This research was conducted to find out how other understanding arrangements that are contrary to Pancasila in Law No. 16 of 2017; and What are the criteria or objective measures of an understanding that are considered contrary to the Pancasila and which institution is competent in evaluating an understanding that is considered to be in conflict with the Pancasila. To be able to find an objective measure of “understanding that is contrary to Pancasila”, several approaches can be used namely, first the Philosophical approach, which focuses on theoretical deepening of the rule of law with the core of the study explaining that an Act must emerge with the principle of concrete rules and is easily understood generally. Secondly, the Juridical approach which explains that the mention of the two last additional elements in the explanation of Article 59 paragraph 4 letter c of Law No. 16 of 2017. And third, a sociological approach that explains that to be able to find an objective measurement mechanism for "understanding contrary to Pancasila". In the provisions of the prohibition of Community Organizations contained in Article 59 of Law No. 16 of 2017 specifically related to "Understanding that is contrary to Pancasila", is very laden with nuances of social and moral values, therefore to be able to measure actions or understandings that are considered to be in conflict with it must be submitted to the judiciary in evaluating it.
The research was intended to determine the prerogative of the President on the Constitution of the Republic of Indonesia 1945, and to know the prerogative of the President in the appointment and dismissal of the Head of the Indonesian National Police, so as to prevent conflicts or potential conflicts between the president and parliament in the appointment and dismissal of the police chief.The research method used is normative law research method with the statute approach and the conceptual approach. Through statute approach, researchers will conduct in-depth study of the article of the Constitution of the Republic of Indonesia 1945, and the Act on the prerogative of the President in the appointment and dismissal of the police chief. While the conceptual approach, researchers will study the concepts of the thinking of experts in Constitutional Law related to the prerogative of the President in the appointment and dismissal of the police chief.The results showed that the prerogative of the President in the appointment and dismissal of the Chief of Police is restricted by the requirement for approval of the House of Representatives as a form of checks and balances between state institutions. This is a form of control of the House of Representatives as a representative of all the people of Indonesia who have sovereignty under the Constitution of 1945.
This study aims to determine the legal essence of the inclusion of the conveyancer signature and identity columns on the SSPD BPHTB form in Lombok Island, determine the legal basis of the policy of the inclusion of the conveyancer signature and identity columns on the SSPD BPHTB form in Lombok Island and determine the legal consequences of inclusion of conveyancer signature and identity columns on SSPD BPHTB form in Lombok Island. This is empirical legal research that uses a sociological juridical approach, statute approach, conceptual approach and comparative approach. The results showed that 1) the legal essence of the inclusion of the conveyancer signature and identity columns on the SSPD BPHTB form is: a) based on legal certainty, i.e. providing certainty to find out the conveyancer location and identity that takes care of the transfer of land rights and providing certainty for the regional government for profit sharing from central and regional tax revenues, b) based on benefit, i.e. it can provide benefits to the Regional Revenue Agency, but it adversely affects conveyancer, c) based on justice, i.e. it does not reflect the principle of justice. 2) The legal basis of the inclusion of the conveyancer signature and identity columns on the SSPD BPHTB form can be found in the legislation. 3) Policies of the inclusion of the conveyancer signature and identity columns on the SSPD BPHTB form give legal consequences to the conveyancer which creates liability and sanction.
Fungsi hukum dalam komersialisasi dan eksploitasi invensi dan kreasi kekayaan intelektual yang dihasilkan oleh Industri kecil menengah merupakan bagaian dari upaya yang dapat dilakukan agar industri kecil menengah memperoleh kepastian dan perlindungan hukum terhadap penggunaan atau pemanfaatan invensi dan kreasi yang dihasilkannya. Untuk mendapatkan perlindungan hukum agar tidak diklaim dan untuk dapat menuntut pihak lain yang menggunakan tanpa ijin, maka industri kecil menengah yang menghasilkan invensi dan kreasi tertentu sesuai dengan peraturan yang berlaku di bidang kekayaan intelektual di Indonesia maka wajib hukumnya untuk didaftarkan (prinsif konstitutif), kemudian setelah dilakukan pendaftaran Hak Kekayaan Intelektual tersebut dalam pengekploitasian dan pengkomersialisasiannya agar Industri kecil menengah aman, maka dapat dilakukan dengan mekanisme Hukum Jual beli, lisensi (ijin pemanfaatan), Joint venture (usaha patungan) dan melalui mekanisme franchising (waralaba).
Penelitian ini bertujuan untuk memperoleh data empiris mengenai: pemahaman system dan dinamika demokrasi Pancasila dengan sikap demokrasi dan tanggung jawab belajar siswa. Penelitian dilaksanakan mulai Agustus sd Oktober 2020, metode yang digunakan adalah survey dengan pendekatan korelasional. Populasi penelitian adalah siswa SMAN 78 Jakarta 199 siswa. Teknik analisis data menggunakan analisis regresi berganda. Instrumen yang digunakan adalah tes untuk variabel X1 (pemahaman sistem dan dinamika demokrasi pancasila), sedangkan variabel X2 (sikap demokrasi siswa), dan variabel Y (tanggung jawab belajar siswa) menggunakan angket. Keseluruhan instrument diuji coba tingkat validitas dan reliabilitasnya pada taraf signifikansi 0,95 atau 0,05%. Pengujian hipotesis dilakukan dengan korelasi Product Moment. Dari hasil perhitungan diperoleh rxy X1 dan X2 bersama-sama dengan Y sebesar 0,9851 adapun rtabel sebesar 0,1391. Karena rhitung lebih besar dari rtabel (0,9851>0,1391), maka dapat disimpulkan bahwa terdapat hubungan signifikan. Koefisien determinasi sebesar 97,05. Dengan demikian konstribusi variabel X1 dan X2 terhadap Y sebesar 97,05%. Tingkat keberartian hubungan kedua variabel dilakukan dengan uji-F. Dari hasil perhitungan doperoleh Fhitung sebesar 3226,158 Taraf signifikansi 0,05 dengan dk=199 dan Ftabel sebesar 3,042 Dengan demikian Fhitung lebih besar dari Ftabel (3226,158>3,042). Perbandingan kedua nilai thitung tersebut menunjukkan adanya pengaruh yang berarti.
