Pengabdian ini memfokuskan pada upaya pencegahan gerakan radikalisme melalui penanaman ideologi Pancasila dan budaya sadar konstitusi berbasis komunitas. Komunitas yang dipilih adalah Pimpinan Ranting Muhammadiyah Bangunjiwo Barat, Banguntapan IV dan Sidokarto. Persoalan komunitas masyarakat saat ini adalah adanya gerakan-gerakan radikalisme yang memiliki agenda terselubung yang menggerogoti nilai-nilai Pancasila - memecah belah bangsa Indonesia, melemahkan persatuan dan kesatuan – merusak kebhinekaan yang sejak Indonesia berdiri telah menjadi konsensus bersama. Kegiatan ini dilakukan dalam bentuk pengabdian berupa: (1) Pelatihan Pencegahan Radikalisme melalui Penanaman Ideologi Pancasila dan Budaya Sadar Konstitusi yang dilakukan di 3 tempat, yakni: di Pimpinan Ranting Muhammadiyah Bangunjiwo Barat, Banguntapan IV dan Sidokarto. Pelatihan ini memfokuskan pada penguatan pemahaman Pancasila dan budaya sadar konstitusi serta strategi pencegahan radikalisme di Indonesia; (2) ToT Pencegahan Radikalisme melalui Penanaman Ideologi Pancasila dan Budaya Sadar Konstitusi. Training of Trainer ini merupakan lanjutan dari pelatihan pada PRM yang dilakukan sebelumnya. Adapaun materi dalam ToT ini meliputi: Pemahaman Ideologi Bernegara Menurut Muhammadiyah dan Sikap Bernegara Muhammadiyah; Pencegahan Radikalisme melalui Kewajiban Bela Negara dalam kehidupan beragama; Advokasi Kebijakan dan Hukum terkait Gerakan Radikalisme. ToT ini dilakukan agar peserta memiliki kemampuan untuk menjadi pelatih yang memiliki pemahaman dan sikap bahwa radikalisme/ terorisme harus dicegah sedemikian rupa dengan berbagai kegiatan pencegahan. Kegiatan pencegahan tersebut merupakan bentuk bela negara warga negara yang baik demi menjaga kelangsungan hidup bangsa dan negara yang seutuhnya dengan melakukan pencegahan gerakan radikalisme di masing-masing komunitas.Kata kunci: Pancasila, budaya sadar konstitusi, radikalisme, terorisme, pencegahan.AbstractThe community service program aims to prevent radicalism movement through inculculating state ideology, Pancasila and building awareness on understanding more about Constitution among the community. In this program, Muhammadiyah branches at some villages in Yogyakarta are selected to be the pilot project. They are Muhammadiyah branch of Sidokarto, Banguntapan IV and Bangunjiwo Barat. These area are considered as some villages that are susceptible for penetrating radicalist movement ideology which threaten the state ideology, Pancasila as the result of national political consensus of Indonesia since 1945. The program is divided into two activities, 1) training for understanding Pancasila and preventing radicalism. The program focuses on how to improve the level of understading of Muhammadiyah actisvits on the phenomena of radicalist movement in the society. The participants are also guided by the understanding Pancasila as the state ideology. 2) Training of Trainers for understanding Pancasila and the 1945 Constitution. This program is more focused on developing the understanding of participants on Pancasila and the 1945 Constitution. The participants are also equipped with basic skill on how to advocate the rights of people in combating radicalism. It is expected that the program educates the Muhammadiyah activists to be the agent of combating radicalism as well as protecting the society.
Putusan Mahkamah Konstitusi No. 46/PUU-XIV/2016 yang menolak perluasan makna zina yang ada dalam Kitab Undang-Undang Hukum Pidana menjadi topik yang ramai diperdebatkan. Sebagian masyarakat berpendapat bahwa seharusnya Mahkamah Konstitusi berani melakukan terobosan hukum dalam isu yang sangat penting tersebut. Namun, Hakim Mahkamah Konstitusi berpendapat perluasan makna zina tersebut bukan ranah kewenangan mereka. Penelitian ini bertujuan untuk mengkaji lebih jauh argumentasi hukum (ratio decidendi) putusan Mahkamah Konstitusi yang bersifat open legal policy dan bagaimana implikasinya terhadap pembentukan peraturan perundang-undangan di Indonesia. Penelitian ini merupakan penelitian kepustakaan dengan pendekatan undang-undang dan studi kasus terhadap beberapa putusan Mahkamah Konstitusi yang mengandung argumentasi open legal policy. Secara konseptual penelitian ini juga akan membahas bagaimana implikasi putusan Mahkamah Konstitusi yang mengandung open legal policy tersebut terhadap sisetm legislasi nasional. Hasil penelitian menunjukkan bahwa pertama, konsepsi open legal policy dalam putusan Mahkamah Konstitusi belum memiliki batasan yang jelas sehingga pengertian positive legislator dan negative legislator sering dikacaukan dalam praktik pembentukan dan pengujian undang-undang. Kedua, putusan yang bersifat open legal policy tersebut juga menunjukkan bahwa di antara hakim Mahkamah Konstitusi telah terjadi tarik menarik penggunaan paradigma judicial activism dan judicial restraints sehingga menimbulkan ketidakpastian hukum di tengah masyarakat. Penelitian ini merekemomendasikan perlunya kajian yang lebih mendalam tentang disain open legal policy dalam putusan Mahkamah Konsitusi dan sistem legislasi nasional Indonesia.
