum dengan memastikan pemenuhan hak atas pendidikan dan menghindarkan anak dari risiko pengaruh buruk yang dapat berujung pada berulangnya tindak pidana, karena dalam isu anak yang berkonflik dengan hukum, pendidikan bagi semua anak tanpa memandang asal, ras, gender, kecacatan atau kemampuan dan layanan kesehatan serta advokasi harus diperhatikan. Sejumlah anak tidak sempat mengenyam pendidikan yang lengkap karena situasi penjara yang tidak memungkinkan untuk memberikan pendidikan bagi warga binaannya.Kata kunci: pidana anak, pembinaan, restorative justice. ABSTRACT This is an analysis of Court Decision Number 9/PID. SUS-ANAK/2016/PT.BDG, which examines whether the decision imposed by the appellate court judge using the restorative justice concept is appropriate. Research in the analysis use normative juridical method with analytical descriptive approach, which describes and analyzes considerations taken by judges in making decision. The consideration taken by the appellate court judge reinforcing the decision of the first-level court judges is the right consideration since the judge decides the case by taking heed to the principles of restorative justice. The judge does not only weigh on the effort to provide a deterrent effect, but also the best interests of children in conflict with the law by ensuring the fulfillment of the children’s educational rights and prevent them from the risk of bad influences that may lead to the recurrence of crime. Because in the issue of children in conflict with the law, education for all children regardless of origin, race, gender, disability or ability and health services and advocacy should be taken into account. The children are not able to get an adequate education because of the incapacity of prison conditions to provide education to their inmates. The increasingly swift flow of information enables the public to take and absorb all kinds of news through printed media, social media, television, radio, and all other forms of equipment. This is the culture in which people live today. Not infrequently some members or community groups in Indonesia today are often involved in fraud and defamation cases, both as perpetrators and victims. Rapidly developing technology gives people the power to spread information so rapidly and massively. However, it must be realized, the power implies responsibility, and all forms of information delivery should be done with full responsibility. The large number of people who become victims of crime is caused by the lack of a critical attitude in absorbing, digesting and analyzing the information received. This article is the result of research that seeks to question how scientific attitude ethics can be developed by legal education and how to shape legal education with scientific ethics that are able to prevent victims of crime. Philosophical approaches, conceptual approaches are used here, with technical analysis techniques namely qualitative analysis in the form of deconstruction (philosophical) analysis, system-normative analysis, heuristic analysis (including description of the context of justification of science, criticism of the science paradigm, discovery of new paths, development towards creativity and socio legal analysis, multi-disciplinary analysis.
The use of virtual reality in education and the professional field in the past two years. The so-called 360-degree virtual technology enables us to simulate space and conditions that are either rare or unexplorable in the real physical world. This research aims to know the limitations in current-day virtual learning is the main challenge for legal education. Students hope to develop their hard and soft skills, such as communication and how they react in real-life situations, and to know virtual reality can answer this challenge. The method of the study is descriptive-analytical. First, the researcher describes the current 'version' of virtual legal education, its challenge and adaptation so far, and the current use of virtual reality technology in simulations. Later, the researcher tries to analyze the problem by synthesizing the limits of virtual legal education and the possibility of the utilization of VR technology in it. The result shows that Developing new technology may present challenges. However, as an effort to provide social environment character in legal education, 360 virtual reality has many potentials. The pilot study was limited, but it helped us to understand how the simulation needed to be improved for future studies. However, our initial application still provides one-way information, in which the subject cannot interact with people in the environment and interaction between subjects in the same setting is still in process.
It is important to build the characters of social justice inherently among the students to sensitize them about the injustice suffered by the communities as one of the processes of legal education in preparation to produce good and strong law graduates. Therefore, the problem of this research is on what values of social justice characters that should be taught in law schools in order to shape their graduates' characters and what process or method considered effective to construct the character of social justice to be internalized in the graduates of law. The methods used in this research was conceptual approach. The research was supported with empirical approach. The specification of the research is descriptive analytical. Empirical data were obtained to understand how the clinical legal education methodology can generate social justice traits instilled with local wisdom values. Interviewing law students taking part in clinical legal education was the method used to obtain data. Some characters highlight the outcome of the social justice education through the exposure of handling and empowering the communities such as empathy, pro-social behavior, and altruism. Local wisdom also plays a vital role in the construction of the character because students or law graduates who incorporate values of virtue passed on generations can be more adaptable with the situation of the community when trying to resolve conflict or social injustice.