Within the same group as the USA and India Indonesia is one of the largest democracies in the world. After experiencing authoritarian rule for a few decades since its independence the country nally at the beginning of the twenty rst century managed to chart along its new direction along democratic course and values. More than a decade has passed since the democratic transition begun yet the country still faces various constitutional dilemmas and enigmas. One of organs of the government which has been entrusted to transform the country into a democratic nation is the Constitutional Court. The objective of this paper is to provide critical analyses of the role of the Constitutional Court of Indonesia in the process of consolidating local democracy. The scope of analysis is con ned to a number of important cases heard by the court on local election disputes from the year 2008 to 2013. The rationale to focus on local election is because local government provides the second layer of government for this unitary country making the governance more democratic and more in touch with local population. The result of the study is the Constitutional Court through its decisions has created conducive political situation and has provided signi cant contributions in the process of consolidating local democracy. In spite of limited number of judges and short period of settlement to disputes brought before it the Court have settled all disputes regarding local elections without much delay The Constitutional Court's Role in Consolidating Democracy and Reforming Local ElectionConstitutional Review, May 2015, Volume 1, Number 1 104 and complaint. Nevertheless there are some areas that need to be addressed by the court to enhance its e ciency and e ectiveness. A few factors have been identi ed to be the cause of the problems namely problem of design of structure of the Court, extension of the scope of authority, period of settlement, over-dosis of authority and the breach of code of ethics of the judges.Thus it is recommended that in order to perpetuate the excellent achievements of the court the institution need to be strengthened by addressing the problems.
The location for the New Yogyakarta International Airport (NYIA) construction involved in land disputes during the land acquisition process. The land acquisition will always lead to disputes or conflicts with the affected people. It is even more complicated if, in the development process, the ruling elite intervenes, external forces outside the local community that are not directly related to the development. This article deals with the question of the government's public perceptions of the legal polemic of land dispute settlement based on Law No.2 of 2012, and concentrates to examine a new model of land dispute resolution from the perspective of affected communities against NYIA. This research is normative-empirical based on primary and secondary data, namely a literature study, field study, using purposive sampling with interviews, FGD, observation, and qualitative descriptive analysis. The result showed the failure of formal litigation and non-litigation approaches offered by Law No.2 of 2012 to resolve the disputes fairly. Village discussions based on local wisdom as a new model for equitable land dispute resolution needs a political review of Law No. 2 of 2012. The new paradigm of agrarian reform must be based on customary law and local wisdom values in the 1945 Constitution and the Agrarian Law. Given recent controversies concerning land disputes, a law on reform and structuring the national agrarian structure, Agrarian conflict resolution law, and law of natural resources management for the community are urgently needed.
In recent years, there has been an increase in the use of harsh censorship in several parts of the globe, notably Africa and Asia. In some cases, the shutdown may be justified, but in other cases, it is driven by the political interest of the regime. The research evaluates the Internet shutdowns in the post-2019 presidential election in Indonesia and during the social unrest in Papua Island. Using normative legal research, which uses statute, case, and comparative approach concludes that although Internet shutdowns in some situations are tolerable, their usage should be less frequent and more restricted. These explanations must be examined using legality, legitimacy, and proportionality principles to limit official arguments for Internet shutdowns because they infringe on human rights. However, since no enforcement mechanism exists, this is only a formality. The Indonesian government's decision to block Internet access to social media platforms during the 2019 presidential election riots and Papua social unrest is not an appropriate response because the decision violates the principles of declaration, proportionality, necessity, and legality, which must be respected even in an emergency situation. Furthermore, the ruling infringed on the civil rights to information controlled by Article 19 of the ICCPR as adopted by Law Number 12 of 2005. It also harmed several industries, including digital-based commerce. The research proffers alternative Internet policy choices for the government in response to the political escalation and social unrest.
